I like your thinking, but they're just going to make the argument that you shouldn't have been using anything close to what certified and trained law enforcement has access to. The other guys lawyers and prosecutors aren't there to see justice served, they're there to win. Whether they lock up an innocent man who did nothing but self defense or not, they don't care. For what it’s worth…I’ve been on both sides of the law. I was a LE officer for 30 plus years and during that time, my partner and myself found ourselves in court defending ourselves in a use of force case that we were both indicted for. First of all, prosecutors are just as dirty as defense attorneys. They are all cut from the same cloth. And yes, they will use anything and everything against you, including social media. With that being said, I am not using a half rusted shotgun in home self defense for fear of being targeted by a rogue prosecutor. The gun of choice, with optics and a light, weren’t chosen because they are “fun” to shoot on the range. They were chosen to be the most effective and lethal firearm to use in a life threatening situation. If I potentially never get it back, so be it. It served its purpose. As far as ammo, I am going to use a reliable, well known ammo, but not necessarily what my local police department uses. Let’s be real, most LE agencies are hampered by liability issues or funding and do not always have the most reliable equipment. I probably wouldn’t use Dragons Breath shotgun shells or something radical sounding however. Just be right in your decision to use deadly force, make sure it was your last resort, and be prepared to get a great defense attorney. (Side note- we were both found not guilty by a jury on those bogus charges.)

I was still wondering if I was going to blue lights behind me. I was 23 and still new at carrying a pistol.
There was a house in my neighborhood growing up that had stickers covering their door that definitely would look bad in court - like "I don't dial 911, I dial .357" ," if you're here at night, you will be here in the morning"- with a chalk outline, "trespassers will be shot on site, survivors will be shot again", etc. my favorite one - " this house is guarded by shotgun 4 nights a week, guess which 4"
Been a police officer for 29’years both at federal and Texas law. Not once has the Brand or Type ammo been an issue other than to simply identify caliber type used. Not even once.

I had a NRA Benefactor and retired prosecutor informed a group of firearms owners like myself during a self defense seminar to use a good firearm that is reliable and you "can afford to LOSE"... to law enforcement and that was 31 years ago in "California"!
That's correct. Never use an expensive firearm in self defense in the states as they will confiscate your pistol and you may not get it back without a long hassle.

Most often, after forensics is completed the firearm will be extensively used, tested and stored until DA's adjudication. The firearm will not be as pristine if and when the firearm is returned . That expensive Wilson Combat M1911 or Korth revolver "won't" be after being turned in to LEO's.
Just watched a court T.V. case where the defendant used hollow points. Even though it's legal, the prosecution tore him up about using "man killer ammunition". He made a great case to the jury.

Short answer is no. It's either a good shoot or a bad shoot. A liberal judge and jury can try to make a good shoot sound bad but bullet choice is irrelevant if it finds it's target.

An acquaintance of mine shot 2 people that were attempting to rob him on pizza delivery (they didnt die, but one guy had a trach tube in his mug shot). When asked by police what ammo was used, he stated they were random rounds he loaded up with from previous range trips. I feel it was a great answer.
Our local deputies carry black hills ammo extreme penetrator. I know this because I used to be a deputy. That ammo from them is not on the civilian market made especially for them. They said 1 bullet could go through 3 of our body armor.

i can put up a good argument on why factory semiautomatic rifle and semiautomatic pistols ammunition is the most dangerous ammunition to the owners of these firearms and the need to reload/manufacturing your own ammunition, proper steps in the loading and the last most important step properly checking bullet and case mouth tension proving / proofing bullets will not creep back into cases causing extreme dangerous chamber pressures. most gun blowups the falt generally falls to the ammunition. we see more and more semi auto recall and warnings year by year. i have over 45years experience and knowledge of reloading many, many calibers and firearms, i rarely buy factory center fire ammunition for rifles and pistols but i personally check. my reloads and factory ammunition every bullet with no exceptions or excuses. it only takes seconds per shell. papa wishing you well 😊

Take a copy of the expungement letter with you and give it to the dealer. Typically if it has been expunged it shouldn't show up in a background check, but don't just check the no box, that would be a felony in itself.
Good video with great information. We have Carry insurance, with knowledgeable attorneys. I hope that we never need them, but trouble can find you even if you are doing everything right.
Listen people. The only thing that matters is WHY you shoot - not what, where or how. There is NO statute, case law or jury instruction that refers to the type of ammo, optic, caliber or any other extraneous thing. Now, if the police/DA/Prosecutor does not like your "WHY" then of course EVERYTHING matters. Avoid questionable shoots and people will not ask questions.

No matter what type of ammo you use , unless it is illegal like handgun armor piercing a prosecutor MAY make an issue of what type of ammo you used BUT this would come up more likely at a civil trial by the turds relatives . Just make sure you have a competent attorney that has knowledge of firearms and ballistics to counter any claims .
Good points. Why give a lawyer something easy to demonize when you can make equally effective firearm choices that seem less threatening to the general non-gun public. A simple wood stock 8 shot pump 12 gauge is every bit as effective as one with 50 feet or picatinny rails with a dozen wonder gadgets bolted onto it, but it sure doesn't look as menacing to a non-shooter. Regarding handloaded ammo for carry, I can't imagine anyone in the arrest/trial/legal process knowing enough about guns to ever figure out you were using handloads unless you tell them. Very few shooters even know about handloading, non-shooters don't even know it exists.
That is literally the biggest annoyance I have with this crap. Oh you need carry insurance blah blah. Unless you ACTUALLY did something wrong, you'll never see the inside of a courtroom. You train, you play what if scenarios in your head. At the end of the day, situational awareness, situational avoidance. You'll be fine. I've had to twice. Both times, I said what happened and went home. Evidence was clear as day.

It is probably best if the box of your carry ammo says “Defense” instead of “Law Enforcement” like the HST, which is the best. +P would also be presented as extra deadly, so if prosecution is the only consideration and your barrel is longer than 3.5 inches I would pick up regular pressure hollow point that says defense or self defense on the box.
I carry a stock Glock (iron sights, stock trigger, stock barrel etc) and use Hornady Critical Duty 135 grain which was specifically developed for the FBI. Since I live in the SF Bay Area everything will still be used against me because guns are evil but at least I can argue that I use the same weapons and use the samo ammo that local and federal law enforcement uses.

It's not our duty to save the perpetrator's lives after hitting them, but are we liable, legally, as to not interfere and let the perpetrator(s) burn(dead or alive)? If the perpetrator is dead, then could there be some potential arson or other charges for not extinguishing the fire? If the perpetrator is not dead and runs out causing a fire, would the invasive criminal be held liable, or could you be seen as legally responsible? Could it be seen as tampering with potential evidence by extinguishing embers? Will the use of Dragon's Breath get you in potential criminal, not civil, legal trouble? I only ask on my Governor's behalf...
If anything, using hollow point should help your case. It demonstrates you are more responsible and cognizant of the fact that HP has less penetration and pass-thru as opposed to FMJ. I’m sure if you used an FMJ in self defense and the bullet not only struck your intended target but an innocent bystander behind the target, the prosecutor would go after you for using FMJ.
May I submit the first consideration for ammo choice should be how effectively it will neutralize a threat. If one is so concerned with what will transpire afterwards in a courtroom...maybe that individual should just carry a big stick. ...Oh wait, what if the big stick is made of that deadly hickory instead of less lethal pine?

Absolutely. It’s been done before. Like the lawyer in the video said, the prosecutor will try to use anything he can to get a conviction. If he can use prior military service to paint you as a hardened killer, he will. If he can use a PTSD diagnosis to paint you as unstable or unsafe, he absolutely will.
I've read that for carry defense ammo, you are required to use hollow points and not ball ammo because of the over penetration that can happen from ball ammo and hitting a non target person.

I've paused the video before I hear the discussion. I don't understand how hollow point ammo can get anyone into trouble. HP rounds are safer for everyone except the attacker. They tend not to over penetrate so unintended damage isn't caused behind the target. The added damage to the attacker is irrelevant because attacker. Listening to this lawyer, I would NEVER hire him for my defense. He is espousing his reasons for taking a plea deal as opposed to fighting for your rights. Anything out of the plain Jane off the shelf, he says will hurt you in a trial. He is looking for easiest way out of a case.
I have a question, my girlfriend was convicted of felony drunk driving about 20 years ago witch we payed a lot to have expunged about 3 years ago( she now has a gun permit in Indiana) how do we deal with the 4473 question have you ever been convicted of a felony?

@2009subie That's a good question,I would think she would say no since it's expunged.Ot most likely will not show up on a background check then. I would definitely look into it though.
Take a copy of the expungement letter with you and give it to the dealer. Typically if it has been expunged it shouldn't show up in a background check, but don't just check the no box, that would be a felony in itself.

Good video with great information. We have Carry insurance, with knowledgeable attorneys. I hope that we never need them, but trouble can find you even if you are doing everything right.

Listen people. The only thing that matters is WHY you shoot - not what, where or how. There is NO statute, case law or jury instruction that refers to the type of ammo, optic, caliber or any other extraneous thing. Now, if the police/DA/Prosecutor does not like your "WHY" then of course EVERYTHING matters. Avoid questionable shoots and people will not ask questions.

I would be more concerned about Using a Gun then the Ammo inside.
I use the same ammo that our small Texas town and county sheriff's office utilize! I believe that a gun owner that reloads shouldn't be an issue at all! Our forefathers made their own ammo at all times just like most of their meetings where at the pub over a drink while armed! The anti-gun anti constitutional activists and politician's should absolutely be held accountable for their treasonous actions!
No matter what type of ammo you use , unless it is illegal like handgun armor piercing a prosecutor MAY make an issue of what type of ammo you used BUT this would come up more likely at a civil trial by the turds relatives . Just make sure you have a competent attorney that has knowledge of firearms and ballistics to counter any claims .

Good points. Why give a lawyer something easy to demonize when you can make equally effective firearm choices that seem less threatening to the general non-gun public. A simple wood stock 8 shot pump 12 gauge is every bit as effective as one with 50 feet or picatinny rails with a dozen wonder gadgets bolted onto it, but it sure doesn't look as menacing to a non-shooter. Regarding handloaded ammo for carry, I can't imagine anyone in the arrest/trial/legal process knowing enough about guns to ever figure out you were using handloads unless you tell them. Very few shooters even know about handloading, non-shooters don't even know it exists.
What you did not say is that the OVERWHELMING MAJORITY of SD cases never see a jury. Ever!!!
That is literally the biggest annoyance I have with this crap. Oh you need carry insurance blah blah. Unless you ACTUALLY did something wrong, you'll never see the inside of a courtroom. You train, you play what if scenarios in your head. At the end of the day, situational awareness, situational avoidance. You'll be fine. I've had to twice. Both times, I said what happened and went home. Evidence was clear as day.
And the vast majority of social interactions never see a need for lethal force. Whats your point?

@@DaveL9170 One should be aware of what would be presented in front of a jury if it were to go to trial. Yes, most good uses will never get to trial even in blue districts, but its the edge cases we prepare for. Just like you carry for the edge case that almost never happens either.

I don’t like the point to use what the police uses, prosecutor will say you were some kind of vigilante and were trying to take the law in your own hands. It is probably best if the box of your carry ammo says “Defense” instead of “Law Enforcement” like the HST, which is the best. +P would also be presented as extra deadly, so if prosecution is the only consideration and your barrel is longer than 3.5 inches I would pick up regular pressure hollow point that says defense or self defense on the box.
I carry a stock Glock (iron sights, stock trigger, stock barrel etc) and use Hornady Critical Duty 135 grain which was specifically developed for the FBI. Since I live in the SF Bay Area everything will still be used against me because guns are evil but at least I can argue that I use the same weapons and use the samo ammo that local and federal law enforcement uses.
Police use hollow points so there CANNOT be a problem with using them.

It's not our duty to save the perpetrator's lives after hitting them, but are we liable, legally, as to not interfere and let the perpetrator(s) burn(dead or alive)? If the perpetrator is dead, then could there be some potential arson or other charges for not extinguishing the fire? If the perpetrator is not dead and runs out causing a fire, would the invasive criminal be held liable, or could you be seen as legally responsible? Could it be seen as tampering with potential evidence by extinguishing embers? Will the use of Dragon's Breath get you in potential criminal, not civil, legal trouble? I only ask on my Governor's behalf...
If anything, using hollow point should help your case. It demonstrates you are more responsible and cognizant of the fact that HP has less penetration and pass-thru as opposed to FMJ. I’m sure if you used an FMJ in self defense and the bullet not only struck your intended target but an innocent bystander behind the target, the prosecutor would go after you for using FMJ.

Why do you people always think you know the law? Checkout the Daniel Schaffer shooting case in AZ. The officer had the phrase "Your F*cked" on his AR dust cover. All references to that were suppressed in a simple pretrial motion.

Absolutely. It’s been done before. Like the lawyer in the video said, the prosecutor will try to use anything he can to get a conviction. If he can use prior military service to paint you as a hardened killer, he will. If he can use a PTSD diagnosis to paint you as unstable or unsafe, he absolutely will.
I've read that for carry defense ammo, you are required to use hollow points and not ball ammo because of the over penetration that can happen from ball ammo and hitting a non target person.
That's the reason Police Departments use it.
Not using hollow points will get you into trouble.
Find out what the local police carry. If something goes down in another county or state that's what you stick with

If loaded to +p+...sorry must have accidentally overloaded it...I am getting older... besides this happens with commercial ammo too...must have just been the guys unlucky day to get hit with an +p+ hollowpoint right between the eyes as I attempted to draw my weapon while backing up and he was grabbing and shooting at me...what a terrible tragedy...I am so sad for him and his family...I wish he had gotten the help he needed...I going to need counseling for years to get over the trauma he and the prosecution inflicted on me.

I've paused the video before I hear the discussion. I don't understand how hollow point ammo can get anyone into trouble. HP rounds are safer for everyone except the attacker. They tend not to over penetrate so unintended damage isn't caused behind the target. The added damage to the attacker is irrelevant because attacker. So, now let's hear what the lawyer has to say about it.
