Extremely helpful video. Filed a wrongful death case on November 17th, 2020 against a nursing home, and Mediation is getting close after 20 months. Your video put me at ease for sure. Thank you!
@@jayionniepage8209 it turned out really well surprisingly. I actually didn’t expect to leave happy that we settled for 90% of our goal. I expected that both parties would leave not happy. It really does depend how your proof is stacked up making the other party ending their battle due to lack of evidence.

I hear you, mine as well! I’m going on 3 years of waiting and I have to email my attorney just to get answers! Hope all is well and you have moved forward with your case!
I got hurt at my job and my case is 17 years old and I'm still going to see a doctor and he wants to do surgery on my hand and shoulder and the insurance has been denying it. I don't know what to do I am still in pain and taking medication and still under a lot of stress.
I go to meditation in two weeks. The defense/insurance adjuster already offered several offers. Should I be excited as a plaintiff about this mediation
@@derrickadams3955 I always go into a mediation hopeful to settle - but not dead set or desperate for it. It is important to continue planning for trial even during the mediation. Where is the offer in relation to a realistic jury judgment? How long is it gonna take to get there and how much will it cost in extra expenses to get there and what is the risk.? Remember this, a lawyer can always scare his clients into settling the case. If your lawyer does not have an active trial history of actually going to trial and getting great results for a clients like we fortunately do, a lot of lawyers will simply talk big and then scare the heck out of you to get you to take this off now. Sometimes there’s very good reasons to take it right now especially if you have some negative parts on your own as far as liability problems or pre-existing injury problems that are true problems. So much of this depends on so many things and an attorney I cannot guarantee my client any result. The best situation for my clients to go to trial or when the insurance company has obviously made a lowball offer and they are sticking firm with it. That is good for me and my clients because we don’t really have that much to lose. Sometimes we do and we still come out very good. It’s a case by case basis. Do not ever let the mediator know that you really want to settle your case. I think there is subtle body language that can communicate to the mediator that you are willing to settle this case at the end of the day no matter how much or how little the insurance company offers you. Good luck with everything. Let us know how it turns out. John
I have a mediation settlement conference in 2 weeks. I think my case is pretty cute and dry. My nerves in my leg are hurting really bad and it's been 11 months since the incident. It happened at work do this is a workmans comp case. The drain hole my foot got stuck in had cardboard and tape over it. I've been to 3 doctors. They all day the same thing . Ankle sprain with neuritis. And neurogenic pain . I am not paying out of pocket to see a neurologist and having a nerve conduction test right now I'm about to have the test. They have delayed my care by almost 3 1/2 months. They sent me 100 Miles away for a IME and the Dr said the same thing. . what can I expect during this mediation settlement conference? I'm in north Carolina
My lawyer is still going to college and doesn’t know shit. I’ve been doin to contacting the other party has me as the lawyer. Can I make them go less than their 31 % because they deserve -31% giving me false info and lying to me and locking door on me and being info in random people to talk to me
You deserve better. I would give them one more chance and if you still get no communication- get a better lawyer. A good lawyer can make a huge difference in your case.

Your video is a magnificent resource to learn about legal mediation. I appreciate your knowledge, wisdom, kindness, and approach to help us learn about the intent and possible outcomes of mediation. I have a couple of questions if you have the time to assist. (1) Does the possibility of winning a large settlement in a personal injury lawsuit greatly increase when the plaintiff has permanent injuries? (2) Is a video recording of the incident valuable if it shows the event that led to the plaintiff being severely injured? (3) Finally, does it help the plaintiff's case if the defendant's team acknowledges the plaintiff as having no fault when he/she was severely injured? Or is that just a way to "lure" the plaintiff to a low-ball early settlement? Thank you sir, and much respect and appreciation to you and your company.
You have a GREAT method of delivering information and very calm. Mediation #2 is where we are headed after two years of almost nothing. THANK YOU!!!
You are so welcome. Good luck to you!
this was the best explanation of mediation I have seen thanks

Very informative my first mediation was today and it was unsuccessful. Thanks for the great video.
That’s okay. The insurance company will likely pay more down the line. Push for a trial date asap. Good luck. JohnG
