Me too! We might not have been great together as spouses, but we were both adults and considered each other & the kids when dividing things up, looked up child support guidelines on our own & came up with a reasonable amount that was a nice round number within those guidelines, figured out custody & visitation schedule that made sense for our unique circumstances & then brought all that to a lawyer who looked it over & drafted it up for us. Think we spent $350 & never set foot inside a courtroom. Just recently celebrated our son's wedding together with our new spouses & all sat together at the ceremony & reception.
My husband got full custody from his ex, and he was fighting her, her mom, AND her grandma. The judge's final comments included telling them they should all be in therapy. Then she threatened them with huge fines if they ever brought us back to court over bs. That was 20 yrs ago. Good men can and do win in these cases.
Mike, responding to your comment that he should have just left his stuff and gotten out: You're rich so it's probably hard to relate to folks who don't have a lot of money and are closer to living paycheck to paycheck. For those folks getting back a $900 power saw is a lot cheaper than having to buy a new one. That man has to pay $1000 in child support, $1000 mortgage, $600 for his sober living apartment so buying a new power saw is a huge amount of cash out. I'm not saying the mental health cost of going over to the house too retrieve his stuff won't be huge. That ex will make it as messy and as horrible as possible. But I'm betting he just wants to get back to work and he needs a power saw and whatever else to get it going again. [Edited: added the first sentence for clarity]
And that is what the judge saw too. She said that she understands he didn't grab anything when he left. And that woman didn't leave when he was supposed to come and get the things, either. She wasn't even out of the house when it was to sell the NEXT DAY! I believe him when he said he needed her gone to get the things. I bet she made his life miserable and is doing this to continue to make him miserable.
Oh I understand it but I’m just more pragmatic. As an attorney I can tell you unless it’s really something expensive like bodily injury or real estate the financial and emotional cost of litigation outweighs the value of most stuff.

This woman (the ex wife) is getting on my nerves! I kicked my ex out and spent the next week on vacation from work putting ALL of his things into a storage unit that I paid 30 days on so he didn't have to come back to our apartment. Nothing was broken. Nothing was missing. I went through the entire apartment. Not hard to do and not vindictive. She didn't need the power tools. She sold them. She didn't need his clothes, and I do believe she burned them.
I have had to endure people going through a divorce. They are some of the most messed up people ever They don't think rationally. So it doesn't surprise me this dispute occurred so late. Divorced people need to have some sense slapped into them.

I can understand why people have this sentiment. My husband's first marriage ended with her trying to burn the world on her way out. He was stationed in Iraq. She cheated with his friend, stopped paying all the bills, and literally sold anything in the house that she could ... including the fireplace tools and grate. He had to get special phone privileges so he could work with the mortgage company and got the house pulled off the auction block just a week before the auction date. He came home to a house and nothing else. Used his bed roll to sleep on the floor. No power or water since he had to pay the past due balance to get them turned on again. After our son was born, he got into a car accident and it got totaled. The title was nowhere to be found and insurance won't pay out without it. He had to get in touch with her to have her sign paperwork so they could file for a lost title (joint property state). She had the guts to call him and cry about the fact that her husband - the guy she cheated on him with - was cheating on her, then sent a letter claiming that she didn't realize what she had until it was gone and that she still loved him and blah, blah, blah. He could have easily established the mindset that the would never marry again and it would have been 100% understandable. His dad even joked after we'd been together about 3 weeks asking, "Shouldn't you have dumped her by now?" since he hadn't dated anyone for more than a few weeks since his divorce. I'm glad he didn't. We got married 3 and a half months after we met and we just celebrated 17 years at the end of October. And we've gotten married 3 times. First was getting hitched at the courthouse. Second was having a formal ceremony with friends, family, the white dress, reception, etc. Third was a special religious ceremony to seal us for eternity. After that, he said he wasn't going to marry me again, but I got him to agree to a vow renewal after 30 years 😁😁
It appears to me that every divorce has some fraud involved. And a lot of them have some destruction. Those with children seem to be particularly egregious.

The tool he describes is a very nice and expensive tool. Use mainly by professionals in the carpentry or building trade. I don't doubt that he purchased it during their marriage and that it should have been there. As far as I am concerned, she should be at fault here and her penalty should be the loss of any profits off of the house. You shouldn't on top of that be ordered to pay the value of those tools too her ex-husband. And finally the money is going to be hard to get from her so a reduction in his child support for the period of time that would make up for the cost of the equipment and tools and clothing. That part can't be done due to the fact that it's the children's money but I would reduce his child support either way. On top of that I would possibly order the value of the tools and equipment and such to be paid by her to him in this divorce.
When this man was retrieving his property on the court ordered specified date, and his ex and her new boyfriend were on this property, why didn’t this man call the police for a non biased report of what happened that day? That would have stopped the he said, she said of the happenings that day.
He is lucky was not married to either of my ex-wives. Before the marriage and during the marriage day promised and explained that they would never be vindictive in a divorce and then the divorce comes. Unfortunately I told them both they could have the furniture that they could use. Unfortunately again, that was not specific enough and both of them took every stick of furniture in the house. The house echoed when I came back to the house. I should have been specific about the items that they could have. Such as life. I made it through that and I am so much the better for it.

Despite the fact that I have been happily married for 17 years after having gotten married just 3 and a half months after meeting, I agree that people need to take it slowly and be cautious.

As usual Mike is correct about (American) marriage. After watching this hearing, I'm counting my lucky stars my ex-wife wasn't this vindictive in our divorce.
Not just American. A study conducted in Sweden concerning winning the equivalent of 10 million dollars showed that women where more likely to divorce outright and not marry than men which showed they were more willing to marry and invest in their, current, marriage.
I am a woman who was screwed over by a man in a divorce back in the 80s. But, there are plenty of women out there that are vicious and will do anything to get on top of situations. So, I don’t defend women in these cases until I can hear and see what Mike brings to us!

@LTWM Mike, I believe the Judge is wrong about the husband not picking up his items when his wife was their against the orders. He BY LAW would have had to leave immediately when he found her there due to the PPO/No Contact order that was in force at the time. What would have happened if she called the cops while he was loading up? He would have , most likely, been arrested.

He is lucky was not married to either of my ex-wives. Before the marriage and during the marriage day promised and explained that they would never be vindictive in a divorce and then the divorce comes. Unfortunately I told them both they could have the furniture that they could use. Unfortunately again, that was not specific enough and both of them took every stick of furniture in the house. The house echoed when I came back to the house. I should have been specific about the items that they could have. Such as life. I made it through that and I am so much the better for it.
The judge got this absolutely correct! Women like this give other women a bad rep! This woman is disgusting!

@@LawTalkWithMike Not only do laws regarding divorce suck, that being the legal term, but the bias in the courts toward women is awful. Unless there is a lot of evidence supporting the man a man’s best bet is mediation.

She is nuts, but the dude made a horrible decision to marry her. He even said "she couldn't be on the mortgage because she had so many foreclosures". Before marrying people make sure to slow roll and THINK. Once married this is the nightmare.
Despite the fact that I have been happily married for 17 years after having gotten married just 3 and a half months after meeting, I agree that people need to take it slowly and be cautious.

As usual Mike is correct about (American) marriage. After watching this hearing, I'm counting my lucky stars my ex-wife wasn't this vindictive in our divorce.

A study conducted in Sweden concerning winning the equivalent of 10 million dollars showed that women where more likely to divorce outright and not marry than men which showed they were more willing to marry and invest in their, current, marriage.
Oh yes it’s a mess all over the world but especially bad in the west.
I am a woman who was screwed over by a man in a divorce back in the 80s. But, there are plenty of women out there that are vicious and will do anything to get on top of situations. So, I don’t defend women in these cases until I can hear and see what Mike brings to us!

@LTWM Mike, I believe the Judge is wrong about the husband not picking up his items when his wife was their against the orders. He BY LAW would have had to leave immediately when he found her there due to the PPO/No Contact order that was in force at the time. What would have happened if she called the cops while he was loading up? He would have , most likely, been arrested.
