It is crazy. Having worked in Human Resources I’ve seen new employees forget to turn the completed forms in by the first day. We would allow them an extra day to get them in as sometimes it’s a case of they forgot them at home, etc. But there is a huge red flag when someone is working for 3 weeks and hasn’t complied. They should have put her off immediately until she turned in the forms. She was trying to pull a fast one and it may have also been about the I-9 form, which verifies your legal status to work in the U.S. she may have been illegal and couldn’t produce the supporting documents that go with the I-9.
I've worked in Human Resources and employees were never scheduled until all their paperwork was was turned in. The fact that she is so resistant makes me think something is sketchy. Like she doesn't want her income reported bc she has a judgement out against her.

She has tax problems most likely and filling out a W2 allows the IRS or state to garnish part of her wages to clear those tax issues. It's why she wants to be paid under the table. A lot of small businesses might pay under the table, but a chain hotel like that would not, since they would get in a lot of trouble if they were caught.
I don't think the IRS or the state garnishes any wages for unpaid taxes. However, they do keep any return you would normally get. In my younger days I owed IRS some money and they kept my tax returns for about 10 years or so. They eventually sent it to collections and it disappeared from my credit report after 7 years. Wages are only garnished when you have a court judgement against you for something like child support or a contractor or retailer who took you to court for non payment or a private person who sued you and won.
W2 form is for your social security number and how you want your taxes withheld (married, single, number of deductions) and the I-9 form is to prove you are eligible for employment showing ID and proof of age, citizenship or green card, etc. This should all be completed before starting your job, but is not always. But no legit business can legally pay anyone "under the table."

Pretty shady for an employer have you work knowing you still have yet filled out any tax related documents. Anyplace I've worked gives you at most a day, the first day or orientation. Its literally just a read over and signature.

If she is receiving governmental benefits such as food stamps, Medicaid, or cash assistance, working a regular job could cause her to lose her benefits. And it is highly illegal for employers to pay under-the-table in the US. I doubt that a big chain motel like Best Western would be doing that. If anything, she just made an assumption that since the others were Jamaicans (as she said) that they were being paid under-the-table. The only places that I have ever heard of that pay under-the-table are little mom and pop places that don't have higher ups to account to.

Some companies when you just start they held back a week pay, so you first paycheck takes 3 weeks, you will get that week pay back later. W2 taxes form, every company have to pay taxes on their employees and when you have to pay taxes, they know how much, state and federal taxes, they also have to have the information for their insurance policy. I don't know if it's still true, but when the government started requiring I9s, your business could be fined $1,000 per missing document. She may be an illegal, might have unpaid child support (I had to send the W4 to the state), all kinds of things. In a perfect world, you get all of the documents before starting work. I had more than one tense exchange of withholding payment for not filling out the forms.

She could be delinquent on some kind of debt or tax obligation or assessment (including having previously declared bankruptcy where wage garnishment is imposed to make the creditors whole) or owes child support, and she is trying to get paid under the table to skirt her obligations or prevent wage garnishment by obfuscating her work from our federal tax agency (the IRS). She could also be a recipient of some kind of government welfare and is engaging in fraud by obfuscating her work so she can report a lower income to remain eligible to receive government assistance. I used to investigate government welfare fraud and this was very common.

This is probably right at the end of lock down, and they needed bodies to work. So they were trusting that she would fill out the forms needed to be paid. They were probably in a rush to get people working.

a w2 is a form you useally get at the end of a tax year that you need to fill out tax forms but any job you apply for should have all the information that your employer needs on it for the the w2 to be mailed to you
The form are tax reporting forms and with all due respect if she can read to dial 911 and get a driver's license, this entitled brat (not the word I wanted to use) can read just fine. She got less than she deserved. She should've spent at least 24-48 hours in the county jail to think about what she did and why she really did it. She may be getting benefits and if her income is too high she'll either lose them or they'll be reduced. Or she may have a child she doesn't have custody of and if she shows an income, she'll have to pay child support.

Their mistake is that they should not have had her even start work until those papers are filled out, that is generally done the very first day you start work, and for some documents, you have to give them those before your start. Look at what happened in Florida when DeSantis passed the law where if you have undocumented workers working for you or even if you have one in the car with you, you can face charges. When he and the Republikkkan party passed that law construction in Florida pretty much came to a full halt because their construction and hospitality industry is pretty much run by undocumented immigrants and even the farms there were heavily hit.
She may be on some government program that would be cancelled if they knew she was working. She may be in trouble with the IRS and her wages would be garnished for back taxes if she filled out the forms. She may just be angry if she thinks the immigrants are being paid cash and she has to pay taxes. But whatever was beneath it all, she sure did the worst thing she could do to rectify it. W2 and I9 are tax papers, the only reason for not filling them out is to not pay taxes, basically she's trying to evade taxes and the company is refusing to pay her without the forms being filled out because if they pay her they will be complacent in her tax evasion which could get the company shut down because they knew about it. There is No place that will hire a person without them filling out those forms, so even IF she did go and do work for them, she was never working for them, she was never on their payroll.

Hi Kabir, the forms are for tax and eligibility purposes. Everyone fills them out when you're hired. She is hiding something. The people she is working for are a national motel chain, and as such, don't pay employees in cash under the table.
She has something to hide. She may have applied for government assistance and indicated that she wasn’t working. If she filled out the forms, the assistance would stop. There are a lot of people who are ignorant of how things really work. She might actually have thought that she did not need to fill out those forms and just get paid anyway. It's not as simple as not filling out the forms. She probably owes the IRS for unpaid taxes, and has a tax lien on her income, So she's trying to work under the table using an assumed identity. That won't work with a big corporate employer like Best Western.

A dreamer is someone who was brought by their parents into the USA illegally when they were very young. They speak english very well since they learned it growing up natively, but aren't citizens unless their parents have managed to become citizens prior to them becoming 18. This would explain her american english as well as wanting/expecting to be paid under the table. You can't fill out the forms w/out a legit social security or green card number (I think it's green card, but don't honestly know). She may have been told she would be paid under the table, but was a problem employee so they just threw her under the bus saying she never did her forms. It is unusual for a business to tolerate not having the forms filled out for more than a day or so. This is all hypothesis as I know no details beyond what was in the video.

W-2 forms are required so you can state what your tax status is….I.e., single, married, number of dependents. That information is needed so the company can withhold the proper amount of taxes. She has tax problems most likely and filling out a W2 allows the IRS or state to garnish part of her wages to clear those tax issues. It's why she wants to be paid under the table. A lot of small businesses might pay under the table, but a chain hotel like that would not, since they would get in a lot of trouble if they were caught.

I don't think the IRS or the state garnishes any wages for unpaid taxes. However, they do keep any return you would normally get. In my younger days I owed IRS some money and they kept my tax returns for about 10 years or so. They eventually sent it to collections and it disappeared from my credit report after 7 years. Wages are only garnished when you have a court judgement against you for something like child support or a contractor or retailer who took you to court for non payment or a private person who sued you and won.
W2 form is for your social security number and how you want your taxes withheld (married, single, number of deductions) and the I-9 form is to prove you are eligible for employment showing ID and proof of age, citizenship or green card, etc. This should all be completed before starting your job, but is not always. But no legit business can legally pay anyone "under the table."

The Fed can trace legal status based on those forms, also if she owes back taxes it can be garnished. If she’s getting government assistance her wages can be offset or assistance can be stopped.
It's the basic tax forms. Everyone has to fill those out for a paycheck. It's for taxes and social security. She has issues for sure.
Pretty shady for an employer have you work knowing you still have yet filled out any tax related documents. Anyplace I've worked gives you at most a day, the first day or orientation. Its literally just a read over and signature.

And it is highly illegal for employers to pay under-the-table in the US. I doubt that a big chain motel like Best Western would be doing that. If anything, she just made an assumption that since the others were Jamaicans (as she said) that they were being paid under-the-table. The only places that I have ever heard of that pay under-the-table are little mom and pop places that don't have higher ups to account to.
Every business in America doesn't do the same things, I've worked as an CNA and was hired on the spot after turning in my application, but I didn't fill out my I9 and W-2 form until I was on my lunch break. Filling out your I9 verifies that you are legit to work in the USA, W-2 form is a tax form. She wanted her employer to do something illegal.
An I-9 form is used when an employee doesn't have proper US documents showing citizenship; used by transient workers or immigrants with a work visa. A W-4 form is filled out by employees that shows filing status' and dependents; which determines how much tax witholdings payroll needs to take out of the pay. A W-2 form is what employers give to employees after the first of the year and prior to tax filing deadlines; showing income taxes witheld, number of dependents claimed, etc. that is needed during filing your income tax. My guess is that she does not have the proper documentation to legally work in the US. Employers can avoid hassles like this if they just hire Legal documented US citizens. If prospective employees can't provide ALL legal documents as citizens, then leave them sitting on the curb eating scraps.

She's trying to commit tax evasion or some sort of fraud (collecting benefits while having a job, etc.) but also the business is wrong for letting her work without being able to pay her. They should never assume the person is going to fill out the forms so you usually require them to fill out the forms to start work, usually on an orientation or hiring day. My guess is she's right about them paying some people under the table (possibly for not being able to work in the US) and she wanted the same courtesy but for the reasons I've mentioned. Also, it's hard to see but did she attack the cop or did he just attack her? It seemed his arrest was a little brutal for someone just refusing to leave. If the cop just tackled her to the ground because she pissed him off he's in the wrong too.

So W-2 would be the incorrect form, probably the manager misspeaking. A W-4 is the record for federal tax with-holdings, whereas a W-2 is your annual report that your employer provides you for you to do your tax returns every year. An I9 is the form certifying that you are legally permitted to work in the US. The I9 will require some level of identification such as Driver's License, Social Security Card, etc to be able to be processed.
It is VERY normal to allow people to start work without having submitted that paperwork to their employer as yet, provided they submit it before the first payroll there will be no issues. This lets people get started right away.
If the employer is as diligent as they should be, she will still get paid for the time worked, but she absolutely has to submit those documents, the W-4 in particular, as the employer has a legal obligation to withhold taxes. They can get in a LOT of trouble for paying "under the table". There are also a number of reasons to avoid besides just evading taxes. There could be a court ordered garnishment (separate with holding to pay for some legal issue such as child support) they want to avoid, they could actually be ineligible to work in the US. Those are a couple I've seen in the past.

Just so you, Kabir, a W-2 form is what the IRS sends you so that you can file your taxes. Employers do not file it, or need it. Employees must fill out a W-4 form. Either the HR person is trying to make her fill out a form that does not exist for an employer or employee to fill out OR she has misspoken. No one who works for a legitimate employer can get paid without completing an I-9 and W-4. No one. If she has indeed not been paid for three weeks, all sorts of laws have been broken, mainly by the employer. I used to be an amateur sports official and got paid two ways. Either cash\check on the spot, or the league paid my association and my association sent me a check monthly. I was responsible for declaring my cash income to the IRS. For monies paid to me through my association I was given a 1099 form which listed how much money the association paid out to me for the calendar year. This form was filed with the IRS. As an independent contractor, I was responsible for paying the taxes for all monies paid to me as a sports official. Luckily, I never had to pay any taxes on that income because my allowable deductions always exceeded the taxable income threshold.

Some companies when you just start they held back a week pay, so you first paycheck takes 3 weeks, you will get that week pay back later. W2 taxes form, every company have to pay taxes on their employees and when you have to pay taxes, they know how much, state and federal taxes, they also have to have the information for their insurance policy. I don't know if it's still true, but when the government started requiring I9s, your business could be fined $1,000 per missing document. She may be an illegal, might have unpaid child support (I had to send the W4 to the state), all kinds of things. In a perfect world, you get all of the documents before starting work. I had more than one tense exchange of withholding payment for not filling out the forms.
We all have to fill out W-2 Forms. It explains if you are married, single, gave dependents or not. It determines how many taxes comes out of your paycheck. Something was going on here. I’m guessing she wasn’t legal?

She could be delinquent on some kind of debt or tax obligation or assessment (including having previously declared bankruptcy where wage garnishment is imposed to make the creditors whole) or owes child support, and she is trying to get paid under the table to skirt her obligations or prevent wage garnishment by obfuscating her work from our federal tax agency (the IRS). She could also be a recipient of some kind of government welfare and is engaging in fraud by obfuscating her work so she can report a lower income to remain eligible to receive government assistance. I used to investigate government welfare fraud and this was very common.

a w2 is a form you useally get at the end of a tax year that you need to fill out tax forms but any job you apply for should have all the information that your employer needs on it for the the w2 to be mailed to you

The form are tax reporting forms and with all due respect if she can read to dial 911 and get a driver's license, this entitled brat (not the word I wanted to use) can read just fine. When an employee in the US wants to take some vacation time, he or she must ask the boss first and get permission to do so. You must ask for vacation time well in advance, especially during the holiday season or summertime. The people who work for the company the longest get choose their vacation days before anyone else. Seniority means a lot in America.

A W-2 is for tax purposes. At the end of the year the employee receives the form, which shows what the employer paid and what taxes they withheld. We then use the form to file our Federal and State taaxes.

Their mistake is that they should not have had her even start work until those papers are filled out, that is generally done the very first day you start work, and for some documents, you have to give them those before your start. W4 is a tax form, where you indicated your vital information along with the number of dependents you want to declare, a W2 is the statement your employer gives you at the end of the year showing your earnings and want what withheld (Fed and/or State tax, FICA, health premiums paid etc) you use this form when filing your taxes.

In my opinion this lady and others working there are paid under the table in order to keep the cost down for the hotel. They hired her like they do all the time but if an inspection were to be done, then they have to have some employees working on the books or it's a red flag for a hotel of that size to have only like 4 employees to run it so they will make US citizens fill out the forms to cover for the undocumented ones working. This is how alot of the US is run. Look at what happened in Florida when DeSantis passed the law where if you have undocumented workers working for you or even if you have one in the car with you, you can face charges. When he and the Republikkkan party passed that law construction in Florida pretty much came to a full halt because their construction and hospitality industry is pretty much run by undocumented immigrants and even the farms there were heavily hit.

W2 and I9 are tax papers, the only reason for not filling them out is to not pay taxes, basically she's trying to evade taxes and the company is refusing to pay her without the forms being filled out because if they pay her they will be complacent in her tax evasion which could get the company shut down because they knew about it. There is No place that will hire a person without them filling out those forms, so even IF she did go and do work for them, she was never working for them, she was never on their payroll.

This may have already been brought up w/this many comments before mine, but I suspect she is a dreamer. A dreamer is someone who was brought by their parents into the USA illegally when they were very young. They speak english very well since they learned it growing up natively, but aren't citizens unless their parents have managed to become citizens prior to them becoming 18. This would explain her american english as well as wanting/expecting to be paid under the table. You can't fill out the forms w/out a legit social security or green card number (I think it's green card, but don't honestly know). She may have been told she would be paid under the table, but was a problem employee so they just threw her under the bus saying she never did her forms. It is unusual for a business to tolerate not having the forms filled out for more than a day or so. This is all hypothesis as I know no details beyond what was in the video.
