Hi Paul! In states where Trusts are commonly used to avoid probate, I often hear that they avoid the court-involved or lawyer-involved process. In your experience, how often do attorneys become involved in trust administration? As you point out, trusts can be very complicated. In PA, an executor under a will could - theoretically - administer an estate on their own. And it does happen from time to time. Likewise, a Trustee of a Rev trust could - theoretically - administer a trust on their own after the Settlor has died. I'm just curious, in practice, in states where trusts are more common, do they ACTUALLY serve to avoid attorney-involved administration?
My aunt contacted me fir the first time saying i would receive a letter? In mail that would being HAPPY TEARS AND I WOULD TREASURE IT WHATS UP PLUS SOMETHING ABOUT SUBTRUSTS,?
Could you provide an example to describe how the successor trustee takes that position? It is not a court process, but there are documents that a lawyer prepares and likely notarizes how the successor trustee informs the account managers and others that he has this authority to speak got the trust. Also same request to formally convert the grantor revocable living trust to the irrevocable trust. These processes require a lawyer to get the documents right. It is more than getting a death certificate. Another topic could be powers of appointment set up in the trust. TX does not allow for a trust protector function. Instead, I have several powers of appointment, under certain conditions to give my successor trustee some modifications that he can exercise and things that he can direct for his successor when the successor beneficiary passes and the trust terminates.
My husband did a trust work out my knowledge. We living in a community property state. I don't even know if I'm in it. All vehicles are title (or) what could he have done with them? Our house is deeded community property with rights of survivorship. What could he have done with our house?
We appointed my brother trustee of a trust while remaining 4 beneficiaries. He died. No will just a land trust. Now beneficiaries can’t be located. I am petitioning the court for executor/trustee. Can I sell the property?
Thanks for the information. Can a ROTH IRA be placed into a Trust so that those funds can be distributed to a beneficiary over the full ten years and then have the remainder stay in the Trust under a taxable status so the money is available throughout the beneficiary’s retirement?
Sorry missed live stream- do your really need to get a fed tax Id for the estate once someone passes even if all the assets will be distributed before calendar year end? If so why can’t you use the individuals Id. ? Is this illegal?
Why would a power of attorney not work? Do all go null? whats the point getting one then? Also when you say when a spouse dies the trust spits in to two, is that something you need to pay for again to rewrite or it is in the original trust that it splits and their is nothing you need to do?
I’m a joint trustee of the trust of my mom who just died. My brother is asking me to sign something to make him the sole trustee so he can do things more easily. This just doesn’t seem right to me. He says the bank is requiring me to be there in person to access her account for example. Also, after watching your video, after she died, does that make me a joint successor trustee?
Hi! A person ask me about putting Mobile Home in the trust, does she needs to change the title in put in trust , I assume you do but I don’t know for sure ! Thanks! Thanks! 🤗🥰

When one is literally laughing out loud, simply "reporting" that one is "Laughing Out Loud"...somehow just doesn't capture the sentiment. Short answer: Don't overthink it...Just laugh with us!

When someone dies with a living trust do attorneys charge a percentage of gross assets to administer the trust after death? thanks.
Banks do. 5k minimum or percentage if money is a lot. Per year.

Hi! Sorry I missed , had to get prepared for a meeting in morning! Thanks again! 🤗🥰
What assets are not necessary to be in a living trust. Been told IRA’s can be left to kids no need for trust to include.

I was told to get an EIN immediately after my mother died
I did it and now the bank is putting the EIN into the trust. Was it necessary to get an EIN?

Too much bs, and sideline diversions, could not follow his train of thought. Seems he was attempting to create a lengthy video as his prime objective.
Please speak slower, as you go over these important issues.
