For large parties, like eight people, the waiter typically inquires before the orders how the bill will be paid or whether the checks should be split. I am not sure whether it was confirmed that the diner acquainted with the waiter actually did go back to pay his portion of the bill. That would be a mitigating factor.

There were people now and again who would sneak out at the back stairs next to the bathroom. The manager and I had words but I was in no way going to pay their bill.

It's clear wrongful termination, witholding wages, illegal termination, wage theft, harassment and discrimination...among other things. He gave information that would help the owner make a police report and sue the customers, and the victim could also make a case against the customers for problems it caused him. The employer needed to follow through with police and convicting those customers so the victim could get his case easier. As the employer said, he didn't check the walkouts for payment either. He could have checked the table. The management made a noticeable bad decision being short staffed with over capacity, which put his employee in a bad position

What employment law did the owner violate? 49 out of the 50 states (along with DC) are at will states meaning an employer can fire you for any reason or no reason at all (except if you are a protected class). I've been hugged by customers that I didn't know. It's uncomfortable. However you hug the customer back in order to prevent them from feeling as uncomfortable as they made you. Otherwise you may not even get a tip. This is how drunk people can behave. It's why I don't like waitressing and prefer to work at a counter. I want there to be something between me and the customers.

Not sure I completely agree with the judge, I think there is an arguable basis to dock the pay (ie negligence) but she would need to tease out whether they were understaffed and busy and so on.
