I am what is called an expert in the field of diving-related injuries. So...try to absorb this thought from an expert: the man was Morbidly obese which has a MAJOR affect upon the physical capacity of the human body to be in a foreign environment (in the water) AND there is NO WAY to predict from a non-medical perspective that this situation could occur. HOW COULD THE RESORT BE AWARE that this cake-eater was going to be in danger ??? they couldn't (period). the sH*&&% realty of this lawsuit is that a woman grieving for her husband (which is totally understandable) is now looking to find closure and blame for what happened.....BUT the man chose to enter the ocean to engage in the process of snorkeling of his own accord.....NOBODY convinced him to do it !!! If you can die from choking on a piece of fruit that you pick from a tree in an orchard, do you sue the person that owns the tree that grew the fruit ?! Sad he died....even sadder that this is now sensationalizing his death irresponsibly.

Her husband might just as well have died snorkeling somewhere else outside of Hawaii. I can only hope that the judge overseeing the case just throw it out of the court and charge her with all court costs, and maybe broadcast to all hospitality institutions in the USA to avoid this woman!
Ma’am, the resort isn’t at fault for your husbands poor health or even common sense. You both knew your poor health, long flight to Hawaii and taking on the physical activity of snorkeling is a recipe for disaster. Actually I live on the Big Island of Hawaii where drowning happens to those out of shape tourists having heart attacks or in her husband's case had preexisting medical issues which is WHY Patti Johnson needed to be next to him since she knew of his medical condition or stay on shore. . Maybe Patti next will SUE the Resort for not telling her to scale walls to reach her resort to use the elevator/stairs. Next SUE both the State of Hawaii andthe State of Flo Rida the Gunshine where I lived for 33 years for shark attacks. Many tourists have SUED the State of Hawaii for Kapu (Trespassing) on private land then fall to their deaths and in one case a DUI driving over a cliff at the scenic look-out getting MIl.$$ awarded to their estate when it's their own fault.
All beaches and tide lines are public in Hawaii. He wasn’t in the resort pool. He also probably had one of those full face snorkels that’s killing people because it doesn’t evac the carbon dioxide out of the mask.
