The main problem is that the people who owe money think they can argue their case with the collectors. They are not the judges. It’s past that point and the case is decided. If they disagree, they have to go back to court.

After awhile everything fell off my credit and it took me another 10 years to build my credit back up to be able to purchase a house. Now the only bill I don’t completely wipe out at the end of the month is my mortgage which I always pay an extra 10% to wipe out early.

I called to tell the person and the collector he’s 13 and was only there to mow yard. The man actually said if my son didn’t pay he was going to jail. He was so scared, and I was beyond mad. These officers did it correctly not threatening a 13yr old just mowing grass for pocket money.
Wait and play games, the tow truck gets paid whether they tow or not. This stuff goes on for a year or more before someone has to pay for it to go through the high court, and then to have bailiffs go out to deal with it. There is an office to handle paperwork and make sure it’s all done legally, movers and storage and it all costs money! If you put it off, it costs you more. Facts.

A 10k debt will result in 30-40k removed cause its whatever they can get at auction. Anything over is given back to the debtor but they can't go back and seize more so they make sure they get enough.. Just brutal.
Our laws are different in the US, and they prevent people just taking your stuff. Also we don't have "councils" that own all the properties and then rent them out. They couldn't even enter our properties here. Plus they take whatever stuff including cars unless the proper owner can prove it's theirs without getting into the car. That equals a felony here in the US, which allows you to defend yourself from the felony. Even auto repo must prove the car is the right one including the dash VIN, or they get arrested and will be fired.
Also jacking the amount 50% higher "because a tow truck is on the way" would be illegal here. Tow fees are set by law by each state at a normal amount, usually about $100-$150. Stealing a n auto worth $30k for a 2k debt and then you jack it up cause the tow truck is on the way.. highway robbery by thug companies given permission by what I'm told is a corrupt law system.
This is the last resort after the debtor has failed to settle and lost the court case. In many cases they have enough assets to pay but prefer to screw other people.
You couldn't be more wrong. It works nearly the same in most states, varying only in detail. If someone owes you money and you prove your case in court, you can get a writ of execution and have law enforcement seize all non-exempt property to settle the debt.
Let's go to the UK and live beyond our means (and the generous hand outs), they don't have the stones to deal with my scheming mind and guile. But sooner or later the Bailiffs show up and you get sorted.👍

The thing I find cold about things like this is like that one guy said. "I am entitled to seek legal advice on a matter I have no knowledge of." As a young man who knows nothing, I understand, verily. But the first thing about law is that "Ignorance to the law excuses no one". The thing that bothers me though, is that this is making them sign a payment plan (A contract) under duress, is that part of things being legal, if laws are based on ethics and morals, isn't it against the morals of contract law (because usually, contracts are either unenforceable or voidable when one of the parties are forced to sign under duress.)
You're forgetting that there was a years-long legal battle, that led these people to the point they are today. They aren't being blindsided. Whether through defiance or inaction, they were directly responsible for the situation getting to the point it is at today. They may, in fact, be innocent... But they had numerous opportunities to argue that and they didn't.

No, it’s towing, storage and auction fees. If you have. A general court order with court fees, then have to pay to have it taken into the High Court, and then you have to pay the office to verify addresses and do car ownership and whether there is any money owed (lien) and the bailiffs to travel however many times it takes to enforce the warrant. They take deposits with payment plans also….They aren’t goons. They are a lifeline for people who have had favourable decisions made by the courts, or everyone would just ignore the decisions of the courts.

If you buy a car in the US it is not your car till you register it and you buy plates. It is really not the sellers either. The car is in limbo till that is done. If that car was really sold to the neighbor should she not have paper work to prove it. See if is resllu signed over title or are they trying to play a scam? Don't they have a title or some form that can prove the neighbor bought the car? I would think so wouldn't you? If they don't have that then they did not buy the car. Then all the collectors would have to do is see the signed over title, plates or something in the person who says she bought the car?
These row-townhouse neighbourhoods are hundreds of years old and have no side spaces in between. The bins are put on the sidewalks on collection day and pulled back behind a front wall if possible. There is no other solution.
So many hostile comments. It's simple (not necessarily easy)- borrow, pay it back. Sell possessions to do so if necessary. It takes a long time and a lot of money to go through the courts to come to this point, including in the US. Don't get violent about it, just renegotiate the debt if needed, but pay it. Then this isn't needed.

Not really. These people order goods or services and then don't want to pay for them. They often have expensive cars, live in nice houses. They usually have what they owe in their account. They're just trying to get away with something. Imagine if you had a small business and people tried to get away with not paying. Hardly Dickensian poverty.

The thing that bothers me though, is that this is making them sign a payment plan (A contract) under duress, is that part of things being legal, if laws are based on ethics and morals, isn't it against the morals of contract law (because usually, contracts are either unenforceable or voidable when one of the parties are forced to sign under duress.)
You're forgetting that there was a years-long legal battle, that led these people to the point they are today. They aren't being blindsided. Whether through defiance or inaction, they were directly responsible for the situation getting to the point it is at today. They may, in fact, be innocent... But they had numerous opportunities to argue that and they didn't.

But what I wonder is if supercedes duress, because in my country, stressing out the person signing the contract is grounds for invalidation. Like if the groom asks the bride to sign a prenup on the wedding, even if it was discussed in advance because social/emotional pressures are coercion/duress.
Here in the US if you sign and put under duress with it.. it's ruled invalid.
He was very lucky they even offered a payment plan, others didn't. If he balked at paying because of duress they'd be like ok then pay it all right now.

We could use these agents in the states. We were awarded almost 5 k sone years back and never received a penny. Once court awards money it’s a done deal. No enforcement afterwards
The woman bailiff handled her case correctly she gave practical options like payment plan doable by the old gentleman but how come the BMW bailiff didn’t do that? Perhaps the man didn’t have the $2k+ money on hand to pay 😮

No, it’s towing, storage and auction fees. If you have. A general court order with court fees, then have to pay to have it taken into the High Court, and then you have to pay the office to verify addresses and do car ownership and whether there is any money owed (lien) and the bailiffs to travel however many times it takes to enforce the warrant. They take deposits with payment plans also….They aren’t goons. They are a lifeline for people who have had favourable decisions made by the courts, or everyone would just ignore the decisions of the courts.

It had not even arrived on scene. Storage and all subsequent expenses don’t even enter the picture. Asking for £1700 is absolutely ridiculous.

The man didn’t fill out his paperwork, lost his license and kept accepting the money for the rental for his buddy to live there. Wouldn’t pay a solicitor. So much easier just to bitch and protest.

Upper Midwest has many similarities with Canadian accent, so opinions vary on this point.
@@johng4093 I'm Canadian, and I think she is Canadian. The rhythm of her speech and accent is quite consistent with the way a lot of people in southwestern and southern Ontario speak. She doesn't draw out her vowels like some Americans do, and the pace of her speech is faster than you might find in many Midwestern states.
I also happen to live in southwestern Ontario.
She might very well be an immigrant and permanent resident of the UK because her parents or grandparents are British, and the current immigration rules allow for immigration on that basis.

How can it go from £2000 to £5000 if a car is towed? I could see an administrative fee and a tow fee and a storage fee for maybe &500 at most? Since when is it £1500+ for a tow truck? That’s criminal

If you buy a car in the US it is not your car till you register it and you buy plates. It is really not the sellers either. The car is in limbo till that is done. If that car was really sold to the neighbor should she not have paper work to prove it. See if is resllu signed over title or are they trying to play a scam? Don't they have a title or some form that can prove the neighbor bought the car? I would think so wouldn't you? If they don't have that then they did not buy the car. Then all the collectors would have to do is see the signed over title, plates or something in the person who says she bought the car?

With all the pot smoking in London, you can be sure there are plenty of high court writs.
So many hostile comments. It's simple (not necessarily easy)- borrow, pay it back. Sell possessions to do so if necessary. It takes a long time and a lot of money to go through the courts to come to this point, including in the US. Don't get violent about it, just renegotiate the debt if needed, but pay it. Then this isn't needed.
