There is no end to the list of things we could ban under the principles that inform this legislation. Roman artifacts? Egyptian? Mongolian? Japanese? Moorish? The British Empire? Banning the sale and removing the trade value is tantamount to destroying history. What is going to happen to peoples collections when they pass on and their children don't share their fascination for history? Can't sell them? Into the bin they go.. People will make the argument that they belong in a museum - and its true - to some extent, there certainly are items of immense importance that do belong in museums. But museums are also constricted by reality. They have limited funds, limited space and limited staff - they do not have the means to look after every single historical artifact in existence. It is not uncommon at all for militaria to be ex-museum stock, and it is thanks to private collectors that these items survive for future generations. I don't even have a single 20th century German item in my collection and still think it's sad to see such an ignorant law coming to Australia. These items are part of history and part of our shared human story, warts and all.
A good friend of mine has a war museum (in the UK) based upon his personal collection of over 40 years. For a long time he did not display any German items as he was concerned about offending people. It was actually the veterans themselves who changed his mind. Having done the tour of the museum they would ask him where the German section was and he would explain that there wasn’t one. To a man (and women) they said that there most certainly should be a German display as without it the rest just has no context. That’s the thing about history, you need to know the whole story and not just pick and choose based the sensibilities of the day (which let’s face it, can change like the tide).

I have not spoken to a single client, friend or any other person since this whole saga began 2 months ago who would argue with your very valid example of why this proposed legislation is wrong. The problem we face here is there is one lobbyist who is pushing this to any politician or media organisation who will listen. He continues to harangue and abuse any person who does not share his own narrow view on the issue and wants to wipe out all connection of the Third Reich era and German history because of the horrible atrocities Hitler unleashed on Europe during that period. And in that movie, it became so absurd that it wasn't just about the things from the past, it became about things that mocked politicians. It became about political dissidents being imprisoned. It became about a "free country" turning into the very thing it once fought against: A dictatorial and surveillance police state, just like the Axis powers a century ago. And I, for one, do not want those that fight dictators and tyrants to become the dictators and tyrants themselves. And two, I learn history on my own so that I can confirm what I learned in school. I also have a very skeptical and cynical nature, and even I must accept history as it happened, when I find events, people, and places that confirm primary sources. So to say, "[you] believe all the history they taught you in school?", denies the very fact of historical facts and evidence, because what I believe is actually not mere belief, as it is not my opinion, but rather what I "believe" is fact. Thus, what I "believe" is a historical record, and because it is, there is not much of an argument that can be made against it. Refuting a confirmed historical record is not exactly an easy thing for anyone to do, let alone to succeed at doing.

The dead are merely witnesses to history, who, when alive, could have sworn to the veracity of history in their time. When they go, they leave behind things like letters, diaries, and other documents that give a look into what history was like for them. Some things, like language, and even dialects, do die out when nobody speaks them any longer, such as Occitan, a language from the Middle Ages. Others, like Latin, are only spoken in certain circles, and are not spoken conversationally. And of course, you have modern-day languages like English that have their roots in history as well, that have dialects or spoken variants that aren't spoken any longer, such as the "King's English" from the King James Bible. But the fact is, I can still know history by what is left behind from any era I may be learning about. Just because I was not at Dachau, for example, does not mean that I can't know or understand how evil of an atrocity the Holocaust was. The same is true for the US Civil War, the Revolution, or even the early colonial period. The same is true for the times of the Romans, the Vikings, the Samurai, the Mongols, and the Chinese. The same is true for the Hundred Years' War and the Black Plague. Etc., etc., ad nauseum.
The US Army 45th infantry division feathered a yellow swastika on a red diamond shaped unit patch. It was changed in 1939. Should the soldiers who served honorable wearing that patch before WW2 be dishonored because that symbol has been tainted?
I'm a German headgear collector for over 30 years in the US. I've been following this story with interest. SS overcoats have already been destroyed by custom agents. If the law passes, will the government give you time to get rid of your items? Will you do what the government commands? What about the black market that is sure to break out. How is this similar to the relatively recent ban on gel balls toy guns? Those ball guns were banned in WA unilaterally with no consultation whatsoever with those that engage in the hobby. I understand the dangers that people might be put if they wield those often realistic looking toys in public, the greatest danger mostly being to the wielders themselves from being shot by police. But that is not the point. Like Jamey said here about the memorabilia, there was no consultation with the public, there was no middle ground. An outright ban by a nanny state with authoritarian tendencies. That is not what a free country looks like, but that is what happens when a government feels emboldened by a voting public that overwhelmingly votes for them with no meaningful opposition. Who cares about principles of freedom and consulting the public that voted for them?

Just don't simply swallow government narrative uncritically. I have great love for the Jewish people and unashamedly so. Why do I collect, and especially documents? A big part is to do my part in preserving history to teach the next generation about what happened, something that I will not entrust to government to do impartially. Finally, let us put aside the type of items being collected. It is not about collecting; it is about freedom. Governments should not have constitutional or legal power to regulate the trading of something that is harmless or else cannot be proven beyond all doubt to be harmful. I collect old Poetry Books and have many by Rudyard Kipling from the 1910s to 1930s which all have Swastika symbols on their covers ( Mr Kipling was a strong British Patriot).They have this symbol because it means "Good Luck". Let me first say, I’m a militaria collector, and do not want this ban in Australia. However, I don’t believe the axis comparison discussion is an effective way of presenting our argument- it only disparages other groups. Part of the problem is there are only Neo Nazis, not other axis nations., and their hate is real and dangerous. History is the key. It is important to preserve these relics so we never forget., especially young people. Understanding mid 20th century politics is critical to the future of this planet. I can't agree with all the arguments you presented but I can agree that this type of proposed legislation is ridiculous. I work in the heritage field and live in a Muslim country where Christain crosses are not actually banned, but have been eradicated from so many ancient monuments here. What is even crazier about this legislation is that if not probably thought out it would stop a Hindu from parading what is to him /her a good luck symbol! Even Germany allows the continued existence of the swastika or a version thereof if it is something historical - and not displayed as a politcal symbol

Great presentation! This legislation is just another example of government over-reach based not on facts, but "feelings". However, human history is replete with horrors and atrocities committed by one group or another. Sometimes artifacts with symbols survive for centuries. Would the person who initiated this modern legislation also have hurt feelings regarding atrocities committed during other eras? The Spanish Inquisition? Classical Rome? Would this person "feel" justified in purging all museums and historical archives of all other "offensive" relics and symbols? Probably the vast majority of the surviving military artifacts of this period were war trophies taken initially by veterans as souvenirs of their campaign against an infamous and notorious regime. In the post-war period, there were no factories churning out miliaria for a defunct regime. These artifacts are now only collectible militaria, not symbols that could rally any viable resurgence in a totally vanquished ideology. To propose legislation to ban them is ridiculous.

The issue is not so clear cut as our modern day politicos think Grandfather served in the Stukas with I./StG 77, while his father in law (my great grand father) Georg hosted pre war regional Jewish business guild meetings at his brauerei defying the regional NSDAP administration. Georg was even investigated by the Gestapo for suspected ancestry. My Grandmother was even betrothed to a Jewish man across the Atlantic in NYC before the war, instead marrying my Grandfather in 1943............So I will keep my Grandfathers Luftwaffe dress dagger, ribbon bar, and war photo album until my dying day. Before being adopted by 'the Nazis' the swastika was a peace symbol in many Nordic countries, particularly Finland. In fact Finland also used the swastika symbol on its aircraft during WW2. In Ireland too it was seen as just another symbol from historic times, in the 1950s the Swastika Laundry was a wll known Dublin company and nobody associated it with Nazism. Over a decade ago I spent thousands on my collection. Its been stored away in boxes that I figure when I pass away my children can sell it as part of their inheritance. Well said and a brilliant argument . I worked with a man whose father was 14 years old at the end of WW2 and was forced into a German uniform and given a rifle and forced to fight the Americans. I think he was a hero not a criminal. There are not many German, Russian or Japanese businessmen in Australia making political donations, maybe look at who is making these donations and that will tell you why this legislation is going through.

Can I just say that my uncle fought in the British 8th Army in North Africa and was captured at Tobruk in 1941? I believe. He was released in 1945. Never once was he offended by the Swastika, and he saw it up close and personal. Even up to his death in 1999, he would talk about the war and the Germans, still never offended. I once showed him a German helmet and he said jokingly they played football with them. My point is that if any one should be offended by the Nazis, then it should be those who were there or experience that era, not those who were born decades later. He wasn't offended, so they have no right to be offended.

Greg, we have already seen several examples of imported Third Reich items being held, shredded and classed as 'objectionable' in the eyes of A.B.F. under the 1956 Customs Act. So whilst the bill is still before parliament, being looked at by a select committee, every collector must contact their local member of parliament and make a submission to this committee to make their voice heard. If only a few of us dare speak up, those wanting to ban this part of collecting will win and no one, nor future generations will be able to collect and have the freedom to enjoy military history without feeling afraid of being locked up for a year in prison. It is a serious matter and one which we should all be well aware of and voice our opinions, as we have every right to do in a democratic country like Australia. JB

There is no end to the list of things we could ban under the principles that inform this legislation. Roman artifacts? Egyptian? Mongolian? Japanese? Moorish? The British Empire?
Banning the sale and removing the trade value is tantamount to destroying history. What is going to happen to peoples collections when they pass on and their children don't share their fascination for history? Can't sell them? Into the bin they go.. People will make the argument that they belong in a museum - and its true - to some extent, there certainly are items of immense importance that do belong in museums.
But museums are also constricted by reality. They have limited funds, limited space and limited staff - they do not have the means to look after every single historical artifact in existence. It is not uncommon at all for militaria to be ex-museum stock, and it is thanks to private collectors that these items survive for future generations.
I don't even have a single 20th century German item in my collection and still think it's sad to see such an ignorant law coming to Australia. These items are part of history and part of our shared human story, warts and all.
A good friend of mine has a war museum (in the UK) based upon his personal collection of over 40 years. For a long time he did not display any German items as he was concerned about offending people. It was actually the veterans themselves who changed his mind. Having done the tour of the museum they would ask him where the German section was and he would explain that there wasn’t one. To a man (and women) they said that there most certainly should be a German display as without it the rest just has no context. That’s the thing about history, you need to know the whole story and not just pick and choose based the sensibilities of the day (which let’s face it, can change like the tide).

I have not spoken to a single client, friend or any other person since this whole saga began 2 months ago who would argue with your very valid example of why this proposed legislation is wrong. The problem we face here is there is one lobbyist who is pushing this to any politician or media organisation who will listen. He continues to harangue and abuse any person who does not share his own narrow view on the issue and wants to wipe out all connection of the Third Reich era and German history because of the horrible atrocities Hitler unleashed on Europe during that period. To consign this period of history to the dustbin will only energise any supposed neo Nazis and give them a platform to attack any member of the Jewish faith for such a ban. Unfortunately many members of the Jewish community will no doubt feel the backlash of such a ban, which will only continue to divide society and polarise the issue. Let's hope cooler heads prevail here.

If this law is allowed to pass, we should also demand that all symbols that has been associated with death and destruction be banned.
They would include the following:
1. Religious symbols like the crescent and the star, the cross, the Star of David, etc.
2. The communist hammer and sickle.

4. Flags of countries who were colonial powers.

In all honesty, this sounds a lot like V For Vendetta. And in that movie, it became so absurd that it wasn't just about the things from the past, it became about things that mocked politicians. It became about political dissidents being imprisoned. It became about a "free country" turning into the very thing it once fought against: A dictatorial and surveillance police state, just like the Axis powers a century ago. And I, for one, do not want those that fight dictators and tyrants to become the dictators and tyrants themselves. Because in that sense, the statement "Absolute power corrupts absolutely" becomes very true, and also becomes a stark reminder of why freedom is not dictated by any one man, or even by any one government. The social contract is, as long as you don't trespass or invade someone else's rights; as long as you cause no demonstrable harm to others (which has to be backed by facts and evidence), then you are free to do, including own, anything you like.
And that's the way it should be.

I also have a very skeptical and cynical nature, and even I must accept history as it happened, when I find events, people, and places that confirm primary sources.
So to say, "[you] believe all the history they taught you in school?", denies the very fact of historical facts and evidence, because what I believe is actually not mere belief, as it is not my opinion, but rather what I "believe" is fact.
Thus, what I "believe" is a historical record, and because it is, there is not much of an argument that can be made against it. Refuting a confirmed historical record is not exactly an easy thing for anyone to do, let alone to succeed at doing.

The dead are merely witnesses to history, who, when alive, could have sworn to the veracity of history in their time. When they go, they leave behind things like letters, diaries, and other documents that give a look into what history was like for them. Some things, like language, and even dialects, do die out when nobody speaks them any longer, such as Occitan, a language from the Middle Ages. Others, like Latin, are only spoken in certain circles, and are not spoken conversationally. And of course, you have modern-day languages like English that have their roots in history as well, that have dialects or spoken variants that aren't spoken any longer, such as the "King's English" from the King James Bible.
But the fact is, I can still know history by what is left behind from any era I may be learning about. Just because I was not at Dachau, for example, does not mean that I can't know or understand how evil of an atrocity the Holocaust was. The same is true for the US Civil War, the Revolution, or even the early colonial period. The same is true for the times of the Romans, the Vikings, the Samurai, the Mongols, and the Chinese. The same is true for the Hundred Years' War and the Black Plague. Etc., etc., ad nauseum.

The US Army 45th infantry division feathered a yellow swastika on a red diamond shaped unit patch. It was changed in 1939. Should the soldiers who served honorable wearing that patch before WW2 be dishonored because that symbol has been tainted?

I'm a German headgear collector for over 30 years in the US. I've been following this story with interest. SS overcoats have already been destroyed by custom agents. If the law passes, will the government give you time to get rid of your items? Will you do what the government commands? What about the black market that is sure to break out. Good presentation, you make some valid points. A collection of memorabilia isn't the same as believing and propagating an ideology.
How is this similar to the relatively recent ban on gel balls toy guns? Those ball guns were banned in WA unilaterally with no consultation whatsoever with those that engage in the hobby. I understand the dangers that people might be put if they wield those often realistic looking toys in public, the greatest danger mostly being to the wielders themselves from being shot by police. But that is not the point. Like Jamey said here about the memorabilia, there was no consultation with the public, there was no middle ground. An outright ban by a nanny state with authoritarian tendencies. That is not what a free country looks like, but that is what happens when a government feels emboldened by a voting public that overwhelmingly votes for them with no meaningful opposition. Who cares about principles of freedom and consulting the public that voted for them?

Jamey was a history teacher. But if you find yourself unconvinced by his reasoned explanation, backed by historical data, then you are free to look up that information yourself. Just don't simply swallow government narrative uncritically. I have great love for the Jewish people and unashamedly so. Why do I collect, and especially documents? A big part is to do my part in preserving history to teach the next generation about what happened, something that I will not entrust to government to do impartially. Finally, let us put aside the type of items being collected. It is not about collecting; it is about freedom. Governments should not have constitutional or legal power to regulate the trading of something that is harmless or else cannot be proven beyond all doubt to be harmful. That is not what a free society looks like. Then again, Australians as a whole have recently shown that we do not put a high value on freedom and prefer nanny statism, so maybe there's that too.

I collect old Poetry Books and have many by Rudyard Kipling from the 1910s to 1930s which all have Swastika symbols on their covers ( Mr Kipling was a strong British Patriot).They have this symbol because it means "Good Luck".

Just the other night I was watching a very popular gun shooters channel in the US and had Tucker Carlson on it 2 rifles presented one had a foregrip for hand so it does not get burned , and another had a hook on the shoulder butt.
Tucker interviewed the actual law maker that banned this, and she couldn't tell Tucker what they were actually for !

I work as a community mental health support worker which often includes work with ex military personnel Every one has the desire for the memory of service people to be kept alive and this includes what they had to experience Collecting militaria is a hobby that people enjoy whilst being so important in keeping history alive to hopefully try to prevent the results of conflict happening again

However, I don’t believe the axis comparison discussion is an effective way of presenting our argument- it only disparages other groups. Part of the problem is there are only Neo Nazis, not other axis nations., and their hate is real and dangerous. History is the key. It is important to preserve these relics so we never forget., especially young people. Understanding mid 20th century politics is critical to the future of this planet. I can't agree with all the arguments you presented but I can agree that this type of proposed legislation is ridiculous. I work in the heritage field and live in a Muslim country where Christain crosses are not actually banned, but have been eradicated from so many ancient monuments here. What is even crazier about this legislation is that if not probably thought out it would stop a Hindu from parading what is to him /her a good luck symbol! Even Germany allows the continued existence of the swastika or a version thereof if it is something historical - and not displayed as a politcal symbol

Great presentation! This legislation is just another example of government over-reach based not on facts, but "feelings".
However, human history is replete with horrors and atrocities committed by one group or another. Sometimes artifacts with symbols survive for centuries. Would the person who initiated this modern legislation also have hurt feelings regarding atrocities committed during other eras? The Spanish Inquisition? Classical Rome? Would this person "feel" justified in purging all museums and historical archives of all other "offensive" relics and symbols?
Probably the vast majority of the surviving military artifacts of this period were war trophies taken initially by veterans as souvenirs of their campaign against an infamous and notorious regime. In the post-war period, there were no factories churning out miliaria for a defunct regime.
These artifacts are now only collectible militaria, not symbols that could rally any viable resurgence in a totally vanquished ideology. To propose legislation to ban them is ridiculous.

Grandfather served in the Stukas with I./StG 77, while his father in law (my great grand father) Georg hosted pre war regional Jewish business guild meetings at his brauerei defying the regional NSDAP administration. My Grandmother was even betrothed to a Jewish man across the Atlantic in NYC before the war, instead marrying my Grandfather in 1943............So I will keep my Grandfathers Luftwaffe dress dagger, ribbon bar, and war photo album until my dying day. Before being adopted by 'the Nazis' the swastika was a peace symbol in many Nordic countries, particularly Finland. In fact Finland also used the swastika symbol on its aircraft during WW2. In Ireland too it was seen as just another symbol from historic times, in the 1950s the Swastika Laundry was a wll known Dublin company and nobody associated it with Nazism. Sounds like Australia is going down the same woke culture route that is affecting daily life here in UK nowadays.... over sensitive snowflakes trying to re-write or obliterate aspects of history that don't align with their own thoughts.

I agree that this legislation interfering with the activities of genuine collectors is unfortunate and perhaps unfair. I assume that is has only been proposed due to the actions of a minority group of people who identify as neo Nazis. I'm sorry that people who aren't part of the problem are going to be adversely affected, but I do support in principal legislation that assists with ridding our society of neo Nazi coward scum.
Over a decade ago I spent thousands on my collection. Its been stored away in boxes that I figure when I pass away my children can sell it as part of their inheritance. I thought I was saving pieces of history that would benefit my children's future. Now the government made it all worthless in this country to the point it's a crime. Well said and a brilliant argument . I worked with a man whose father was 14 years old at the end of WW2 and was forced into a German uniform and given a rifle and forced to fight the Americans. I think he was a hero not a criminal. There are not many German, Russian or Japanese businessmen in Australia making political donations, maybe look at who is making these donations and that will tell you why this legislation is going through.

Can I just say that my uncle fought in the British 8th Army in North Africa and was captured at Tobruk in 1941? I believe. He was released in 1945. Never once was he offended by the Swastika, and he saw it up close and personal. Even up to his death in 1999, he would talk about the war and the Germans, still never offended. I once showed him a German helmet and he said jokingly they played football with them. My point is that if any one should be offended by the Nazis, then it should be those who were there or experience that era, not those who were born decades later. He wasn't offended, so they have no right to be offended.

Greg, we have already seen several examples of imported Third Reich items being held, shredded and classed as 'objectionable' in the eyes of A.B.F. under the 1956 Customs Act. So whilst the bill is still before parliament, being looked at by a select committee, every collector must contact their local member of parliament and make a submission to this committee to make their voice heard. If only a few of us dare speak up, those wanting to ban this part of collecting will win and no one, nor future generations will be able to collect and have the freedom to enjoy military history without feeling afraid of being locked up for a year in prison. It is a serious matter and one which we should all be well aware of and voice our opinions, as we have every right to do in a democratic country like Australia. JB
