It’s a risk they take because they’re renting to people that can’t be trusted by other rental companies. That’s why places require a card down-payment instead of cash, etc. I think his business is perfectly legal, but in the end he owns the cars so they are technically his tickets so the city isn’t wrong, but since he has contracts neither is he. I just don’t get why he’d sue this one guy and not all the others that racked up tickets, rather than have a contract stating no parking in the city 🙄 He knows the game he’s playing, so why this lawsuit? Just to be on tv?

they ARE an offbrand enterprise, but actually provide a cool service. I used rent a wreck waaaay back in college 30+ years ago. It was cheaper, which was nice as a broke college kid, and I wasn't able to rent a car because I wasn't 25. You aren't going to get everything you want when you are only spending half as much.
Common sense response, it's clearly outlined in the contract. Tons of people rent vehicles and have no intention or desire to drive them into specific places. I used Rent A Wreck while I was in the military outside of Ft Drum, NY and the contract was the same back then. I used them about once a month to travel to A-Bay, Syracuse, Lake Placid or Black River for camping. That was 20 years ago and it was 19.99 a day and much cheaper than making payments on a car I would barely ever use due to deployments. Well worth the cost to me since I had no plans or desire to go to NYC in it and they always treated me fairly. This company has been around a long time.

If you listened to him, the contract has always stipulated that renters cannot take the vehicles to NYC, but people do anyways and they rack up more tickets than the $300 deposit covers or more than can be charged to the credit cards the person used. It's not hard to rack up over $300 parking tickets over a couple days in NYC if you know you won't pay them.
I like that the Judge read out loud what the defendant was counter seing and when she read out $100 for missed work, she paused for several seconds and looked at him. She did not even have to ask him to prove it, as he wasn't going to get it and no one in their right mind would think he gets $100 a day from somewhere, anywhere.
The company knew that if the car never got into New York then there is nothing the city could do to collect the money owed for parking tickets. But now the city has the car and will sell it to pay for some of the money owing for parking tickets. The plaintiff is SOL!!

NYC tickets cars that are parked illegally. It means the driver is not available. So NYC pastes the ticket onto the vehicle. But why didn't the car rental agency not check to be sure there were no tickets attached to the rental car? Check this at the time the customer returns the car. Then make the customer pay for any parking tickets at that time.
Car insurance companies uses clean retail values. The car can't be replaced for the trade-in value. I don't understand the judge's reluctance to award what the actual value is.

New York city now has a car that can be sold to pay for parking tickets. The plaintiff has to deal with low income people like the defendant. They know they are taking on more risk that other car rental agencies. So now this is what happens occasionally. It is a part of the cost of doing business.
Why not help him? Because you have to come to court with clean hands (aka; the clean hands doctrine). The renter knew he had outstanding tickets which left the vulnerable to towing. While the defendant breached the contract the plaintiff was trying to rip off the city by not settling his parking ticket debts. No clean hands, no reward and any decent judge would have ruled for the defendant.
The contract is illegal as against public policy to rent a vehicle that cannot be rented because it is subject to being impounded. If I rent you my stolen car and you sign a contract requiring you to pay me for the value of the car if the cops impound it, you do not have to pay me for the value of the car. when it gets impounded

How does it make sense for one renter to pay $2600 if the city confiscated the car. Regardless of whether he was in the city or not the car would have gotten confiscated for all the unpaid tickets.
Because the renter is responsible for the missing car because of the contract he agreed to & signed. The car did not get confiscated out of the city. If it had gotten confiscated out of the city, the plaintiff couldn't sue the defendant. In fact I am sure that he wouldnt. He would lose the case & would instead have to pay the defendant for the inconvenience. But in this case, the car got confiscated someplace where the signed contract said that the defendant was not supposed to go.

After an accident the other party’s insurance company provided me with a “Rent A Wreck” vehicle. The brakes failed on the first day I drove it.

Would that be like the meme that my son told me about a few years ago that went something like, "Don't ever make fun of me and my grandson again!" I believe he said it was on Facebook, but I wouldn't know because I've never had an FB page.
