He can choose to not press charges for it. But no you don't get away with stealing if you return the item. You gain good karma and if you're a human with a soul then you free your conscious a bit. The victim might be willing to drop the charges if you return the item since a lot of times the item is what they desire based on it being sentimental or its loss causing them financial hardship. But if you return the item it doesn't counteract or negate the fact that you committed a crime by stealing it in the first place... that event still happened and you still are going to be prosecuted for it but it's one of those crimes where the victim is the decider in if the charges remain or not most of the time.

You don't have to agree with someone's preferences whether it is sexual preferences or religious preferences or whatever the case is, but that should not be enough reason by itself to cut them off. Sadly this happened to my uncle when he came out of the closet. My grandmother disowned him for it. My mom and I don't speak to my uncle anymore and haven't for years, but it has nothing to do with him being gay and everything to do with him being a jerk and he and his partner committing elder abuse among other things.
