    Separation of power is ensured firmly by presidential system. But we retained Westminster moder because it ensures "Responsibility" Over "Stability" & our first generation lawyers were experienced in it... Extremely discussion indeed

    Split should not be done away with but reintroduced with majority voting for same instead of 1/3 rd. Stopping defection is taking way individual values of MPs and MLAs.... Especially when internal democracy in national and regional parties is abysmal.

    6 Months for Nominated Members: because there is a maximum gap of 6 months between 2 sittings of the house, the nominated candidate gets a chance to see for themselves and then decide if at all they want to join, the party of their choice

    In US, Europe and other developed nations the members of Parliament or the equivalent can vote against their Party's stand.... There is no reason for any political party should have a dictorial control of few, the all powerful high command. Of course the overall ethical standards of politicians and also society needs to rise to the levels observed byHieung Tsang. It cannot be a forgone conclusion that people only vote for party and not the individual. Many independents have own elections consistently in every election going against the party mandate.

      Party discipline is very strong in the Westminster political system that is used in India and the UK.

    The suggestion that the Anti defection law should be applied in the times of no confidence motion and also at the time of money bill is very pertinent.
    Otherwise the Act is defeating very functioning of democracy in the parliament and state assemblies.
    The Act is a failure as defections did not stop, but it succeeded in making MPs and MLAs slaves of their Party Presidents. They no longer represent their constituents. And they lost freedom of expression also because of this Anti defection law.

    I liked this episode for political objectivity( lack of visible bias) of expert.
    I agree with the point that scope of it should be reduced just for no confidence motion and money bill. In fact may be just NCM with a constitutional amendment that failure of money bill will not lead to automatic fall of govt but instead would warrant a confidence motion by government.
    Second amendment in 10th schedule should be that candidate elected for a particular term of assembly can't stand for a bye election in between, so that karnatka, Madhya pradesh like situation could be avoided. Merger rule can stay as its more like post poll alliance. We cant have unelected party dictating elected representatives where to vote for.

    A political party makes several promises to the people in its manifesto during the elections. If the law is done away with or watered down, then how will the party be certain of delivering on those promises?

    I would like to see discussion on dowry act. People made much of the criminalisation of triple talak by saying that you can't criminalise civil act but then same is case with dowry.
    DVA is another thing but anti dowry act is ridiculous as its impossible to implement. Secondly it goes against the idea of equality. Father can give gift to son and daughter in law in their marriage but not to daughter and son in law.

    Fun fact, CJI YV Chandrachud appointed BN Kirpal. BN Kirpal appointed DY Chandrachud as judge. And DY Chandrachud is trying to appoint today's guest Saurab Kirpal as a judge. When it wasn't done he claimed it was homophobia 😂
