Thank you, Dr for your take on this saga. I have learned so much from this video.
    Note:
-There are Intellectual Property Rights and Technical Rights.
-Always have a signed contracts instead of assuming that your client understands your needs.
    -Create a professional invoice
-Collaboration is vital and we can't take that for granted, but understand what you bring to the table. Communicate your terms and needs clearly.
    - Understand the business of fashion.
Thank you for these lessons, Sir. 🙏🏿

Intellectual property belongs to the person with the Original IDEA/DESIGN....the creator of the dress becomes like a seamstress in this case .... The designer in this instance Olivia does not Own THE IP OF THE DRESS BECAUSE SHE DID NOT IMAGINE AND CREATE IT UNDER IP LAW IN EUROPE. & USA. That's why I DO NOT COPY ANY ORIGINAL GARMENT ALREADY SEEN.. THE 3 DESIGNERS ONLY OWN COPYRIGHT! ITS NANAS INTELLECTUAL PROPERTY AND DESIGN. DONT COPY ANYONE...TRUE DESIGNERS CREATE ORIGINALS FROM THEMES....NOT BY COPYING OR ADAPTING AN ORIGINAL DESIGN FROM ANOTHER!

    • @somtoimmanuela7788
      @somtoimmanuela7788 6 หลายเดือนก่อน +1

Even yoli nor Earl owns the original design. The original design belongs to a US designer whom the copied the word from and then Olivia Ezinne made the changes.

A publisher/producer is also recognised after being paid for jobs. Every effort is remunerated and bringing the Idea to existence is recognised. Asking someone to choose payment over recognition or vice versa is the dumbest thing I now hear.
The autimatum given to Olivia to remove clips of her side of contributions to the work is callous and uncalled for because without her part, the final work wouldn't have come to light, it makes it look like she wasn't in the mix at all. She too can file for a counter but the legal tussle won't be necessary. Credit should have been given to all that played a role. And the question is if others that were tagged/recognised weren't paid any money?

    • @somtoimmanuela7788

If I were Olivia I would have filed for counter law suit against her... These so called celebrities know how to intimidate and bully upcoming brands.

For me I think the Nigerian lady works as a seamstress on her part and yoli and the other group are the designers.
Is like a designer design a piece and either you put it together or you do which one you can do which was clear the Nigerian lady couldn’t figure out the other part and that’s why yoli took it from there.
The thing is you can’t do seamstress work and want to claim a whole designer work while you chose the payment.
My advice to Ghanaians please work with your people because we have good designers and we need to patronize them

I have learnt a lot in this podcast honestly, in this era of social media we need take certain things seriously and the part where You said there are some designers who don’t know how to sew but they are the ones making the money is very true……let’s ask ourselves if the base of the dress wasn’t made would the design be brought to life? Olivia on the other hand could have found a way to tell Nana to tag her and also make her pay for the job done, all the same both parties are wrong in one way or the other, there’s a lot we need to learn when it comes to fashion business and dealing with influencers

Everything you said was on point. When I saw the invoice, I was like what in unprofessionalism is this? I fear that big influencers may not be able to trust Olivia again seeing how she went about the whole thing. I also love the fact that you mentioned that she should have been involved in the 3D creation. How can someone send such a design to you and you made those little designs for it. I was disappointed when I saw the little silver floral designs she showed Nana for that design and she let Nana figure out everything on her own. You are a fashion designer for a reason. Figure the designs out. She should have been the one looking for the factories to produce it and relate it to Nana. I hope we have all learnt from this story.
Finally, I want to say this, if an influencer gives you an option between tagging you and paying you, first weigh the options. Don't get mad and say it is evil. It is not evil because it cost them years and money to build that platform to influence for you. Weigh the options: What is the value of such influencer? How far can their influencing get to? What are your gains if such person tags you? If tagging you would bring in more value than paying you, please take the option that pays you more. You may want to build your brand from scratch but trust me, it will be easier and would require shorter time to get to a certain height if a high profile far reaching influencer puts your brand out there. Would you rather suffer for long to get there?
Nana is a big name. If I were Olivia, I would have found a way to get both the payment and the tag like Dr. Clement mentioned. For instance, I would plead with her to help pay for certain costs like the cost of buying materials and transportation. I would let go of the labour cost. But if getting the two in this case is not possible, personnally, I would have chosen the tag over THAT AMOUNT especially because I didn't contribute to the 3D design. And I would have still had good relationship with Nana and all potential customers who would come through her.
I hope we've all learnt anyways. Thank you so much Dr. Clement for this review. I love love your takes.

Nana caused the whole story🙄🙄... She is obviously benefitting from the controversy, 2) Olivia's flowers should be given her!! She started from day 1 with d back and forth 3) How under heaven will a chanced-courier- designer( according to your story) suddenly become THE designer? Just bcos she helped checked something in China and courier same to Ghana?
Where was she when they started? And how come she didn't travel to Nigeria to fit her for d final look..?
    4) The Ghana designer is just an opportunist...and pls stop all this stylish justification rhetoric with your " all a collaboration thing".. so why don't designers tag beaders and weavers in Dr work?..
    5) And Nana is now going legal on Olivia🙄🙄🤔🤔😀😀😀.. really? Without Olivia's ....will the " so called" design come to life?
Nana is just being a drama queen as expected of someone profiting off and on SM.
Meanwhile, Did she really wanted all that work for free from Olivia?🙄🙄🤔..
Pls help ask Nana....Who "physically made' (sew) the Dress?
And why did she not give her , her dues?..
Was she trying to take advantage?
    ___
Later ...we'll be talking rubbish about Women supporting women...🙄🤔
And DR?.. the Base gave the dress LIFE!!.. and I disagree...the fact that you pay for a dress does not mean you must not tag the designer.
Worse scenario is purposely tagging someone else for the work of ANOTHER!🙄🙄🤔..smh
Undoubtedly, lessons are to be learnt....( Dotting all 'i_s' and crossing all "t_s' ) ...in short .. learning Professionalism

I’m a Ghanaian designer, to be honest, Olivia can claim she made the dress. Nana Akua Addi just wanted Olivia to do the dress for free thinking she’s a big influencer who can help her get more clients by just tagging her. Nana Akua thought she was doing Olivia a favour. That’s bad.

I love you so much. I agree with a lot of things you said. Thanks for the lessons. A real eye opener. My personal take on this is that the intellectual property right of this dress belongs to Nana because she created the design, even found her way around getting the structure done. However, Olivia tailored it so she should have credit for putting it together with other designers also getting credit for their assistance. To me, Yoli shouldn't have been in this picture at all. That's error on Nana's part. You're already working with a designer, why include someone else to do what that design could do? Also, I hate this thing celebrities do where they either give payment or credit. It isn't fair, especially for upcoming designers who cannot afford to give up the money. Pay and give credit. How hard can that be? If you won't give credit to the designer because you paid, then don't give credit at all. It's annoying seeing someone else get credit for your work. It's painful!

@@lydiagyamara7758 First of, Yoli was not the designer in any way, Nana was. She actually guided Yoli on the assembling, probably to hasten time during AMVCA day. She did basically what she would have done with Ezinne during fitting had she(Nana) been in Nigeria. Taking Ezinne's corset dress to Ghana was unnecessary. N Yoli didn't figure out the other part of the dress. Nana also did that.
      DRESS TIMELINE
      ×Nana thought of design
      ×Ezimne built dress
      ×Nana created the 3D design
×Ezinne, on Nana's request, sent dress to Ghana and Yoli fitted another tailor's work
      ×Ezinne did the final placement
To me, the design came to life with the creative efforts of Nana, the 3D illustrator, Chinese company and Ezinne. By the way, designers collaborate all the time. That's why you see,'made for Gucci by so and so. N Ezinne isn't claiming she designed it. She just tailored it but it was made to seem Yoli tailored it. The official shoot of the dress is even on Yoli's page.
N I'm still against this tag or money thing celebrities do. It's unfair. If Ezinne wasn't important to the design process, she wouldn't have had the option to be tagged. N who said other people that got tagged wasn't paid?
N this is not a Ghana/Nigeria thing as netizens have turned it into. It's a fair/unfair thing. Patronise whoever you want. You see the met gala with celebrities patronising whoever from whichever country cos the world is global now. People are trying to be cohesive around the world, shattering borders and we're still doing buy Ghana, buy Nigeria and buy Tanzania here. C'mon now. I stan one Africa; one globe!🌍

Who placed those designs on the inner garment???
Who ever did that, did the actual work, it doesn't matter who produced the 3D design

Olivia sewed the inner corset and also placed the design on the garment which is even quite different from the 3D image they've been circulating.

According to the lawsuit, it was Yoli who contacted her not Nana and she was asked to style her because Yolo couldn't travel, read the lawsuit, Yoli even fixed it and made a video which she was looking at to fix. The lawsuit said she was contacted for the under garment

So Ezinne was contacted for only the undergarment and she went ahead to create the structural design? Yoli contacted a 3D designer because Ezinne didn’t get it right

@@everythingeveedwardsif you believe what was written in that lawsuit, then you can believe anything. How can they tag her and she will say they should untag her, how? That is to tell you that Nana is evil and she knew the right thing to do and refused to do it. The lawsuit even said she was paid 406,000, but, Ezinne and Prudence who trained her, said as at the time of the saga, not a dime had been paid. So this lawsuit will and cannot see the light of day.
