This is more complicated than the lawsuit makes it out to be. According to the Nevada Secretary of States website, Mirtyl is designated as a “Manager” of Jettson Donut LLC. LLC’s have members and managers where corporations have presidents, vp’s and treasurers. Members are owners and managers run day to day operations. Managers are legally authorized to take out loans, open bank accounts, write checks, etc. without permission of the members. According to the suit, the transactions were between Mirtyl and the LLC not the Lawrence’s personal accounts like stated in the vlog. It’s also interesting that the complaint doesnt addresses the fact that Mirtyl is a principal/member of the LLC. It also states that he is only paid by Wasserman which is absurd that he wouldn’t be paid from a company that he is responsible for managing.
This is the most interesting bit I've heard since this whole thing came out. That actually changes things quite a bit. It's being framed as him embezzling money from their accounts but if he's actually a member of the LLC he would definitely be authorized to spend. This might make it more of a Wasserman vs Lucas deal after finding out he was in business with one of their clients. Just speculation but your comment if accurate definitely framed this thing very differently in my eyes.

If they have concrete evidence, they wouldn't want a jury trial as the judge will make a ruling based on the factual evidence.. The only reason to want a jury trial is if you don't have evidence and you want the ability to convince a jury of how to interpret loose correspondence or witness recounts. A judge won't be persuaded to interpret that type of evidence with bias or emotion (shouldn't anyway).

Incredible handling of this unfortunate situation, by the Lawrences, Their Agency and Vital MX. I know some might think or even say, "How/why would the Lawrences let this get so out of hand and go so long before speaking up? They just did. Artists and Athletes live very busy and focused lives. They are rarely monitoring their finances, that's what trusted Managers, Accountants & Lawyers are for. Think Nicolas Cage's situation with his corrupt 2,000's Business Manager, who stole over $20m from Cage, before he realized it. If in fact Mirtl is guilty (which it sounds to me like he is) he is a slippery one to pin down. Heck, he led Alpine Star along for hundreds of thousands.

Why are they using an agent as their accountant? Mirtl, as an advocate for the Lawrences, is a salesman, a hype man. His aim is to 'win' negotiations and get as much as possible. He's selling 'success' to the sponsors. You don't want an optimist like this in charge of your accounts. No, you want a dour, no-humor, by-the-books, to-the-penny, boring-ass accountant to do that. If the allegations are true, the Lawrences put a scorpion on their backs, and wondered why it stung them. Not blaming them, but the sport isn't known for the highest levels of professionalism, and this should be a big lesson to all.

Innocent until proven guilty. However, if proven guilty, this is how you put a death sentence to your own livelihood and any future outlook of potential employment. Also background checks for employment will never pass.

Once the amount you stole goes over a certain amount it becomes criminal and it isnt always up to the person that lost the money, whether or not they get prosecuted for the felony committed. The amount threshold changes based on what state your in i would think and im not sure what it would be here.
