Thank You for your feedback. The filing procedure with the Registrar under the Plant Varieties and Farmers Rights Act, 2001 is as follows:
      1. Application for Registration: The first step in the filing procedure is to submit an application for registration to the Registrar. The application should be made in the prescribed form along with the prescribed fee.
      2. Examination of Application: The Registrar examines the application to ensure that it is complete in all respects and meets the requirements of the Act.
      3. Publication of Application: If the Registrar is satisfied with the application, it is published in the Plant Varieties Journal for public scrutiny.
      4. Opposition to Application: Any person can file an opposition to the application within three months of its publication in the Plant Varieties Journal.
      5. Hearing: If an opposition is filed, the Registrar gives an opportunity to the parties concerned to be heard before deciding on the registration of the variety.
      6. Grant of Registration: If the Registrar is satisfied that the variety meets the requirements of the Act, he grants registration to the variety and issues a certificate of registration to the applicant.
      7. Renewal of Registration: The registration of a variety is valid for a period of nine years. The applicant can apply for renewal of registration six months prior to the expiry of the registration.
      8. Maintenance of Register: The Registrar maintains a register of plant varieties containing details of the registered varieties.
The filing procedure may vary depending on the specific requirements of the Act and the instructions provided by the Registrar. Therefore, it is advisable to consult with a legal professional or a registered agent to ensure compliance with the filing procedure.
