I turned up to court. It wasn't even a court room. They rent a interview room and just rearrange a payment plan. Something that could have been done on the phone by the council in the first place.
thing is all council tax court summons they print themselves at what they call a bulking centre at the actual council office so its all a scam
but the couldn't use the scary word court then could they, all mind game, (didn't action in you tuber amongst a list slightly trumped up charges, the council are not the court, and how, a court any court if only for library book charges fees, think it okay, supply, fertilities, to Thera state, all legal scam, why not make full you of the fertilities sell drugs and guns, in the main main entrance, at least that just illegal, and every body involves is a where if that, but deception, of people who this may be there first, interaction with a court, of any kind, it bad enough with silk, lawyers, ban boozing legal mumbo jumbo, say one thing whilst meanly nothing like who the say? the very building are in on it too. it would seem too.
I have not problem with say film company hiring the hole building, if the want too, at least ,the, who think will be duped are people that tv thing everything the show it real and have no concept what an actor is/does as a job?

This is known as COURT DE FACTO and can be ignored. This action is also used by private car parking charges and the best solution is to COMPLETELY IGNORE ie, dont answer letters, your door, never phone them, never enter into discussion, you are not obliged to and by refusing their offer of joinder, they cant claim you have refused to pay as they will need proof. I havent paid for 12 years and its not a criminal offence, nor can it affect your credit score without a court order and for this they need your refusal to pay and if ever this does show on your credit score, you can easily have it removed as proof by the council of your refusal to pay is needed, but you havent refused have you ?
We should ALL do this as council tax is an illegal tax anyway and we have all been manipulated into paying just as we were with TV Licence etc.

What you must do is phone the county court where the summons is from by the number in yellow pages, not the number on the summons and ask if there is a summons in your name.
Chances are there isnt, in which case you can ignore the summons.
Thats what i did and i sent the summons back saying i dont recognise this courts authority and heard no more, but please check first .
Being i debt is not a criminal offence.

Update to the council tax obligation to pay. Over the last year, 20 councils have failed to prove their case. Liverpool council took 8 months, requested 3 adjournment, failed to provide the liability order and dropped their claim 2 days before the case was to be put before a distract Judge. The courts and councils have perverted the course of justice. All claims for council tax must stop.

Can never get hold of our council, phone up get to a robot voice who then gives you a 4 minute talk then tells you to go online or wait for an adviser, the line rings 6 times then you get a message saying we are too busy to take your call please hang up and try again later. I have not paid council tax in over 2 years. The process is relatively simple. Just doing this process for someone else. The person cannot pay they just cannot afford it.
What you need to understand is that a bailiff needs to be appointed by a court. Not the local council pretending to be a court. For a court hearing a court case must be logged not a fake court case, No one has the right to enter your property. The councils rely on intimidation to make you pay.

Years ago, I got a demand for council tax they said I owed them. I very quickly established it was an error, which the council admitted. Despite this, I got more demands which the council said to ignore which I did. Next thing I know, my wages were arrested. Took almost 6 months to sort out. No apology, no compensation. Never assume they are in the right and if it is a mistake get them to put it in writing..

The 150 council tax rebate announced by the government ...i phoned and asked them to take it off my bill and they refused saying they had to give it to me. I was summoned and they gave me the money and then took it back . what an utter waste of time and taxpayers money that was

I've been on a loop with newlyns and equita and In 3 years I've have about 20 agents take the case, only about 5 have ever shown up and they never visited twice they always hand it straight back, newlyns has emailed to say they will no longer dealing with it and equita are just being stubborn but eventually will hand it back for good

My latest lettsr from the west Yorkshire council is a removal proceedings letter. Should i be worried. I made the council an offer but they refused it so thought stuff you then. Is it true the goons can't force their way in.i rent and have no savings and my credit rating is rubbish anyway .

No joinder no contract and you can't have a contract with an Occupier. Check the word Joinder if you don't know it. they charged me £100 court fees for not attending a place that wasn't a Court.

A few years ago there was a post on TH-cam about this very thing . The person rang the court and asked if the Court Summons was Real . There was No record of a summons being issued by the court . The lady on the phone explained to the person that the letter is Probably a Commercial Summons , where councils can hire the court and a Magistrate to " Rubber Stamp " their Claims for Fines and Payments . They simply furnish the " Hired "Magistrate with a list of claims and He / She Approves them Without any Court Case or Evidence . This method is Regularly used for Fines, including Parking and Speeding fines . The chap then asked the person if Anyone can Just Hire the Court, could I hire the Court. He was told I don't see why not was the reply ! I have tried to find the post to send it to you, but it has Disappeared Surprise Surprise
The council is a private corporation, you have no contract with them and are not obliged to pay. They use intimidation and extortion to get your money, which is illegal or so I understand.

You demonstrate a simpleton’s misunderstanding of how law works. The Council Tax A & E regulations order your council to collect said tax from liable parties. They also order your local council to pursue defaulters using a quite specific mechanism contained in the act. Your notion that a law “tells you” to pay tax (or do anything else) is infantile.

My council only send one reminder letter the next letter you get says you have lost the right to pay in instalments and the whole amount is now due......pay by such and such date.
If you fail to comply the third letter is the court summons, the amount you owe plus the court fee of £65. I f you decide to go to court you find there's just someone there stamping the forms, you can't give your side of the story as there's nobody there to listen to it.......court wise it's one big scam. The collection agency (bailiffs) are on the council payroll!

That sounds similar to my council. I've only ever gotten as far as when they tell me that unless I pay that I will have to pay in one big lump sum then I've bottled it and paid. I'm trying to read as many people's experiences as I can to weigh it all up on whether I should just hold the line and not interact with them and completely ignore them all together as hard as it might seem.

The debt collectors have to have a stamp from court by judge a signed by judged and you have not made contract with debt collector..This is not law ..the law is if you don’t pay you then take to court and the judge then says what he decides ..This has to be paid only then to he says so who owns what and no 3rd person can pick up the money …Look at law it’s quite simple .

Before the council can charge you anything they have to prove that you owe anything. Ask for the contract they have with you where you agreed to pay. They can’t because it doesn’t exist. Or just return their letters “return to sender non commercial property” I haven’t paid for eighteen months.

So how would I make a case about this to counter a concil tax summons?
I had a ctax dd set up n it was cancelled but not by me. Didn't have any letters. Just sent a summons. I went down the council n had all sorts of nonsense. Got absolutely no looks on the council what so ever.

I had a summons once, in 1998, though the council tax debt was someone else's. Birmingham City Council didn't care and demanded payment. I argued that it wasn't my debt. They threatened me with prison and I was forced to pay the other person's debts out of my unemployment benefit as I was unemployed at the time. I literally starved to pay this debt. To my knowledge, council tax is the only debt one can still get sent to prison for - unless that has changed now but I doubt it.
As I understand it, prison is supposed to be a last resort.
@@juliewills3592 Yes but they kept threatening me with it from the start. I did prove that the debt wasn't mine but the person whose debt it was refused to pay, so they forced me to pay it - with threats of prison. The person whose debt it was, was the previous tenant at the property.
@@LittleKitty22 I can't quite see how they could get away with that unless you let them. You cannot be forced by anyone into paying a debt that isn't yours. In a situation like this you must either take legal advice or, at the very least, go to your local Citizen's Advice office.
@@SpeccyMan I did. The CAB didn't understand and kept saying "you can always apply for benefits" , which is all they ever say no matter what the topic and I doubt they understand a word one says. They didn't understand that my case had nothing to do with benefits. So I got legal advise, the solicitor wrote to the council but they ignored her letter and proceeded with the summons. So the solicitor went with me to the court hearing and managed to get the summons revoked - but only on the condition that I pay this other person's debts! I got threatened during this court hearing that if I didn't pay, I would be sent to prison.
I then spent several years paying this other person's debts out of my unemployment benefits and starving for it until I found employment and paid the rest off in one go. They even pursued me across counties, ie when I moved away from Birmingham, they continued to hound me - something that is apparently very rarely done and had never been done for such a low amount as what the other person's debts were.
Birmingham City Council were hellbent on getting this money from me, even though their court costs alone must have cost them much more than what they were hounding me for.

Councils have become more corrupt now than in the past i got a summons but no reminders from over two years ago ? i phoned them and said i would pay but not only did they take the money i was supposed to owe them but they added not one but two summons fee's and one of them i never had in first place !

I moved out of my house to become a full time career for a lady in another town . She needed me there all the night as she stops breathing. I'm a very light sleeper anyway so it isn't a problem . I wrote to the council about this and they wanted to know the contents of my cats litter tray. I refused to tell them anything as it's fuck all to do with them . I didn't live in Bridgend any more and moved to another council area . I gave my house to my two daughters as they were going to get it when I croak so no loss to me . I've been hounded by Bridgend council for 3 years now over this . They even sent me a bill for £3400 . Yet my two daughters pay the council tax in full . I don't owe them anything. I don't understand what the fucks wrong with these money grabbing bastards. I have a very small room at this ladies house and all my tools ect are in the double garage at my old address as I have nowhere to store anything where I am . I'm in a situation with the bailiffs I received a removal and sale of goods enforcement letter for council tax. My question is because its a civil debt are they allowed to force entry ??

Just had a letter of enforcement come through our door from a company Bristow and Sutor, claiming we had not paid our council tax, and are demanding we pay over £1700. We have had no letters from Dudley council. Not a single one. My wife phoned Dudley council to see if we have an outstanding debt, and they say we are all paid up, insisting it is nothing to do with them. Of course, the bailiff from B and S would not except this and demanded the money. This nonsense has been going on for over ten years now, usually harassing us about every 12 months or so. They give up after a while, then start up again. Any advice on this?
Tell them you will sue them for harassment. There is a case someone v British Gas. Write a letter, send recorded delivery, make this point, you won’t hear from them again.

I phoned them, Told them I could not pay, Hoping for a new payment date/set-up. Got told over phone NO. If I don't pay I will receive court order, That I now have received. With new payment dates I still can't pay on. 1st October to pay by. But don't get uni credit till 7th
The bad news is those so-called Court costs mine where £80 are added to your council tax bill as you will see if you check your bill. They must be paid happened to my self two years running. It's a sham that needs to be stopped as it's the poor who can't afford to pay council tax.

They seek a liability order from the court BUT now it seems that liability orders are only a Notice due to upgraded legislation. It is no longer a court document that can be enforced with bailiffs of collection agencies. It would be an interesting test to see what happens when they try to enforce non payment if you know the rules.. I am looking into that at the moment trying to understand the legalese. IF your BILL is the "COUNCIL TAX" then 2.5% was added to VAT to pay this tax by NIGEL LAWSON.. So your burden is already paid by that VAT. AT least the burden should be reduced. This is a case of pay twice for the same thing.
I've only got as far as when they tell me that unless I pay by a certain date that I will have to pay it all in one big lump sum. At that point I've bottled it and relented. I'm reading as many peoples comments and experiences on here as I can to weigh up how far I am willing to go in the future as it is getting more and more difficult (same as for everyone) to keep up with the cost of living. I have toyed with the idea of just completely disengaging myself from any letters sent through my door and anyone who I'm not expecting knocking on my door. It’s all a fraud. You need to learn to stand your ground and not pay. We never signed a contract obliging us to pay. Do not go to their fake court summons, do not enter into any written agreement to pay by instalments, ignore ignore ignore. Ask them for proof of contract where you’ve agreed to pay. If they say you’ve been paying for years, say you were under duress, and ask for the contract where you agreed to pay.

I'am 31 , i have the same attitude how far can i push my luck .
I have not paid one penny in council , section 13 1a only works so many times ,
I used f.o.i and data protetion law on the court last known court apperance was aged 17 , so never been court no liability order .
I have seen about 6 baliffs all have left empty handed , no peaceful entry no power of entry and i don't own GOODS i have possesions GOODS is a item for sale

Recently Ive started to feel the same way as you and am considering going down the route of completely ignoring and disengaging from paying my council tax. I'm not as savvy as some of the people that have done the same on here with all the technicalities so was just gonna go down the route of completely not responding to anyone/anything. Thankyou andy for advice on council tax summons i recieved letter yesterday and rang council straight away and managed to make arrangevment to pay it back in installments
2 months hahaha I’m 2 years deep the trick is not to pay get a letter pay a week or two payment stop wait for letter do it again been doing this for 2 years

I’m disappointed you are recommending to pay council tax, I was actually hoping you would advise something more challenging once receiving the summons. I’ve received one and it looks like it was produced by the council not the court. I will not be paying

@D-Bunker That old chestnut 🥱that’s secondary legislation, primary legislation is above that to start with. Also court procedure is not followed and summons are issued by council which is fraud. The amount of legislation the council violate cancels out the little LGFA1992 they hide behind. People should get themselves informed 👍btw I’m not a ‘You’

People delaying payment resulting in the need for councils to pay staff to deal with it and send out reminders cost us all more on our council tax, not impressed.

Try renting if you get a CCJ 😳 or getting a phone
Interesting fact of the day: You can have a CCJ removed from your file if you pay the CCJ in full within a month of the judgement and contact the court with evidence you paid it. I recommend paying it immediately and having the CCJ wiped off your file, definitely. But its easier and cheaper to just pay yo bills in time

"Your council will send you a reminder notice giving you 7 days to pay if you miss a payment. If you don’t pay within 7 days, you’ll have to pay the whole year’s Council Tax instead

Love your vids but you shouldnt provide 'legal advice' on your channel. Councils operate outside of the court system regarding council tax and therefore remedies, offers to pay, or denial of payment can take many forms if you know about the actual legalities relating to your obligation to pay council tax. It cannot be considered a debt. if you default on your council tax so people needn't worry about credit scores. Just another shameful way in which the populace is treated by those organisations we are indoctrinated to believe are there to help us

Wrong. There is no legal obligation to pay. It is not a law as no law can offer exceptions. Everyone must be treated equally. So it is not a legal obligation and non payment cannot be considered a debt in terms of credit score or otherwise. The whole system is a contractual sham and knowing the mechanisms used will free you from the bureaucracy they will throw at you

What is a 'real court'?
Whatever your council claim council tax is an unlawful tax and you will find the facts and the laws that will destroy their case if you see PEACEKEEPRS right here on YT.
You will also see on their own site GOV UK that there hasnt been a liability order since 2003 and every liability order is individual and without the original liability order there cant be any case.
A simple liability order downloaded from the internet will not suffice and you need to digest and be aware of the laws that PEACEKEEPERS quote on his many posts on the subject.
My guess is that this summons has not been sent from a real HM COURT but from a Bulking Centre. and you might like to phone the real HM COURT to ask if there is a warrant in your name because chances are there wont be and you must use the number in yellow pages and NOT the number thats written on the summons.
Bulking Centres are used by councils, private car parking firms etc and are simply rooms hired out in an official court building giving the impression that they are real courts and this means that access is available for them to send out headed court note paper to complete the illusion and this is FRAUD, itself a criminal offence . Dont be fooled.
The person you stand before will either be a council official or a solicitor and not a judge or magistrate and they will only have the power of your AVON LADY.

if it did, be very suspicious as a proper summons should be delivered by hand.
