On February 9, magistrate Preeti Singh of the Ghaziabad court charged Aarushi Talwar’s parents with murder and the destruction of evidence on the basis of the closure report of the Central Bureau of Investigation (CBI). The CBI could not gather enough evidence to chargesheet the Talwars but it left behind a trail of damaging insinuations that the media replayed without hesitation or conscience. Neither the closure report nor the magistrate’s orders were questioned for their glaring contradictions.

Parents killed both
This is most likely what happened:
- Hemraj invited Krishna and Rajkumar to his room to chill and drink beer. They likely had done this many times before too.
- The 3 people talk about Dr. Talwar scolding Krishna in the clinic in front of everyone.
- Krishna and Rajkumar persuade Hemraj to get more liquor so he agrees to quietly get a bottle from Rajesh's bar.
- While he is pouring alcohol, Krishna and Rajkumar enter the house and look around, find the key to Aarushi's room hanging on the door and let themselves in and try to molest her.
- When she resists and tries to scream, Krishna hits her on the head with the blunt edge of his khukri. By now Hemraj has just arrived on the scene and is shocked to see what has happened.
- Hemraj completely freaks out, so Krishna and Rajkumar drag him out of the house to sort things out. They bring him to the terrace. The intention is to of course calm Hemraj down and chalk up a plan and not to actually kill him.
- On the terrace, it became clear that Hemraj was not getting convinced to run away with them. He started to tell them that he would wake the parents and let them know what happened. The servants were at a loss as to what to do. They could not leave Hemraj and run away as they were sure Hemraj would tell the parents and they could not convince him to run away with them. As they had no choice, Krishna hit Hemraj from behind while the latter was arguing with Rajkumar. They then slit his throat, dragged his body and hid it in a corner, locked the terrace.
- Back in the flat, they collected their belongings, slit Aarushi's throat as well and cleaned up the crime scene and dressed it so as to make the suspicion come on the parents. They know that anyway, because there were four people in a flat and two of them end up being murdered, the burden will fall on the other two to prove their innocence.
- On their way out, they drink some scotch and leave.
Had the Talwars actually committed the murders and cleaned up the crime scene, they would not have left a whiskey bottle with bloodstains and fingerprints on it or a bloody palm print and a bloody foot print on the terrace (also note that the shoe size of the foot print did not belong to Dr. Rajesh). This only suggests that an outsider did try to clean up the crime scene, both to cover his own tracks and to ensure that the needle of suspicion points to the Talwars BUT did not have the guts to stay back long enough to wipe off all traces of blood because he was worried that the parents would wake up.
The whole case goes on to show how powerless we really are as ordinary citizens and that if the system decides to screw you over, because of corruption and ego issues, then the fact that the truth is on your side will not help you. A lot of evidence that would have absolved the Talwars was suppressed. They spent 4 years in jail for a crime they did not commit. Their lives were ruined because of the corruption of our justice system.
It is indeed mystery of the century.
Wht r chances that police ,cbi etc will botch up the case and in a simple murder case it would take yrs to find out.

Without showing any doubt or putting blame or alligations on Parents/ Servants, during the initial stage of investigation CBI/ Police should have kept the cell numbers of Parents and Servants on surveillance without letting them know from June 2008 to July 2008 for these 2 months. Police/ CBI should remain silent during that time.
When the criminal is not worried about being cought he will definitely make a mistake of talking on cell with someone and expose himself.
In that way case could have been solved.

page 29 of the CBI’s own closure report states that there is no evidence of Hemraj’s blood anywhere in Aarushi’s room. So if Hemraj was killed in Aarushi’s room, what happened to the blood? And if he was not killed in Aarushi’s room, what happens to the ‘motive’ of “grave and sudden provocation? The prosecution claims that having killed Hemraj in Aarushi’s room the Talwars dragged the bludgeoned and blood-soaked body up the staircase (which happens to be outside the apartment and not inside as some reports have insisted) then came down and “dressed the scene of crime.” This implies that they washed the trail of blood on the stairs, wiped their finger-prints off everything they touched, discarded their clothes soaked in Hemraj’s blood (which means they left the house and came back), locked themselves in (since the next morning, the maid found the door locked from the outside) and sat waiting to be discovered. The prosecution explains the missing blood of Hemraj by alleging that the Talwars “dressed-up” the scene of crime. This would imply that the Talwars accomplished the impossible task of mopping up Hemraj’s blood while leaving Aarushi’s intact! (The Defence had good reason to ask whether the colour of Hemraj’s blood was blue for it to have been selectively cleaned!) Now, if the Talwars have indeed demonstrated such expertise, skill and pre-mediation as assumed by the prosecution then they must surely be experienced, cold-blooded killers who under the guise of dentistry, have perfected the art of killing. In which case, the motive of “grave and sudden provocation” comes crashing down. Because if this ‘motive’ has to be established, Hemraj’s blood must surely be found in Aarushi’s room. If not, we must ask, who killed Hemraj on the terrace and why?

The tests showed INCONCLUSIVE. which means neither lie or true. The machine could not tell.

CBI said nobody enter the apt and nobody left apt as per checks with watchmen and people so quest is where are the weapons , cloths , mobiles ... Who picked the phone at 6.01 then switched off , who called hemraj from unknown number at 8.27 on 15th then at 9.10 arushi mobile went out of reach at 9.30 driver comes and handover the keys. I think the mobiles went out with driver. Hemraj didn't had dinner he might aware of upcoming incident , only 25 ml liquid found in hemraj body but beer and wine was used in 2/3 glasses in his room and visky was touched which had blood on it

In Arushi Talwar case, every channel ,any Tom , Dick and Harry tried to show how parents are guilty. Very sad. After completely destroying the lives of all concerned and after so many years finally Talwars are out . Thanks to Allahabad High Court for giving proper verdict now. Very sad story. People are really heartless.

The servants had cast iron alibis. All of them were present in their own houses during the time of murders. CBI had no evidence that the 3 servants were present in the Talwar's apartment apart from the narco tests which are highly inconclusive and unreliable.
There were no phone calls made between these 3 before the murders and no physical interaction in order to plan to meet Hemraj on that night. One of the alleged servants, Rajkumar was at his owner's house and had dinner at 12:30. It takes 20-30 mins to reach Talwar's apartment from his house on a bicycle. The post mortem reports concluded that both the murders occurred between 12 am and 1 am which doesn't fit the timeline. The security guards of Talwar's complex didn't see any of the 3, entering or leaving the society. I think it was a complete outsider who wanted to kill Hemraj but had to kill Aarushi because she was a witness or, it were the parents. This case is India's biggest unsolved murder mystery.
Also, the security guards of Rajkumar's complex didn't see him leaving or entering the complex. The khukri recovered from Krishna's house had animal blood on it and wasn't Aarushi's or Hemraj's. When Krishna was arrested by the CBI, Rajkumar and Vijay didn't try to abscond. Hemraj was a tea-totler too.. why would he host these 3 people when he is well aware that he could get fired if Dr. Talwar found out. I agree that they dressed up Hemraj's crime scene by hiding his body with a cooler panel and dragging it 20ft towards the corner so that he will be the suspect until his body is found but, Why would the servants dress-up Aarushi's crime scene?? I mean, once you have committed two gruesome murders, you just push-off from the crime scene as soon as possible. It is highly unlikely that 3 drunk men would escape and be completely unnoticed. It is very strange that instead of running away, they kept drinking whiskey when they were well aware that the parents are sleeping mere feet away and could wake up any time.
@@rugvedmulay5090 I don't know... As far as Krishna's alibi is concerned, it cane from his own family. Of course they could easily lie to save him. Only thing that does not support my theory is that Rajkumar has an alibi from his employers who are the Talwars' friends. Given how inept the investigation was, I will not be surprised if the post mortem guys also made a mistake and that the actual murders happened after 1 AM, which would have given Rajkumar time to reach Talwars' house. Also, in any housing colony, there are several ways to enter and exit without being seen by the guards. The head security guard himself said this later on.
More importantly, everyone says narco is unreliable. But my question is this: "IS IT SO UNRELIABLE THAT A COMPLETELY INNOCENT MAN WILL SAY THAT HE DID IT??" What kind of drug is that, which makes a totally uninvolved person hallucinate so much that he will say he was at the crime scene? And if it IS so unreliable that an innocent man will say that he is guilty, why use narco at all? The parents were also subject to the narco test, they never said anything like that under the influence of any drug!
Even in spite of that, one can say that the servants can STILL be given benefit of doubt as the evidence against them also is weak. Then in all likelihood, I do acknowledge that this might have been HEMRAJ's murder by an outsider and that Aarushi was killed for being a witness. The parents had to suffer because the CBI were such corrupt crooks.
@@pundit5682 I agree with you that Krishna's alibis can't be completely trusted. But, I believe that the 3 servants were trying to be framed and the evidence against them is very weak. Speaking of the narco tests, they can be rigged by asking provocative and very leading questions which were being asked by the lady who conducted the narco test on all the 3 servants. She was later detained for malpractices and other issues. Due to these reasons, it isn't admissible in the court. The parents could be innocent as nothing conclusive came against them in the tests. CBI said that the parents' tests were inconclusive. Unfortunately, The crime scene was heavily botched-up and only 2 viable fingerprints could be recovered which didn't match with any of the servants or the Talwars. This is the Indian 'Joe benet Ramsey case.' I won't give a complete clean chit to anybody here as there are no witnesses and all the evidence presented is just circumstantial which lays a shadow of doubt. I think it was a complete outsider (could be a loan provider) who, was given a friendly entry by Hemraj but an argument broke out between them and they went to the terrace but, he got killed there. The killer, then came down to take Hemraj's phone so as to erase his records but Aarushi saw him and as a result, got killed too.
However, the involvement of the parents is highly debatable.
The outsider theory too has some contradictions-
1) No outsider would dare to spend so much time dressing-up the crime scene.
2) What will be the purpose of dressing up Aarushi's room for an outsider?
3) Why will a killer cover Aarushi's body with a white blanket? Why will he risk himself getting caught to find a white blanket and what was the need anyways?
4) It is pretty odd that the killer Has cut both the throats so precisely.
5) No experienced killer would ever spend so much time dressing-up, locking the terrace door and drinking whiskey when, the parents are sleeping just a few feet away and can wake up any time.
6) After killing 2 people in a house of 4, the killer's topmost priority would be to escape instead of drinking half a bottle of whiskey.
7) Why would an outsider take away Aarushi's phone?
8) Aarushi's phone was formatted after her murder. Why would an outsider do it? It is foolish to sell her phone as it could be tracked later and the investigators could know the outsider's whereabouts and his facial description.
This case is very messed up man....

Parents were not professional killers if they killed them in sudden rage it was possible that they could have accept in these years.
Hemraj told his wife and in a NGO that his life was in danger by his dear one. So I think it was planned murder of hemraj as no proof of someone coming or going in CCTV footage and also no one saw any one coming or going as it was already planned so they managed these things. They killed hemraj. Arushi was killed being a witness.

Both Arushi and Hemraj were killed on the terrace. They were seen on the terrace in an objectionable position. Out of anger, Rajesh Talwar hit at Hemraj with Hocky stick but missed the target, and Arushi got badly injured. The second hit was on Hemraj.
The injuries on them caused their death. (Later on their throat was slit )The injury on Arushi was on her forehead and Hemraj had an injury on the back of his head. This reveals both of them were seen in an objectionable position or sitting on the terrace face to face and talking . Since they were killed on the terrace no blood/DNA of Hemraj was found in Arush's room.
When Hemraj's body was found on the terrace he was in his slippers, pant, and shirt and a wrist watch. This means he had the plan to leave Talwars house in the night itself or he came back from outside after meeting the person who called him from a PCO. Hemraj had feared for his life and indicated the same 2/3 days before his death to a lady social worker. So Hemraj had the plan to leave Talwars. He wanted to share something with Arushi and took her to the the terrace.
