"Following orders" has been used as a defense in other cases, where the soldiers did not have the knowledge neccessary to understand what they were doing was illegal or the order was a snap judgement that did not give them time to think about what was happening.

The judge in banning mods has effectively enabled chaos by removing the order, and you could reasonably argue that without order, the judge is enabling unethical behavior which is, in itself, unethical decisionmaking, and he should be banned
While I see your argument; how many had to die needlessly before we got any peace? And who enforced that law? Judge Bot. You can argue chaos, but it's chaos without uncertainty, and cruelty, where one man can have you executed on a whim.
