Insurers are very keen , too keen to write off accident damaged cars. If they do , then you should push for the max payout and do a deal to buy it back and then take over the repairs yourself. Cannot let this car die - we all enjoy seeing what you do and driving this great car.

I did have a bit of a wobble and looked at a few replacement, but no, just won't do! Sorry for the late replay - been busy trying to sort this out. Of all the E31's in the world, yours is the one that should be saved. Sorry, you had it smashed, glad to hear you're going to repair it.@@TimmsBMWRepairsandInformationIn the States (of course) the driver should get some compensation for his injuries...he should reevaluate and see if he has them. It might help with your negotiations. 😁

But i would not spare a dime to get this car fixed, it is a VERY special car....well worth the effort and cost to repair it and get it back on the road.

The council should be sued for not keeping the signs and road marks visible! Just shows the vale of dash cams of course. I had the same car exactly, didn't know there were only 30 of them. Money won't replace it, get it repaired!

I feel a little sorry for the Golf driver as well. Obscured give way sign, worn poor road markings, probable sunshine in the eyes. It's obviously still their fault if only they were a little more cautious but a conspiration of factors contributed.

That is horrifying. Personally if you think it can be straightened up properly and want the job done, one point of leverage would be the fact that it is intrinsic to your channel, which I assume makes some money for you and that you should be compensated in the sense that a repair however expensive should be undertaken. Or that cosideration should be given to that in a cash offer.

I must admit having seeing the Golfs point of view because you cant see the give way sign and the markings on the road clearly i can see how it looks as though the road continues straight on if you didn't know the area I'm pretty sure a few more people would carry straight on this because councils are cutting services to the bare bones these days.

I wish never seen this video.... Timm I feel as you are one of my friend. Your cars, your respectful behaviour. Always TOP.
In this case "As M539" did accident with customer car 1 year ago , same thing done by Lee too. If you drive anyone else car you should be more careful. It is not golf. It is not hyundai. It is rare E31. Read it? Driving car is not push the pedal and look your handy. It is sth more important to feel road, tyres, brakes, anyone else on the traffic, engine heat..... Thats why I never trust anyone to maintenance my car any shop. If sth big must done I go shop and offer to do together. They all accepted up to now. Anyway.... That happened and we have no timeback machine.

    1. Don't let the car leave you until you've been paid. 2. Try and buy the car back - I think it's 20% of the insured value or at least used to be. That will be recorded on the V5 as ac Category S (structural) total loss forever. or...... 3. Take the 30 grand and run. It won't be scrapped unless they Cat B it - some hero will repair it.

You look great for 65. I figured you were at least 10 years younger.
The sad part with accidents involving these generation BMW’s is they are totaled by the insurance company with relatively little damage and the insurance pay out is pathetic. I can feel the emotional angst of the situation. If the insurance company doesn’t cover your repair costs you’ll absolutely have to pursue the driver at fault in civil court. Last September same situation with my father in-law. Driver paid the difference out of pocket above and beyond what their insurance company failed to cover. So speak to a lawyer for guidance. Good luck

fix it in 3 or 4 parts...door first, then rear wheel and subframe, then the b pillar, then the bodywork. A 3 year project... by that time it will have increased in value by 30% because cars like that are amazingly designed and will be sought after..

I did have a bit of a wobble and looked at a few replacement, but no, just won't do! Sorry for the late reply - been busy trying to sort this out.I have found lots of parts now which is a good start. So gutted for you Tim 😢 That's a priceless 8 series so I trust you'll fight to save it. Also glad your mechanic wasn't injured. I came out of a clients office many years ago after a thunderstorm had been through. My heart sank when I turned the corner to where I'd parked my limited edition 540i6, the street was littered with fallen trees. Eventually the next morning I could access the street and my bmw had fared better than most of the other cars. Downed power lines had landed on the roof and slid down across the bonnet. My insurer was great, the panel shop even better. They dipped the bonnet back to bare metal before painting as they knew it was special and I wanted to keep it. I thought maybe I'd feel it was tainted afterwards but the repairs were so good I still loved it. Fight Tim, fight for it and use the community to help find the required parts.

I think your car is unique and there are not many of its kind on the roads anymore, so it is better to fix it so that the next generation can see it later.

That's terribly-sad news Timm :( There may be a case against the local authority for letting that junction become semi-dangerous.
It would be a crying shame not to try and get the old girl back on the road, even if the 3rd party insurer wants to write her off. Maybe try and get the max possible payout & buy back the car... it will be a long road to straightening everything out again if you go this route though.
    Best of luck!

OK....this is all UTTERLY heartbreaking🥺....that car was just wonderful.
I know how good they can be for I owned an Individual 840Ci in Avus Blue with Champagne Nappa for many years.
I wish I'd never sold it.
Your MORA has to be my all-time favourite BMW colour, so even more heartbreaking....but hey-ho...it's life.
    Right...how about this...just my 1d worth...
Look ahead to the future, to where you could be after these TWO possible scenarios.
Number 1. You're able to get it repaired....back to where it was before the accident.
Will you be really happy? Hmmmmm.....
Will there be niggling thoughts in your mind?
    Will it be perfect?
Will every rattle make you think...why did I go through all that grief?
    Number 2.
You move forward, break it for parts (that LSD for a start) and search for another E31.
There's a guy in Germany, on TH-cam (M539 Restorations) who repairs BMWs completely to AAA standard....quite amazing work.
OK, he may be a young (younger?) chap than you, but you are just as dedicated. You could perhaps call in help from your favourite 'fettlers'.
Being blunt, 'age' might not be on your side, but you have a phenomenal 'knowledge-base' on the E31 that you have so kindly shared over the years...
Just a couple of life choices.....
Stick with it, don't lose hope...and remember, "How many other cars out there have a driver-adjustable-infinitely-variable-intermittent-wiper system!!!!!
GOOD LUCK....and keep smiling...we LOVE your videos...incredibly informative...!!!!!!!!!

Timm, tell your insurers that you will not be relinquishing ownership of the car. You'll get a payout from the third party insurer, and then fix the car yourself. That's what I done when my E38 was T-boned. Also, if you have classic insurance, the car should be fixed by the third party insurer, as that's what classic insurance ensures. My E23 was hit at the rear, and was about to be written off until the assessor realised it was classic insurance.

    Hello Tim,
What a shock to hear when it was oh Tim bad news .....
As much as it is a treasure for you and a beautifully maintained unit I would from my similar experiences let it go if insurers will pay out on it to your satisfaction.
It will seldom be a repair of satisfaction as a thump it has had sends shock throughout all the alloy components on these two door cars.
I had a similar experience with an E30 M3 like your heart attached to the E31
    I might assume.
One problem will be its resale value if repaired and with that wisdom says say goodbye to your vehicle sadly.

The body estimate sounds fair enough, however the mechanical estimate is extremely suspect, 10k for what exactly, would be VERY interested to see an itemised breakdown of parts and labour, there are certainly salvage parts available in good condition for these cars. Above all else this is a nice example and worth fixing properly even if you have to buy back from the insurance people, as we enter the era of the electric vehicle cars such as this will be very much sought after. Wish you the best of luck but do dig into the costs for the mechanical repairs, something isn't right there.

I would definitely contact your own insurance company. That is. In Sweden your own insurance company can help you wit the negotiations to get the deal that suits you best. Adding to his - why not tell them about your great YT videos to further explain your commitment to this cars - just to show howe much of a loss this really is - Its true the insurance companies wants to write cars off due to additional administrative costs ( not to say the strange business models currently defining pricing for repairs) I would certainly get the best and most reliable tool shops needed and asking your insurance company to assist you. The Golf driver should inform his insurance of the lack of visual signage due to non maintenance, preferably with video from his driving perspective. I used to work for an accident investigation company and it is a legal requirement that councils maintain the clarity of road signage for the safety of all road users, including pedestrians. This is just such a classic case and it should be seriously investigated by the insurance company concern as soon as possible!

if that car was offered to a decent mechanic, it could be saved with a secondhand subframe, rear quarter, and door, and repaired to its former glory for around £5.K. it might be worth considering an agreed price to pay you out, and you keep the salvage, and get it repaired by a garage you trust. as ther own insurer (3rd party) will insist its done at their cheap place. and they wont do decent repair, or touch secondhand parts. it might become a cat S car though.

It's still your car, whichever insurer is involved - they cannot right your car off without your authority to do so. They are required to return your property to the condition it was before the accident. If you really want your car repaired, I'd consider involving a solicitor. I had my M3 repaired under the same circumstances, it was a fight but ultimately successful - the car was repaired, not written off. EDIT: note your final comments, the other parties insurance in mine were initially very bullish about writing it off, but I stuck to my guns & they folded. I think what is very much in your favour is the likelihood of finding a replacement, they'd be better off getting it repaired asap, time is money to insurance companies.

Brutal, hope this works out for you. I had a neighbour hit my mk2 Golf 16v back in 2009 when the car was worth a lot less than it is now. Neighbours insurance couldn't get parts for it, but as it was on a classic policy with agreed value they were bound by those terms; payout received in lieu of repair by myself, no write off marker on the car. Good luck 🍀

Oh man this is such a shame, of all the battered cars out there, they had to drive into a rare, pristine 8 series, one of the most beautiful cars BMW ever built and this one which is a loved and pampered example at that. Got to say, you're remarkably calm under the circumstances Timm. We had a vehicle written off by a local Ford mechanic on his way home from work. We'd spent thousands on the vehicle over the preceding 12 months and his insurance company conducted an unsolicited inspection of the damaged said vehicle without our knowledge. We subsequently received an offer of a sum which was barely above scrap value. Several letters back and forth, submission of all our expenditure on the vehicle over the preceding year and a strongly worded threat to take the matter to court resulted in them upping their offer by several thousand pounds which we rejected and continued to pursue until the amount met our deserved loss amount which they eventually paid. Some insurance companies will try to get away with paying out as little as possible, you really do have to make your case Timm. I believe Rowan Atkinson's Mclaren was written off more than once but was repaired again and again despite costing an eye watering £900k sum to put right. Perhaps not in the same league as the McLaren (still a BMW v12 6L engine btw) but the 8 series is certainly becoming a rare classic now particularly with those specifications. The question is: would you want it back in a repaired Cat ? state! Could it be repaired back to factory original or would panels not quite line up, could you live with any discrepancies? Only you can make that decision. Thankfully, at least no one was hurt I guess!

Sorry to hear of your misfortune. My first car was a Ford Granada, I wrecked it almost immediately, asked the insurance to pay up and let me have the old car as well. Which they accepted. This was in Denmark. If UK insurers will allow it, you could do the same. Take the money and the car, get yourself a replacement and either fix the old one or use it for parts. This may sound harsh, but you could then buy a cheaper one with a sorry interior or busted engine, and stick your old parts in the "new" car. Just a thought. Agree the car is too good to just let go completely. Best of luck to you Timm.

@@TimmsBMWRepairsandInformation Yes, today a person from the insurance company will come to inspect the car. I don't have accident insurance, everything will come from the compulsory insurance of the vehicle of the person responsible for the collision. The problem is that insurance companies have their own tables, which do not correspond to the real market price of the vehicle. I'll see how they evaluate it, but the damage to the car will probably exceed its price (according to the insurance company).

These are the worst, when it's someone else driving the car, because i'd reckon you would have been more aware of crazy drivers. I always look carefully at all traffic at every intersection even if i have the right to go, because if i don't look and make sure, i feel like i'm giving the crazy people permission to ram me.
A similar thing happened to my E39 540i, the day i finally got the car finished the way i liked, when the mechanic was driving it. Same except the impact wasn't this big and it was from a bad driver switching lanes right before the divider, like 20-25 meters past the point when he was allowed to switch lanes.

My argument is always that the car should be put into the same condition it was before it was hit. You never get back the money you spent on it with repairs etc when an insurance company writes your car off and pays for a replacement. And they always try to low ball the value of the replacement car. It's a cheap get-out for insurance companies to go down this route rather than allow the repairs to be done to reinstate your car to its pre accident condition, regardless of cost. Probably said by others, but those responsible for keeping road signs clear of obstruction (trees) and clearly visible should be liable for covering the cost of complete repair.

Fight to get it back up and running, it will be interesting to see how you wade through all the Red tape and how many hoops you have to jump through.
Insurance companies will try anything to not pay out so looking forward to how you deal with this.

Hi Timm, it is sad to see and hear what happened to your beautiful e31.
I had almost the same problem with my insurance that the price of the vehicle is supposedly below what it is still worth. But the appraiser listed all the e61 550i Tourings in the appraisal that didn't even come close to the equipment mine has. So I do not know how it is with you in GB but you should look there exactly because with us in Germany it is so that the appraiser ONLY on request you send the offers about which he has determined the market price. And with me that was the case that he then just all lower equipped vehicles also included and then came instead of 15k on only 7k for the residual value of the vehicle.
I hope for you that your beautiful e31 is repaired again and he shines in the old glory then again!
Good luck and greetings from Germany!

That’s such a bummer, sorry Timm! Glad everyone was okay though. I’m not familiar enough with the UK insurance side, I’m also sure you probably know more than most about the structure and engineering behind the E31. But if it turns out to be a total loss, get as much out of the other insurance as possible, and if it works anything like what we have in RSA your insurers would also fight the other insurers. Put an offer for salvage and once you get settled, get the other E31 and transfer every part that is viable and better than the new car. My dad is an insurance assessor for a U.K. firm and I’ll ask if he has any insight.

That’s fantastic news! I’m thrilled you decided to keep it going.
The “N” is only a letter, if you don’t plan on selling it for the foreseeable future and is par for the course, if you still get to drive around in your (otherwise) mint drool worthy dream car. Even with the “N” category, I think it will still have incredible value, if you did ever sell it, due to it being meticulously maintained, and famous in the forums and TH-cam.
Also no need to apologise, I’m not entitled to any response at all, let alone any apologies ;).
I do need to apologise though, I offered some input from my dad, but life and me E60 has gotten in the way. It sounds like you are further down the road with the insurers anyway, so I’m not sure how much that would be worth at this point.
I also completely agree that insurers are shady. We pay them a lot of money to get us back to where we were before an accident, but they look for any reason not to pay out, often nowhere near the value of what was damaged, if at all.

I'm really sorry to hear about this Tim, stuff of nightmares.
In my opinion, I'd be surprised to see the insurance company pay out for the repairs to keep it in the road, which sound like they're approaching £20k. Proving the value of the car will be tough since it's high mileage (though probably in better condition that most cars half its mileage).
The best decision for you money-wise would be to accept the write-off and the cash, then buy the car back from them for pennies for you to sell as a whole or break for parts, though this is extra faff for you. Most of the valuable goodies on the car are intact so they'll fetch a pretty penny.
I hope you can however find a way to get it back on the road. This could be buying it back from them and then getting it repaired with the money they give you. Will always be a write-off, so value will be lower, but who cares for a car you love.

I followed you channel for years and really enjoyed (like myself) your passion for the Bavarian brand BMW. Really sad story you announced and there is really only one option going forward and that is to repair the car! These cars are unique and in your spec and condition there is really no discussion what to do! Myself had a 1993 model BMW 850CSi for over 8 years in "hellrot" color. Lovely car that i still miss today! However the car went to an private collector in 2020 so its still in good hands. Please fix your car Timm and secure the legacy of our Bavarian loved brand for future! BMW these days are nothing like the quality of the "old school" and its important that we do our outer most to secure the legacy.
