    Sad this shameful father, is sitting there drinking Starbucks coffee, looking healthy and this poor baby had to steal food! 😢😡I hope he gets life!!!

      He better get life!! The torture and pain he put that poor child through is unimaginable.
      WHY would someone do this? It’s like that woman and her oldest son that just went to prison for starving and torturing her son. Of course they took it further by making him do physical things and making him eat hot sauce. I wonder how long until Brandon started doing that.

      Before defense brings in their doctor that claims Benjamin died of something else, look at physical and circumstantial evidence. State produced photos of Benjamin, state of his bedroom and how it kept changing, B begging for food, locks in kitchen, videos of how his dad interacted w him, pics of bruises and on & on. Jury will use their common sense to convict this child killer. Let him suffer from other inmates if he doesn’t get death

    Everyone failed this poor child. If you see your child hurting himself, get help for him. They didn't. CPS failed. And as much as I am for law enforcement, they failed him too. Even the doctors failed him. May he finally rest in peace.

    The defense attorney is the most obnoxious and hateful acting person. She stands around with her arms folded like a spoiled child and basically stomps back to the defense table if she doesn't get the answers she wants. I am waiting for a witness to say to her, " No, I do NOT agree with you."

      I think she did an excellent job. Yes. Everyone failed this child. I hope the dad learned that he can’t be so passive but he did not kill this child. This child was special needs and needed additional help but no one, not even the health care professionals saw that he needed more intervention. The dad should not be put away for this child

    this poor child was not only going through the physiological effects of starvation but also suffering so much anguish, he knew and felt his absolute desperation, helplessness, and hopelessness, knowing no one in that family cared about him or would help him. This is absolutely heart wrenching.

    I am SO enjoying this defense lawyer trying so, so hard to punch holes in this pathologist's testimony and failing again, and again, and again... You would think she would figure out that she is not anywhere near as smart as this doctor and just give it up! The Doc is doing a good job of keeping a straight face when this defense lawyer is saying such dumb statements!

      I love when the doc can’t hold it in anymore and a smile breaks across her face- she knows she’s dealing with yet another hot headed defense attorney who is trying to school her on her craft! I’ve seen Dr. Molina before- she knows her stuff

    No matter how much the DA tries to discredit the examiner or detective or whomever, benji himself tells what happened through the videos. Thank god the stupid father and step mother recorded all this themselves. Thats what’s gonna put the “father “ away too. The mother lost custody of him because of abuse that was being done to him over there with her, and he was no better off with these people smh. Poor baby 😢

    This lawyer should be ashamed of defending this child killer. Yes I know every person has the right to a trial but this child had a right to live, a need for food, a need for liquids and a need for love and the necessary things each person needs. What a total disregard of a human life.

    Defense had the AUDACITY to state that DAD couldn’t decipher whether or not Benji APPEARED as if he had VISIBLE weight loss is beyond me!!! he’s the father, he’s been with him for 2yrs 8months Oh come on DEFENSE! No one is buying that argument! Just stop ✋ already with trying to point the finger or OTHER DIAGNOSIS on Benji that he didn’t have!!!

      How / why did the step mother go along with this? If she’s not already, she needs to be locked up too.

    I’m not a parent, but there’s gotta be something wrong when a four-year-old is punching himself in the face repeatedly. There’s definitely some damage that has been done to this poor kid which ultimately resulted in his premature death. So sad.

    I jist dont understand how someone could do this. My son is 5. He has autism. When Benji cries it sound like my son when he has nightmares. These videos broke my heart. I would have taken him in a heartbeat 😢 Give me 30 mins with him and the step mum 🤬

    The state violated their Brady obligation to disclose to the defense the expert change their mind and did find a rest lines that's actually a huge scandal and on appeal that's reversible error on appeal.
    This is why we practice criminal defense!

      Hello, so Dr Molina found arrest lines anywhere from months 2 weeks before the trial. And the finding of arrest lines would be a change in her testimony. And that would be great cross-examination material. And so anytime the state find evidence that could help “the accused” the Supreme Court ruled that they must turn it over immediately to the defense or else it's called a discovery violation and it's a big deal. It's actually called a Brady violation is from the 1963 case Brady vs Maryland where the prosecutors withheld favorable evidence from the defense team. It could be anything as little as the lead detective has Facebook postings talking trash about the accused. That would be horrible for the state because it would show that the lead detective was not dispassionate and unbiased. If the prosecutors find out. They need to turn that over or at least let the defense know. They can't just scrub his Facebook and tell him to shut up.
      Dr. Molina’s findings were the bases for this whole charge. And for her to get something wrong like that I need to be corrected by another expert and the prosecution to sit on it for months. And then for Dr Molina to lie about it on the stand and say oh “She can't remember when if at all and how she forgot that she had to see a new expert and revise the fact that her testimony is now different than what was on her final report---» the same final report that the defense has to use in order to defend their clients Liberty. So many shenanigans going on.
      I'm encouraged you're asking questions. That's what we need to see more of in the comment section. If you listen to this whole case there's a lot of twists and turns and you listen to the defense attorney with an open mind you'll see that Brandon is not his wife. And that you cannot starve to death in 72 hours. Look at the picture of his last day on Earth.
      This is not a neglect case. Benji was actually well taken care of. He's not even charged with neglect.

      @@sisters4life224 yes because this judge has a brain and realizes that the state came in empty handed. Absolutely zero evidence of starvation or physical abuse. Benji checks every single box for type 1 diabetes, yet was apparently never tested for it and the medical examiner f'd up and waited way too long to test samples for ketones. He should have gone with a bench trial.

    Ugh the saddest thing is when benji is in the kitchen looking for food , there’s a piece of garlic bread on the pan. Poor baby’s eaten so much bread that as hungry as he is, he doesn’t even pick that to eat.

    He was found not guilty ain’t that about a bit. The prosecutor was trash. How tf do you lose a case like this. You know how incompetent you have to be to lose a case that can more than likely sway the juror through emotions. Lmfaooo the DA needs to be fired asap. There is no possible way you lost this. Absolutely none. You can easily win a case like this. This is probably one of the easiest cases to win especially if there are women on the jury. The fact that the DA lost tells me that the DA was complete trash and needs to go back to school lol😂

    That is *”Brady 101!”*

    These comments have *ABSOLUTELY NOTHING TO DO* with the circumstances surrounding the horrible nature of what happened to the victim…
    These comments are *STRICTLY* on behalf of the *AMERICAN PEOPLE* in general, and our, yes *ALL OF US,* rights as a defendant…
    The display of what happened here was not appropriately remedied I’m my opinion… if he’s convicted… *THIS* exchange will be a bullet point for his appeal…

      @@hanabelle65 I disagree with this comment. He was starved. Yes, he stole food and drink, how many times I don't know. If you look at the tapes you can see that he was scared each time he did. He was aware of the cameras and at times turned his back away from the camera to hide what he was doing. And his body proved he was malnourished. His distended stomach proves that he was starved. I don't know how you can say otherwise.

      @@glendabpospisil3851 it was stated by Brandon's sister when she was babysitting him that she found it odd that he was still very hungry even after eating a full meal. He had all the signs of type 1 diabetes ie; excessive hunger, excessive thirst, excessive urination, behavioral issues like anxiety and depression, diabetes can cause the thymus to shrink....yet none of these so called professionals tested him for diabetes and the medical examiner did not do her job properly concerning the testing of his glucose during autopsy. Are you telling me that you would be ok with your ~5 yr old rummaging thought he kitchen at all hours of the night eating loaves of bread when you are sleeping? I would be concerned of the choking hazard myself!

    Hey, I think this monster is guilty too but, I give credit where credit is due & the defense attorney is actually doing very well & fighting for her client, as she should. When people start attacking an attorney, it's usually bc they're actually very skilled.

    He probably had prader willi syndrome. The doctor should know about this IF the parents let them know this was going on. I understand locking the fridge until there is a solution. But locking food up doesn't mean to starve the person. Parents always go too far. There's no easy cure for that. Prader Willi is a life long condition. A person with PWS won't stop eating on their own.

    This prosecutor is ridiculous! She could be using all her knowledge and skill for good and here she is belittling all the people who work day in and day out to get justice for victims! Her bruised ego shows- and why can’t the other defense attorney do anything? She seems like a control freak? I love when she gets shut down by more knowledgeable experts!!!!

    Child had every sign of diabetes type 1; excessive hunger, excessive thirst, excessive urination, weight loss, behavioral problems like depression and anxiety. Was he ever tested for diabetes by these genius health professionals?!

      He would have ketoacidosis and would be heavily breathing and in respiratory distress not able to talk and ask for bread

      @@Nurseydogmom are you saying this child had no medical issues? I think the state clearly proved he was not being starved. Was he tested for any diseases like diabetes, Prader Willi or others?

      Many of those metabolic diagnoses are found at birth on the NBS and his was negative. Prader Willi has very distinct facial features in which I am not seeing. Our healthcare system is horrible but I don’t think DM1 was missed

      @@Nurseydogmom I have yet to hear any testimony stating that he was tested for diabetes during any of his dr. visits. He had all the symptoms of diabetes 1 yet everyone is saying, nah...not diabetes even though he was never tested and the medical examiner clearly f'd up the testing of ketones at autopsy by letting way too much time pass before testing. One of the dr. today stated that after such a prolonged period of time he was surprised to see any amount of ketones yet it showed ~45 or something... he even said that's an indicator that they were extremely high before death, yet everyone says, nah... wasn't diabetes! I don't know what you people think you're talking about!

    There’s no evidence of starvation. The kid peed and pooped that day so he had to have eaten and he was eating bread in the video and eating at the table in another video they’re fishing for a reason. There was something wrong with the kid, but it wasn’t starvation.

      @@donnae2013 he checks every single box for type 1 diabetes. There are studies that show diabetes will cause the thymus to dissolve. He apparently was never tested for diabetes and the medical examiner did a poor job on autopsy... waited too long to test for ketones. Medical examiner should be fired for her findings of "starvation" and "homicide".
