First a friendly critique of your video. I enjoyed the open vs plain view video, you explained it well. However, this wasn’t so clear. You did a great job establishing the difference between a hunch and reasonable suspicion, but the difference of where RS rises to the level of PC wasn’t 100% clear. Then at the end you are, seemingly, advocating for an arrest of a citizen with less than 50% certainty that they have committed a crime? I would think you could put the levels on a scale of certainty. Something like: How certain are you a crime has been or is being committed? 0-25% = Hunch, 25-50% = RS, 70-100% = PC You also scarcely touched on time place and manner, though in your example you used it but without expanding on it.
Good point but PC can't be that high. Right? Your level of PC certainty is in the realm of beyond a reasonable doubt. The point I was trying to make is that there are some serious crimes where an arrest will be made even if the officer is not positive the suspect will be convicted. Think about a gang rape where the victim states two of the three people in the room raped her. However, she is unsure exactly who the two people are. On top of that, the three suspects tell police they will not speak without an attorney. Who could the cop arrest that night? All three, even though one of them did not commit the crime. That's what I mean. Maybe that helps.
