And depends if limitation period available will file a fresh suit otherwise will file a application of set aside to restore the case. My question is which option from above is suitable or in favor or defendent wheather to go for fresh suit or to file set aside application. What are the advantages and disadvantages of both application. In routine practice of court which option the lawyers like to go for.
