    Sometimes people wait for till the initial trial setting conference to show up that day not knowing, that an awnser must be filed before the initial trial setting conference,I think Default Judgments are morally wrong and pray on innocent people!

    I went to court twice. Be careful guys... the judge is defaulted to the attorney or creditor rep there. Yes, they'll send out a freakin contracted legal rep who will lowkey hide their job title from you unless you ask for it. I honestly researched my butt off and found that it's often a waste of time. The judge knows you likely owe and then sees documents proving it and is ready to go to the next case. Best case scenario is the creditor's rep or attorney fails to show up, then it's all dismissed.

    I'm here in Britain. This is interesting because I see some cooperated companies following this stream of procedures on stuff that isn't statute, or fraud. Here in Britain it's very different in law, but procedures doesn't necessarily mean law, but the companies can follow these procedures in attempt for recovery. However, for things such as mail order and mobile phone contracts they rule on solicited selling so it's not favourable. A judgement acts like a bad mark on a person's credit file, but in default judgement it doesn't even count. There is no point with court action unless the amounts are in the thousands, for small debts they don't get to high court and the cost in legal fees and there is no guarantee for recovery, so that's why people don't do this as they end with being out of pocket. However, I don't see how these things can garnish incomes on bascly "fraud". Its looks like "legal robbery" here the only thing in their court if they can prove a defense to an habitual offender.. such as a reputation for taking on credit and not paying. Here, depends on the sale, or contract and if they've approved anyone by soliciting means.

    I paid Solosuit to fill out the answer paid the premium package , and I received default judgement accuse court did not receive anything ! So before you pay them to do it for you think about it ! They just said sorry refunded the money and I’m with this bullshit

    They know I'm on disabled widow social security survivors benefits and I get food stamps. Theres no extra $. But I didnt show up because I didnt receive a notice to appear. Before all this I sent out sease and desist letters

    In Florida I was sued for damages during an accident. They served the secretary of state under the wrong name. I never knew this happened, now my license is suspended.

    Can you file an answer basically stating that you are disabled, no income and will simply declare bankruptcy if they pursue further legal action? Would that possibly persuade them to drop the case as a waste of time and expense

    I was never serve papers for a landlord/hair salon studio due to the fact that I moved but they served my ex-husband!!! I knew nothing about a court date now I have a default judgement against me 😢 I did contact the debtor to make payment arrangements but what can I do about not being served? Or is there anything I can do? This literally happened 3 months ago and I am truly sad 😢

    I was sued by a client of my home improvement LLC company. The client sued me personally instead of the LLC. I was in the wrong quart room and ended up being late to my court appearance by 15 minutes, the judge had already set a default judgment. Now the client has sold the debt to a debt collector and they are after me. This lawsuit should have never been filed against me personally, but rather the business. Is there anything I can do at this point?
    I am in Jefferson County, Colorado.

      It could mean either (1) that a response/answer wasn't filed to the complaint so a default was entered, or (2) a motion for summary judgment was filed and granted by the court. Under either circumstance a judgment could be entered without going to trial.

    I am on ssdi and have two judgments for old hospital bills that total about $10000 they said they would settle for 10000 is there anyway i can get a lawyer to negotiate it down ? They have no way to collect and they judgments are 7 years old and 4 years old and they wont come down at all? does this even make sense since they probably only paid about 10 cents on the dollar for this old junk debt - Im not willing to pay 10k for something they bout for about 1k thats extortion isnt it??

    What if you were arrested for failure to appear but was never properly served according to their rules of procedure. Can you sue for damages? Can you get your funds taken, returned and can the case be thrown out? This was over alleged child support arrears. Point being I was never properly served according to their rules for out of state summons, I was served by in state process which did not apply to me. They knew where I lived. I lived 1000 miles away in Texas. They didn't have jurisdiction to arrest me because due process was denied. My question is should I sue them in my state because they unlawfully had no jurisdiction to arrest me in the first place as they went across state lines to enforce a void judgement. They know nothing about the affidavit of service. Usually they have to swear under the penalty of perjury for proof of service process don't they?

    I noticed John you said you had a certain time limit to address a void judgement. This is what the Florida Supreme court had to say about that in Ramagli Reality v. Craver 121 So. 2d. 648 (1960) Florida Supreme Court and I quote. "A void judgement is a nullity, and is subject to collateral attack at any time. The passage of time cannot make valid that which has always been void".

    Ex-wife was served when we were separated prior to divorce. The court records reflect Domiciliary on both notice of original action and default judgement. The judgement is 7 years old -any chance of setting aside?

    I did not know that I even had the ability to answer a suit myself and have been watching your other videos. Apparently judgement was awarded against me on 8/12/19 by Unifund. I did not know at the time that I could dispute the suit and thought I had to retain a lawyer which I couldn't afford at the time, nor can I now. Now I was served with a Writ of Garnishment with bank as garnishee. The defendant is my wife and she is currently unemployed. Our banking account is joint but the only income we have at this time is my social security.

      Social security is protected by federal law and cannot be garnished.

      Bank will do a 2 month look back and once it sees ss deposits they are required by law to protect 2 months of social security benefits. Creditors cant touch that and banks are not going to violate federal regulations

    Great video sir. In my case I moved. They served me a year after our last contact. The plaintiff had my phone number and email address and their best friend had my phone number.
    They made no effort to contact me and apparently I was served by publication. I know you can't answer this but in general was somebody being served by publication have a good chance to get the can you speak etudes. I'm not seeking legal advice and I know you're not my lawyer this is just for entertainment.

      Thanks for the comment. In Arizona where I practice if a default judgment is entered after service by publication the courts will entertain a Motion to Vacate that is filed within 1 year of the date the judgment was entered. Even if it has been more than one year make sure that the creditor followed the rules exactly when it comes to publication. If they didn't that could be a way to get it set aside as well. Good luck!

    My paycheck is being garnished for a default judgment from 20 years ago. I never knew anything about this debt and truly do not believe it's mine. Ive been at the same job and address for the past 15 years and never received anything about this debt but all of a sudden my payroll debt told me about the garnishment 3 days before payday. I filed a MOTION TO RELIEF FROM DEBT and found out that there was a court date I wasn't told about as well. What grounds do I have to fight?

      You probably figured this out by now, since it's been 4months, but just in case you have not.... I'm dealing with a similar situation right now. Judgments become dormant after so many years, depending on your States Laws. It is 10 years in most states, but some are 7 & 20yrs. If it's that many years past when the default judgment date was awarded & they never renewed the judgment, then you can ask the judge to vacate & dismiss the garnishment & judgment.

      Depending on the rules in your state you may be able to get the judgment set aside. The burden would be on you to show that the landlord didn't tell the truth.

They paid this guy. He has the justice court judge in his pocket. They can’t afford a attorney. It’s horrible. Since New Year’s Eve day.

      Come up with an amount you can afford to pay, and then reach out to the landlord with a specific proposal. Understand that they will likely counter any offer you initial send over.

    I had a default judgment against me I live in the state of Texas the court register will not settle the debt for anything less than the agreed amount on the on the judgment and basically told me we have a judgment F off I tried calling the court the judges office that issued the judgment and the judge said that it has nothing to do with him anymore he can’t help me to make things worse the court register is purposely ignoring my phone calls just so she could rack up the late fees then after a couple of months freeze my bank account and take whatever money that’s in there what do I do I live in the state of Texas I can’t file for bankruptcy because technically on paper I make too much money for that

    What if you went down to the court to answer the summons but the court is closed becouse of covit 19 and the judge made a decision on it but we couldn't get upstairs at the court to fill out the paper work

      I would contact the clerk of the court via phone and let them know what happened. You may need to file a Motion to Vacate the Judgment if it was entered because you didn't have access to the building.

    A summons and complaint was issued to me by a debt collector company(Midland Funding LLC), and I didn't realize that I was suppose to file a written answer/response with the court and serve a copy of it to the other party. I thought I was suppose to wait for a court date and appear in court, I didn't read it thoroughly. So because of this mistake, they issued a default judgement request. But because of the fact that they bought my debt from a credit card company and shouldn't have proof that I owe them, would my best option be setting aside this default judgement using rule 60 reason 3(fraud)? I'd greatly appreciate the help

      @@alwayssmilemore9091 Lexington Law(credit repair company) just helped removed them from my credit report in 3 months and now my credit score is good. Instead of paying the $682 to the collection agency, I paid Lexington Law $150($50 each of those 3 months) to get Midland Funding LLC removed from my credit report.

      @@jwyzebeatz I thought in your original comment that you said Midland issued a default judgement. Did it not go thru after all? And how did Lexington Law remove it? I don't have a default judgement, I actually answered mine right away and filed it,etc. But now Midland lawyers are trying to get me to do a consent judgement! Which no way i will do. So they also have filed a Motion & Memorandum Summary Judgement. Not too sure what to do now :/ , thinking I have a good chance at fighting back tho.

      @@lisahotfuss5537 I'd have to refresh my memory with these court terms because it's been so long lol....But I honestly don't fully remember how it went. I just remember going to court and came to an agreement outside the court with the lawyer/collection agency representative about how much I'll be able to pay monthly...But later went home, did more research, and said fuck that, Imma think of another way out of this, especially after my cousin told me how he ignored letters from a collection agency before and nothing negative happened lol...Now, I may have paid them a little($20 maybe) and no more...But I eventually ended up getting Lexington Law involved, and to my surprise, they removed them by sending dispute letters. From my research, collections are easy to remove because you never borrowed money from them, so technically you don't owe them. A lot of people say don't respond to collection agencies of course because when you do and sign, you're basically saying you do owe them even though you don't, which I've done, but I got out of the situation still, soooo lol...But I say give Lexington Law a call and tell them your situation like I did and see what they say because they were confident that they could handle mine, which they did. Or you could look up on YT or google about sending dispute letters yourself for your current situation.

    If you live in a state that does not garnish your wages; you can tell your employer to give you a paper check and do nothing and never pay.

    have a default judgment against myself. one or mor credit/debt collections suits . i did not answer , through fear and procrastination . i started footwork , but did not follow through my negligence. i sought bankruptcy but was informed debt was under minimum amount ( 7500 ) . was informed recently of garnishment. embarrassed and ashamed . hav had current employer about four months and turning in resignation..

      Both VA disability and SSDI are Federally protected from garnishment and they can't take your money. I suggest you tell them to go pound sand.

      u are a bit confused . u are not required by law to pay debts and the only debts the law will enforce are those debts that are owed to the government or debts that a collector had to sue for and won . but if nobody sues u then u can owe debts and the law will not care whether u pay them or not .

    I filed an answer using a template, showed it to a lawyer who said it looked fine. I could not enter both my name and my wife's name so I entered my name only. I did have both our names as the defendants, only my name in another section and the court issued a judgement against my wife only. Now we are screwed and have to cough up for an erroneous debt. When a common man needs a lawyer to understand a law and to negotiate the law it is not a good law. This is utter horseshit. Our country has too many fucking byzantine laws and too many grifting lawyers . It will eventually collapse under it's own weight...I hope.
