There is an ongoing theory that, by asking Morena "if i could leave safely in case i get a return card and forget everything that happened here", she kind of, sort of, made a "nen vow", making Morena promise her that, aka, tell the truth, while also fulfilling at least the 2 requirements for the contagion ability to work on her (pulling a "yes" card and kissing Morena). Once she sees the Heil-Ly memebers kill someone, she can now try to develop her own nen ability while also being "free" from Morena's clutches, as per their "agreement". The fact that she put her life on the line, probably made the nen vow stronger. Also, even if Morena did notice or somehow found out that she was cheating, by no means did she ever tell Borksen that she couldn't cheat, so it may not even matter at the end of the day. If that is really what she was going for, then that's a damn good plan.
If Morena could notice that Borksen, or anyone else, cheated and then isn't obligated to enforce the rules that would make the ability weaker or not even possible. The point of vows and limitations is that the more they matter at the end of the day the more it strengthens the ability.
Morena’s goal is kill the entire human race. If anything, she would want the contagion to spread, even out of her control, maybe even after her death. With post mortem nen contagion could become an everlasting nen curse.
That would require that everyone is capable of making nen vows even before unlocking their nen and that a vow can be flimsy and not enforceable by your own ability. Such as Kurapika's vow being enforced by his own chain around his heart. If the idea is that Borksen tricked Morena into making a vow with Borksen that would require you could trick someone into a vow. I don't think that makes sense since it's a deliberate act by the nen user. If it were that easy, then everyone (since all people have nen) would be making a vow every time they promised something. Which would certainly be funny, but I don't think it fits into the setting and power system.

I don't understand. If she wanted to say Yes, she could have just stopped playing, with the last two cards and said yes. Why go through this weird loop hole and complications?
I suspect Borksen exploited the nen vows of the game by tricking Morena into agreeing to let her go if return is the last card, without specifying which card she would return. If Morena is under vows to speak truthfully, she may also be bound to letting Borksen go, despite not choosing the x card. By choosing Yes, Borksen may have satisfied the conditions for contagion without formally joining Morena group.

It's the easiest way to get and rapidly develop nen, and that is the number one way to increase your odds of survival on the boat.

When we stop to think that Borksen gets "ranked-up" because of martial law, I think there was a small foreshadowing to this fact when she didn't flinch with the annoucement, as she would already have inside information that it would inevitably happen and it is all a part of her bigger plan somehow. Also the cheating made me rethink the whole new nen ability situation -- what if she doesn't get the ability because the conditions to trigger it somehow is very specific with the "negotiation game was sucessfully concluded" actually implies it had to be a fair game for both sides, as it would explain why Morena makes herself very clear verbally about herself not cheating?

Morena was too focused on winning from the beginning, I dare say she's in Cheadle's position. We may have vastly underestimated Borksen, bc she's displaying a lot of the genius that isn't unlike Pariston and Ging themselves. Considering the 4th prince she's under who is confirmed to be even more than Gon and Killua, it wouldn't be a surprise to me that he has a keen eye for detecting candidates who are indeed "usefull trash" to be under him. What with being an artist and appraising the value of others, not unlike Zepile, who accurately appraised Gon, despite lacking Gyo or nen....For crying out loud he has two specialists! Geez! Okay theory time okay this my reasoning and thinking to why Borksen ended saying yes. I believe Borksen was some what moved by Morena back story and wants to maybe change Kakin cause we have that inner monologue in 408 where borksen was okay with living an a modest and normal life even stating duty, responsibility and national defense don’t mean much to her. However, Beyond’s interference with the dark continent journey threw and wrench in her plans. On top of that we know Borksen and her crew want to try and do what they can to help Tserriednich. Morena states her powers are like a pyramid scheme where Borksen can eventually be her own parent to her own group of children with enough points. Now like I said with my last question with Marshall law invoked Borksen has an easy opportunity to rise the ranks quickly get her group as her children and level up so they can build their own parent and child system. I personally feel that as I stated in the beginning Borksen was moved to change Kakin for the better because maybe between the change in Tserriednich, Morena backstory, and the force change to her life goals has maybe sparked something in Borksen to want to change Kakin for the better. To do this I think Borksen will use Morena and the heil ly to establish a mini army of nen users to rise far up the ranks and gain enough members to put Morena in a situation where Borken either takes her out and becomes the new leader of the heil ly or tries to persuade her to drop the killing humanity aspect of her goal again. Or she could have said yes because of fear of being questioned and tortured as to her whereabouts when Marshall law was invoked. Sorry for the yap fest but been think about this since reading 409.
oui. I think she did. I don't think she would have crumpled the card if she hadn't cheated in some way. There was also no penalty stated by Morena for cheating, only trying to escape the game or trying to not participate in it would incur penalties, nothing in those stipulations would apply if you partake in the game. To add more to that I don't think Morena would care that much about Borksen cheating if she did know (although it's Morena, I could be wrong).

She’s continently 2 nen users away from developing a specialist hatsu. A slaughter spree to gain levels is out of character for her and inefficient in both narratively and in actual time. Morena needs her Hatsu. Bork needs to win their trust. Im 99% sure those guys are fodder for her. I’m less sure about which Prince it will be but my best guess is 3rd due to his mafia/kurapika ties to bring the plot points together. Bork is going to become a major player very soon. She’s going to gain levels VERY quickly.

Having it be up to chance, at least on Morena's end, is part of what allows the card game to make contagion more powerful. It's like Kite gambling on what weapon he'll conjure.
It's possible that Morena, and probably her allies, are the ones who are limited to following the rules and Borksen isn't. The point of the game is to recruit people and strengthen contagion, so leaving cheating open for someone who wants to join but got unlucky on their discards makes sense.
