If you have a domestic partner covered on your hdhp and they are not a legal spouse, you can each contribute the full family amount to your respective hsa. Not all plans cover domestic partners, so this is plan specific.
For the HSA loophole; the kids must be ineligible to be claimed as a dependent. Even if you don't claim them as a dependent, if they are ELIGIBLE to be claimed as a dependent you cannot contribute to an HSA for them.
