We should be clear- The allegation is that David Ross distributed the leaked documents as proof to the reporters publishing the story (about it being unencrypted/non-corrupt). This petition alleges that the defendant is interfering with an ongoing investigation. That being said, allegedly the documents are publicly leaked already... Anyway, this is what journalism is. Dig deeper.
I think your missing the point of this. Downloading stolen material is still downloading stolen material if he was contracted by the city this would be different but he indecently with out any legal jurisdiction just knowingly obtained stolen information.
Usually it’s the distribution (and/or use) of stolen materials that gets people in trouble. This honestly could fall under whistleblower laws and because of such the city has no ground. Anyone could go and grab this info to make sure they’re not in it themselves, so there really isn’t that much at play when a researcher “whistles” about the government lying.
