      Great point! We just had a big case in Nevada where the Nevada Supreme Court basically said there is an implied civil cause of action under our state constitution for violations of our search and seizure clause.

      The Magna Carta states in Clause 45 We will appoint as justices, constables, sheriffs, or other officials, only men that know the law of the realm and are minded to keep it well. This means that police officers have a legal duty to know the laws they enforce. The U.S. Supreme Court made an un-Constitution ruling when they fabricated by fraud the Doctrine Of Qualified Immunity as and affirmative defense. When a person is injured there must be a remedy.

      Judicial and prosecutorial immunity too. When there is a record of a judge refusing to follow the law and court rules, over objection, and also incessant ex parte communications with one side, that should not be labeled a judicial function that enjoys immunity!

      Here is some good news. Three states have struck down qualified immunity and most "recently" (2 years ago) it was New Mexico. I hope this trend continues.

      @@fatherinexile imagine a cop responds to a situation they have never experienced and unaware on how to deal with it (they are not lawyers). What should they do? The action they take when they are "ignorant/unaware is what is protected under qualified immunity. Abolish it and police may have to sit back and watch some situations.

    No judge should ever have the power to extend or remove immunity... that isn't law... that is criminal. End all immunity and discretionary prosecution for all public servants to start.

      Earlier this year, an error was discovered that qualified immunity is unconstitutional under the Civil Rights Act of 1871. In the Act it is clearly unlawful. SCOTUS has been made aware and will hear two QA cases this session. Keeping my fingers crossed.

    Imagine this perverted logic actually applied! The cop has qualified immunity because he had no duty to report misconduct, and the judicial system is immune because they didn't know about it?
    IOW, the government can do whatever it want and never face any consequences. Wait, that is what is happening most of the time.

      SCOTUS is the court that came out with QI. Can any officer explain how QI justify an officer to be ignorant of Constitutional Rights? If they do not know what a citizens Constitution rights are, why do they swear an Oath to uphold those rights? I don’t really expect an answer because QI gives law enforcement the ability to be ignorant of the law with No accountability.

      @@crazyk9754 I’m no officer, but the way I understand it, qualified immunity mandates ignorance. Ignorance is a necessary ingredient for QI. If a LEO is well-informed on the law, then they are not immune, because they would be knowingly and willfully acting in bad faith. However, if they are ignorant, they are able to claim that they were acting in good faith. So, what it boils down to is this: the more ignorant the government minion, the more immunity that minion has.
      Another question, entirely, would be: why do judges let cops play ignorant in court (when it benefits them), even when they have nearly limitless audio video record (body/dash cams) of that same officer saying things like, “I don’t need you to tell me how to do my job”, “I know the law. I’m a cop”, etc.? I can guarantee you, if you or I were in court, and they had video of one of us “spontaneously uttering” a statement that negated our entire defense, those statements would be front and center every step of the way. …but, it’s different for them. They’re special.
      Remember: on the animal farm, all the animals are equal… but the pigs are MORE equal.

      A new agreement that considers public rights should be publicly reviewed adopted and voted in. The agreement of a public offical should never be done in secret or obscured from public view ever.

      Wrong. When they lose QI they still aren’t held responsible because taxpayers are the ones forced to pay, not the cops, because they still have civil immunity against monetary damages/judgments! Two separate immunities and BOTH must go.

    Forget qualified immunity, we need to throw out prosecutorial immunity which is essentially absolute immunity. In this case, yes it is likely that the cop lied to get her arrested but that’s hard to prove. The misconduct in this case was the DA’s office committing Brady violations, refusing to add officers who have been found by IA to be dishonest to the Brady list for months or years, and when this officer was added to the Brady list and they were forced to amend the case file they just added a note that said new evidence was found and didn’t inform Ms. Salazar or her lawyers so she spent additional months in prison even after it was clear that this “new evidence” would result in a dismissal and new trial!

    All qualified immunity should be removed. This way the Taxpayers don’t have to keep paying out these law suits . Think about how much money would be saved that could be used on things actually needed .

And what we spend on needless military equipment, this illusion of defense that requires a huge chunk of the budget,subsidies to billion dollar corporations, subsidies to private companies playing with rockets,or to private business that make electric cars for profit.       I haven’t had a trial in 4 years in the corrupt Santa Clara County, CA Family Court. I haven’t seen my kids in 2 years since I was falsely arrested. I just filed my federal civil rights lawsuit. The first one. Those will be going on for years. Justice delayed is Justice denied.

    So the cop lied and fitted up an innocent person on fake charges, he was investigated and found to have lied months before the persons trial but the DA still prosecuted the case and sent an innocent person to prison. The DA knew the person was innocent all the time and still went ahead anyway, me the DA needs to be sued as well as disbarred.

    QUALIFIED IMMUNITY allows cops to go into every situation with the idea that NO MATTER WHAT THEY DO THEY WILL GET AWAY WITH IT.
    QUALIFIED IMMUNITY allows cops NOT TO THINK ABOUT THE LEGALITY, CONSTITUTIONALITY OR HUMANITY OF THEIR ACTIONS.

    She wasn't exonerated, the State decided not to pursue charges.
    Hmmm, I wonder if the prosecutor, who is a lawyer, learned that a citizen is PRESUMED innocent until proven guilty?
    If the State doesn't pursue charges, the citizens doesn't need to be exonerated, they are innocent, by definition.

      Exonerated means an actual finding of innocence. That is much different from not filing charges. It's in your own words - "presumed innocent". Exoneration is factual innocence

      Private citizens benefit from collective bargaining in their workplace ie. union. However a police officer while working is working on behalf of the public therefore should b held accountable for their actions. And teachers whether in a union or not can be held liable for their actions

    In watching courts and appeals, it is openly evident that all too often the nuances, incompetence, technicalities, and process are used against naïve unformed trusting citizens by police, prosecution government personnel. Why does "government" by default get immunity against presumed innocent citizens?

      If a citizen asks questions, he is being difficult and charged with obstruction. If he doesn't want to comply with id, papers demand or answer stupid 20 questions its assumed because he is guilty of something, he isdisorderly. If he gets assaulted, he deserves it for resisting even when illegal or no basis. Once detained or arrested the process is part of the punishment. Police can lie or make up anything but if you make any misstatements, you are charged with obstruction and lie to a police officer though not a sworn statement. And it's being uncovered with video evidence so they are always suspicious of a guy with a camera, even on public grounds! Amazingly if police trespass into your property, even unannounced, they are authorized to kill you, your right to self defense evaporates because you should be able to understand assault or home invasion is by unannounced police, not a home invasion. I have even seen several instances of police shooting from curtilage because the saw someone inside their home with a gun and still you have a long legal battles, if lucky qualified immunity is removed and they get held accountable more than the usual vacation time punishment. The more you know!

    I think qualified immunity should never have been put into place anyway I think that cops should be held to the same standards that we the civilians are held to because we do have a constitutional right and law that tells us right from wrong so no qualified immunity for anyone

      There are actually 2 ways to overcome QI, the first is "clearly established", the second is the action is facially unconstitutional, IOW so egregious and so obvious that no prior precedent is necessary. Courts love to ignore the second path, focus on the first, and then argue down any evidence that it was clearly established and grant the cop QI. Have to remember, a cop has 3-6 months backlog of citations on the books, if they get "brady'd" then all those citations are going to get dismissed, all the prior convictions could be overturned, and a lot of $ goes out instead of coming in. In most jurisdictions, some % of all fines go directly into an account for the judge to retire on. So in most instances, a prosecutor won't even look at any accusation against them and judges have an interest in keeping that backlog of revenue protected/viable and granting QI regardless of the harm to the constitution and the peoples rights.

    The officer was found to be a lier and yet they want to fight this case saying that the system didn't do THEIR job properly!!
    Funny how officers are in charge of upholding the law and they when he they get caught braking it, they use every aspect of the laws to cover their asses. And when the law doesn't go their way they appeal.

    I remember when police would come to our school and show us different stuff. Everyone wanted to be a cop on the playground.
    So what happened?
    Two things happened.
    First there was a Supreme Court ruling that recognized it is impossible for a police officer to know each and every law he is supposed to enforce, giving them Qualified Immunity. Even though every cop has excess to States Attorneys, City Attorneys and Prosecuting Attorneys to clarify the law on the spot, a luxury no American citizen has.
    Second, the police force's became Unionized. Now they dictate what is taught at the Police Academy's instead of the City Council. And the Police Unions eliminated the sections on RAS, the Constitutional/Civil Rights of citizens. The Unions have plenty of money for attorneys and all of their friends work in the court system. Witnesses for the prosection damn near daily.
    Just think about what Qualified Immunity means! A cop is Immuned from violating a United States citizens Constitutional/Civil Rights! Immuned! That is so ridiculous that States are nullifying Qualified Immunity. Good for them!
