      The Supreme Court is IMHO, in a large part corrupt. The Conservative Supremes pretend to be ORIGINALISTS, HOWEVER, they are not unless it fits their whim. The Supreme Court Judges know DAMN WELL, that our Founding Fathers did not want a Unitary Presidency, they Did Not want a Monarchy. The settlers her were in a large part those who left England because of the English Monarchy and the Devine Rights of Kings and Queens. In no reasonable way can they construe the Presidency to be a position above the law.
      Read the Federalist Papers, STOP BEING SHEEPLE!!!
      Additionally, Trump's Acts were not within the outside orbit of his power or authority. The Executive Branch has no Authority WRT to Presidential Elections. Presidents are immune to Civil Suits while holding office, not Criminal Acts. Even further a past President is not covered by Civil or Criminal immunity for unofficial acts!

    If all the charges in the indictment are about non-official acts, which is the case, then why is the Supreme Court even getting involved in this matter?? Nobody is arguing that Trump was acting officially. The question of official vs. non-official doesn't even arise from the indictments!!! It's hard to see a legitimate legal question that made it necessary for SCOTUS to hear this case. It ends up serving only one purpose, and that is to delay the Jan. 6 case against Trump long enough to insure it won't be heard until after the election. Unforgivable.

    To make a distinction between a private and an official act suggests that the incumbent of the American presidency has the ability to periodically go on or off duty.. Actually, those justices who kept saying that they were concerned for the future were departing from a longstanding principle that guides the work of the Supreme Court. That is, that it keeps its review to the most narrow margins, to deliberate only over the specifics of the case before them, rather than venture into the realm of legislating from the bench. They seem to have totally forgotten that, or at least a few of them have, in their current deliberations. It's pretty alarming, frankly. Too much of today's discussion had nothing to do with the Jan. 6 case!

It was authorized by President Kennedy but operated under the jurisdiction of the CIA. The legality of such covert operations often depends on interpretation and context, but as it was conducted by an agency under executive authority, it wasn't directly attributed to the president as a criminal act. Additionally, at the time, there was significant support for aggressive actions against communist regimes, which influenced the perception of such operations.

    "If" I'm following this case in the proper context which is that the law of the land does, or should provide for President Trump, or any president, to be held criminally liable for acts committed while president that benefits that president which act, or acts can be deemed criminal in nature which legal logic should be a given. Therefore, it does appear that an impeachment would be the initial remedy and if successful, then there could be a criminal prosecution in the federal courts afterward. However, in this case of President Trump being "accused" of trying to "overturn" the 2020 general election has the added beneficial element for our entire nation that far exceeds President Trump's personal benefit of being able to continue serving as president. This benefit is that "if" the 2020 general election was indeed "proven" to have been fraudulent we the people benefit in having the individual in office as the president who was duly elected, along with the exposure and then the appropriate criminal prosecution of those responsible for corrupting/stealing the 2020 general election which removal of that criminal element from our society is a further benefit to our nation, as the law requires. The problem is that there was never a trial held that would have been able to determine, one way or the other, as whether or not there was a corrupted/stolen 2020 general election thus there was no "impeachment", of a sort, with a finding of guilt which "guilt" would have been the proving of having a fair election, that would provide for a subsequent criminal prosecution for trying to steal the 2020 general election.
    In other words, it appears to this layman that several legal requirements are being "skipped over" that shouldn't have been "skipped over" which omission of the due process of law appears, to me anyway, to negate this particular presidential immunity hearing? To belabor my point, President Trump hasn't been "legally proven" to be guilty of anything to do with stealing the 2020 general election, and from what I understand, he has never even been charged with any criminal act related to him trying to steal the 2020 general election, so..., like..., ummmm where is the need for immunity in the first place? I mean..., am I missing something here?

    • @finesseeeeeee6409
      @finesseeeeeee6409 หลายเดือนก่อน +2

      Maybe I’m missing something too, but he was indicted and they are in pretrial proceedings for the trial, so yes he has been charged, but no of course he has not been found guilty because there hasn’t been a trial yet. As part of the pretrial proceedings, Trump and his team appealed by saying he has presidential immunity, hence us being here. It first went to DC appeals court and was denied, Trump and team then appealed to the Supreme Court.
      Therefore, due process is happening, but the trial has been delayed until it’s determined if he has immunity and thus if this indictment can actually go to trial.
      Remember a lot of this is unprecedented

    • @finesseeeeeee6409
      @finesseeeeeee6409 หลายเดือนก่อน

      Also you referred to an impeachment, but my understanding is that an impeachment only applies to a currently sitting public servant. Thus WHILE Trump was in office, he would’ve had to be impeached on this, but obviously the transfer of power was literally what was happening. Once he was out of office, you can’t impeach anymore, which lends itself into the conversation of criminal proceedings like we have now.
      Also the question of if an impeachment is necessary in general has also been a big one because if it was decided that an impeachment must come first before a criminal action takes place, then someone could do something illegal then step down from their position before an impeachment could happen, thereby skirting the process.

      @@finesseeeeeee6409 My point was and is that for a president, there must first be an impeachment with a finding of guilt before than can be a criminal charge and if there is, it must go through the federal courts AFTER an impartial hearing to determine whether or not it is case worthy of prosecution, or what we have now which is a Witch Hunt. The point remains, even under the current circumstances, there have been short cuts, the lack of due process of the law, and that has to be forbidden.

    Sauer sounds like Davros and the Daleks from “Dr. Who” how appropriate! “Exterminate-exterminate”! I hope the SCOTUS strike down Davros and his Daleks to protect humanity!
