I find it interesting that these people seeking asylum are over staying visa and then claiming that they have done nothing wrong and are not criminals. Overstaying a visa is a crime...so yeah. That said the real issue than is how can we make it easier for people to apply and what are we willing to allow refugee status for. Yes your country may not be safe but according to the current laws (US and international) you cannot just move to another country. David It's actually not a crime, it's a civil offense. The only penalty you can give is deportation, and a bar (3 years, 10 years and permanent) from entering the United States based on how long you went over your Visa. Since it is not a crime no fines can be given, nor can you recieve jailtime. It may seem pedantic, but the difference is significant, not just from a prosecution perspective, but also how we view and discuss refugees and undocumented (not illegal) immigrants.
