      Doctors mess up: Malpractice suit against the doctor and they stand to lose their license to practice medicine
      Drivers mess up: Insurance rate increases, liable for lawsuit, citations possible and can lose license to drive vehicle
      Police Officers mess up: The unions threaten the city/state to eat the bill for the lawsuits, the officer is protected by numerous federal and local laws, and if the department lets the officer go there is nothing to stop them from getting hired at a different location or rehired at the same location.

      Police should be required to have something similar to the malpractice insurance that medical personnel hold. Too many claims? Your rate goes up. More claims? We're no longer willing to insure you, as you're a liability. Cant get insurance, can't be a cop. Their insurance needs to be paying these lawsuits, not tax payers.

      Lawsuit payments are paid directly from the departments pension fund.

    20 years as a cop here and I can tell you that the moment they realized that he wasn’t the suspect they thought he was, their legal justification for contact ended. It’s like pulling a car over because the registered owner has a warrant. The moment you know the registered owner isn’t in the car, you end the involuntary contact. Period. Everything those cops did after realizing he wasn’t their suspect was illegal. I would be on the horn with a lawyer.

    The female Sargent nailed it when she says “it’s no big deal”. It IS a big deal! That statement sums up the attitude of law enforcement in America. They’re so used to violating our rights, they do it on autopilot. This was a fishing expedition. Plain and simple. Because once they found out he wasn’t the suspect, he should’ve been released immediately. They continued to hold him in cuffs for an additional 20 minutes. They have zero fear of accountability. “We investigated ourselves, and found no wrong doing”…….

      They aren't a narcissistic person don't care they get a rush from another person suffering or distress, they know that their presence symbolizes a authority figure so that in itself tells them they have a superior complex in their mental space so they can or could be a regularly cool person, but they need to feel better about themselves for whatever justifiable reason they conceive at that moment and with this they make contact with the first person that they could possible assert this power against, with little or no repercussions, as this person becomes agitated or uncomfortable they either respond or react, the officer now uses this encounter to fuel the narcissistic adrenaline. So my advice is they are human like myself, I understand the psychology is to build a case as their bosses demands results or it is a exposing of their personal biases, matter nothing to me. If one is a criminal and get hold then jail is a part of the choices and if one is innocent then it is just an inconvenience, life is full of that. If I'm held and cuffed for some bull.I know this that words have power so I'm going to curse their bloodline with simple powerful words not with any aggressive outburst but with knowledge of the power of the tongue that can create life or. 😉 make sure the encounter is recorded and sue pull up on did and tell them thanks for the new ride.

      there is also an issue with liability. Sometime apologizing is seen as an admission of guilt or more like liability in a civil court. So cops never say sorry for a few reasons. One. They are DBags. Two. So it isn't easier for the people they've wronged to sue. and Three. They are too stupid to realize they are wrong, thus they don't apologize because they think they aren't wrong. Either way is bad news for us.

At that point they have no reasonable suspension that he's committed a crime. If they file a suit the department will definitely settle.

    The moment they admitted that he looked nothing like the guy they had detained that should’ve constituted an unlawful detention and a crime. And that admittance should also be able to be applied under violation of rights under color of law. And I’m sorry I don’t care if you’re a cop on duty or not. The moment you break the law while in uniform and with your weapon, you should be charged with weapons related offenses as well!

      You are incorrect. If the initial stop was for the suspicion that he was a murder suspect, then the cops have the right to investigate. The fact the murder suspect had red locks would hold up in court as a reasonable stop and investigation. Police are allowed to stop a person for one reason then shift to something else if there is more suspicion upon contact.
      Unless I just missed it, why was the gun ran? How did the gun come into the situation? The only issue that may be unlawful is running the gun. The cop did not search the vehicle. The cop reached in the car and grabbed the gun.

    Looking like a suspect is one thing, but once they discovered he is NOT who they are looking for, then that's the end of it. They can't, lawfully just take a man's gun and "run" it without reasonable articulatable suspicion that he's committed a crime. They already confirmed he wasn't their guy, but now they are hoping to go ahead and make an arrest over the gun. His civil rights absolutely were violated! Not to mention the illegal search...

      You are correct in that they could not lawfully extend the detention and go on a fishing expedition, right up until he told them they could run the gun, then all bets were off. He gave them permission to do exactly what they did. Police often use the tactic of 'if you're so innocent, what are you trying to hide?' and the public knows this tactic all too well, the problem is that they don't realize it's BS. So he agreed for them to do anything they needed to do to clear his name. This is why it's so important to know your rights, and exercise them.
      Also, in the video, when the cop goes in for the gun, a message pops up that says illegal search, but again, he gave the cop permission to run the gun, the cop went in, grabbed the gun and ran it.. I think it'd be impossible to assert that it's illegal once he gave him permission

    No feeling that they accused a man of murder with little ( to no) evidence, pulled hi our of his car, cuffed him, and then kept him in custody AFTER they determined he wasn't the guy they were looking for( to punish them for daring to question the police???).
    I understand that mistakes are going to occur in law enforcement , but, were this me, I would feel so bad about it and want to make some amends towards the citizen i had inconvenienced so badly.
    Not these cops though. So much of law enforcement thinks that the public are there to do what they tell them and should thank them for what they do, even when they screw up and violate people's rights.
    they can almost never admit a mistake( except when they really screw up so badly that it looks criminal over mistake and then its a mistake).

      No your rights when pulled over don't resist if videos are attainable make sure you don't delete anything. Just remain calm. When your rights have been violated by the police 🚔 officer and there are no warrants not so much as a parking ticket and they are still detaining you now your being held against your will can you say kidnapping. These officers should be fired once it was established this gentleman was not the person being sought after by law enforcement no reason to detain him and looking for anything else . Racial profiling happens everyday in America 🇺🇸. This needs to stop innocent people could be hurt or killed. Respect a person rights no matter what color or creed or ethnic group.       If you're worried about someone falling, you sit them down. You don't keep them in an upright position. If you're worried that dehydration might cause them to collapse, you provide water. If you're worried they are going to collapse due to heat, you move them to cool and shade.
      Holding someone as they stand because you're worried they'll fall, is foolhardy at the very least.

    I absolutely applaud the way this gentleman handled the detainment, and the way his wife calmly recorded everything but was also willing to call out these cops for what they were doing. She very correctly asked why he was still in hand cuffs given that they knew he wasn't the suspect, which clearly indicates these cops were on a fishing expedition to find something to justify their actions. This is why trust of law enforcement has eroded in recent years, because of BS like this... And to be clear, if they thought in good faith he was the suspect, I get that, but ID'ing someone takes just a few minutes, and once they learned he wasn't the guy, that's it, detainment over. Get the handcuffs off and apologize for the inconvenience. They did neither, which is sickening.
