My criminal brother that has never filled taxes had been given this exact advice and succeeded with his tax situation! As a drug addict and all around their and conman he has never filled taxes then he had to file taxes to get disability and was told by a state funded tax attorney to not file all 31yrs of taxes just the last year and that’s what he did and it worked, now that same now older conman is collecting SSI disability and owns a small cash business that yup you guessed it he doesn’t report any tax on!!!

But, he was calling and telling as many of the people that he knew about, that the IRS had done this to, while he was there. He advised me to research it myself and to make decisions based on real knowledge instead of what everyone was doing, making decisions based on what they are being told to do. I thanked him for his input and started researching the codes for myself. He was right. There is no law requiring us to file and pay a tax on our income. I informed the local IRS and the Federal IRS that I would not be filing and paying a tax on my income until they produced for me the law that required me to do so. That was 16 years ago and I'm still waiting for that law so I can file and pay the tax. Here is the reason you do not need to file some old tax returns if it has been a while: 1) The IRS might just skip those old years and not care about them anymore. They put a code on years they do care about. 2) Sometimes the IRS does the tax return for you. If the Substitute For Returns are old, the IRS collection statutte expiration date might be coming up. Filing the return re opens that date. 3) If they did it for you, you owe on other years anyway, and you are filing an Offer In Compromise, it usually is not worth the extra work to do the old returns. If your offer gets accepted, it gets accepted anyway. The IRS does not require you to file years you did not file. 4) Sometimes what they file for you is less than what you would owe anyway. Sometimes, if a single W2 earner, it is exactly the same.

You do have the right to file an extension on your current tax filing year. You do have the right the submit an explanation of forms as to why your filing was incomplete. You do have the to find a credible CPA that will represent your filings to the IRS. To regain your filing tax rights and measures. It takes a lazy person to consume problems if the taxes of their activities are ignored every year. So, understand your rights, forms, explanations, log expenses for each year and unfilled forms as records and have them amended or represented to the IRS. I am sure it's not that difficult. You can always negotiate and make payment arrangements. Just as long as you keep up with it. Being penalized $20 a day is not funny per year. So, find out what your options are.

Making the bold unconditional claim that you should not file all of your tax returns may constitute gross malpractice and a Circular 230 violation by this attorney. Sometimes, the IRS will follow a 6 year rule and allow the taxpayers to only file the previous 6 years. However, they sometimes require everything. Get good advice, don't just assume that this attorney is 100% correct.

I am a retired CPA/Attorney with over 40 years experience. A return prepared by the IRS is NEVER the actual tax return of the taxpayer as it is unsigned. It is simply a jeopardy assessment. People with numerous years of unfiled tax returns NEED to file and sign all years tax returns, even they merely use the government information and sign it. This is because all income taxes, penalties and interest are BANKRUPTABLE after five conditions are met, including to filing all previous years tax returns and signing them. Your insult about ignorant accountants is occasionally true - it is equally true of ignorant attorneys. Your experience is obviously not in tax preparation or taxpayer income tax defense. People who don't file their taxes can be candidates to bankrupt out of all those axes IF they follow the rules.

No one is required to file a form 1040 because the tax died August 16, 1954. See CFR 26 1.0-1 paragraph (d) enacted by the House and Senate.
After 6 years it is unlawful for the IRS to pursue you for past returns. It's an IRS code.
