      Our last extension ended August 1st 24 and it’s now the 5th and we are wanting to just back out because it’s wrapped up in an estate and it’s gonna be a lengthy process. Do we still need to terminate the contract even tho it has expired?

    I just terminated a contract on a home in Marietta last week and am having “termination remorse.” 😕. But I do know it was the wisest thing to do because of all the issues found after inspection; which were more-so concerning because of the age of the home. Now I’m going to take a few weeks before looking at homes again in order to recollect my thoughts and re-evaluate what I want in a home. I can’t wait to find my dream home.       Yes, it is typically a hard decision. You may want to find a contractor so the next time repairs come up they can give you a better idea of how much it would cost to fix. Sometimes it is not as bad as most people think.

    Conditions on appraisal which are lender required repairs which can lead to their particular loan being denied are also another issue that could take the buyer by surprise. Especially when their lender encouraged them to consider the USDA loan route only to find out the needed repairs are too extensive for loan approval by underwriting.

    Yes... Towards end of video have contingency or statement that if offer is terminated outside of due deligence period that buyers are not liable for seller's agent/broker commission or anticipated commission

    I don’t understand why the loan officers aren’t held responsible for loosing your earnest money. They should be sure that one is qualified before going into contract. I’m very upset my agent did everything she was suppose to do and the guy is ticked off because my loan wasn’t approved and he’s refusing to give me back my money.

      If you loan did not have a finance contingency then they seller is generally entitled to the earnest money, that is part of the agreed upon damages if you default on the contract. If you terminate inside of your finance contingency then you should be able to get your earnest money back.

    When bought my first home. I keep wanting to back out. But after words it sweet deal for me. But when I sold it there were iff stuff because was land contract and all my agent it threaten to sue me. I ended selling land contract I was so scared, if will get paid sold it for 75%

    What about when because you really want to have a property, you keep trying to continue in a contract even when you know your agent is being unfair charging way more than the book price. Then it comes to a point that you start feeling unsafe with a long term contract with someone you don't feel you can trust because lies don't stop?

    I don't want to terminate contract but I do want to amend it and work with another realtor. I was told I would lose the home (new construction). It's not due to be done until November.

      That may be difficult, the builder is only obligated to pay the agent on your contract. You can ask the builder if you can switch or you can potentially pay another Realtor for representation. If you are having difficulty with your agent it might be best to reach out to their broker, you are actually under contract with the broker and not the agent(unless the agent is a broker).

    I'm under contract in Maryland. Closing date is Nov. 30th. The Seller scheduled asbestos abatement on the same day as closing and the walk through. I prefer the abatement be performed before closing. The Seller won't budge. I've given them 45 days (not 30) for moving out. The repair list is long but they'll only pay for abatement. Also, my Realtor suggested I call the abatement company with any questions. I did and the asbestos guy emailed the Seller saying..I was pushing for a earlier date. The Seller contacted my Realtor and asked that I don't contact the asbestos guy again. I never asked him that. It pissed me off icing on the cake) and now I don't want the home. Can I get out of the contract? I don't trust my Realtor. So..yeah..thanks

      You need to to check the laws in your state, but if the seller is doing everything agreed to in the contract then you will likely lose your earnest money if you terminate. If the contract states the abatement must be completed 7 days prior to closing and they are doing it day of then they would be in default. You can always pay for a consult with a local real estate attorney to see all of your options. Thank you for watching and best of luck!

    Your videos are so helpful! Daughter has a contract with a contingency that seller will specifically install a new split unit. It was written into the contract. The agent sent a photo yesterday of an installed regular heat pump. My daughter agreed to well over her original offer based on the promise of a split unit because it is a ductless system. I am guessing we can terminate?

      It really depends on what is written in the contract and if the seller is in breach of that contract. It is best practice when writing amendments for repairs to include what happens if the seller does not complete the repairs as agreed. Thank you for watching.

    Land vestments contact my brother before they paid for it they sent and nother buyer out my my Personal address that’s not even connected to that land and told the lady to come knock on our door so she can go see the land and I pacifically told them ours is not connected to that one so I terminated the contract violations on my civil rights need somebody to my private property where it says private property no trespassing .

    I am the buyer, the seller has renters in the house. It was originally a 30 day escrow, then the seller requested 45 days because the renter needed more time to get out. We agreed and signed an amendment. Now we are 30 days in and was supposed to close on May 27 and the seller is requesting more time (60 day, close on June 11). This interferes with our 45 day rate lock and would have to purchase a rate lock extension. The seller is unwilly to cover this cost, can I terminate the contract and get my ED back based on this info?

      Yes, but the seller is in default if he doesn't meet the May closing date and you can possibly sue him for damages. Check all options with your broker before you terminate, you may be able to force their hand.

    Is it more difficult to terminate the contract for resell properties vs new build properties? I’m thinking in terms of a new build being 4-6 months out of being ready to close, etc…

      Yes it is typically harder to get out of new construction and get your earnest money back, but it depends on the contract and the builder. It will say in the new construction contract the consequences of termination.

      Talk to your agent or an attorney to get legal advice on this topic, this is not legal advice. Often during a transaction the buyer may ask for amendments or repairs, etc. If you don't agree then they may willingly terminate the contract. However, if you are under contract and they are not in default in some states they may be able to sue you for specific performance and ask a judge to make you sell the house.     I really hope you see this comment so we did the inspection we did the appraisal but the problem is we’re not getting financed for another home is there a way we can back out of this contract even though we’re supposed to close in like two days and then we will be on the streets I don’t really know what to do in this case

      If you have a finance contingency in place you should be able to get out of the contract. Verify with your agent.

    Do you guys charge a buyer a fee if they default on a contract?
    For any reason that makes them the party to be at default... do you as a realtor charge something for your time and effort?
    or
    you have a representation agreement and they just choose to stop looking for homes weeks into it but by then you already spend time and travel expenses on visiting 20 some properties?
    just need some friendly advice.

      Some agents charge admin fees upfront to cover some costs. Also, your broker can charge the buyer the commission that they earned if they terminate on the contract. However, the broker would have to sue for the commission so it doesn't happen oftern.

    I could really use your help. My dad's house has been a disaster since he died 2020 November. Now I've almost got this place pAyed for and the guy will not file the contract with the court for 7 years now. He's changed the address into apts for sale, ahistoric barn. And the side yard which has been split in 2 for sale separately.

    What happens if on top of the earners fee you had put in 10% of the downpayment and will pay the remaining 10% during closing ? Are you able to receive back the 10% down you had put in? The house doesn’t have a closing date yet since it’s a new construction home.

    What happens if the appraiser comes back with safety repairs that must be done before the loan can close and neither party are willing to pay for the repairs? Also, will the appraiser go ahead and give an appraisal amount in that situation? Does the required repairs count as the loan not being approved even if the appraisal amount comes in at or above contract price but with safety contingencies per the appraisers recommendation?

      If this is FHA, they will not finalize the appraisal until the repairs are complete. Review your contract and see what is in your FHA contingency there is usually a line in there for FHA required repairs. Are the repair costs significant? If they are not I would try to neotiate with the seller, maybe put in price of the house if they will not budge on repairs. Check with your agent for all of your options.

      @@ShaheedahHill it was USDA- Guaranteed. The “President” over the mortgage division even encouraged going USDA guaranteed after going out and walking the property himself because the bank wasn’t far from the house. Now saying the USDA loan is denied in underwriting related to property conditions from the appraisal after stringing along this loan path for over a month! Not sure if it was automatic or manual in house underwriting. Approx a week after the appraisal was done called to see what was going on, he said the appraisal was with the underwriter last Friday so believe it must have been manual in house but still not certain. Found this news our yesterday (Monday.) In the email it said “appraisal to be complete subject to 1)..2).. 3)..items but only in reference to a conventional loan. They aren’t being clear on what exactly needed repaired for USDA Guranteed and seem to be trashing that option for good all together and according to the Mr. President who said to go USDA from the beginning.

      Probably not, if you are buying an investment property ask for the disclosures of leases and payments ahead of time. Discuss with your Realtor and review your contract with an attorney.

      Consult with your agent, you can but it may not be the best choice. There are many other options, for example, you could take the amount of the roof repair out of their proceeds at closing. Work with you agent to see all of your options, because it sounds like they are in default but in don't know the details of your contract.

      Depends on what is in the contract, is there a due diligence period? If so you may be able to get out during that time, but refer to your broker. Just because the earnest money is not deposited yet does not mean the seller is not entitled to it.

      If you already closed you are no longer under contract. You should contact your Realtor or Real Estate Attorney if you are having problems after closing.

    What happens if the seller void the contract because our lender doesn't close on the closing date. Will I loose my ernest money deposit to the seller on FHA loan?

      They could because you would be in default. However most sellers will grant you an extension to your closing date, so your agent should request an amendment. Also in Georgia we have an 8 day unilateral extension. That will give either party 8 additional days and the other side does not have to agree. Ask your agent if you have that option.

      She will likely have to start the eviction process with her tenants for the sale to go through. Have her contact an attorney, her agent can recommend on to get this process started.

      Usually not because the inspection contingency will generally expire before your appraisal is complete. But it is whatever is in your contract, so check with your Realtor if that is something that you are considering.

      You need to get a lawyer, why was the home left off the contract, did you just buy land? The answer is maybe to if you can sue, it depends on what the contract states. Consult an attorney.

    Hi, I signed on a house and it’s been 3/4 days. I haven’t done a home inspection and I’m having second thoughts on the house because I felt rushed to buy. Also I toured the house, there were cosmetic cracks in the ceiling and my agent said that they can only ask for structural repair and not so much cosmetic.
    Can’t I cancel my agreement?

      *Disclaimer - I am not an attorney" It depends on what your contract says, you can usually terminate before closing, but based on what your contract says - you can see if there will be any financial penalties that you may face. Speak with your Realtor and go over your contract.

      Possibly, if your lender will give you a loan denial letter becuase you need that money to qualify for the loan. You may be able to use your finance contingency.

      In most states sellers can keep your earnest money as damages and not sue you, but it depends on your state and what your contract says. You should ask your agent to see what your penalties are for termination. Thank you for watching.

    hi i have question about house that am going to buy, after tour me and my agent My agent email me contract to sing before 6-pm Sunday and i don't want sign without Attorney, because price we agree is different, example value property is 200-k but contract I need to Sign shows 180-k i try to contact my agent and he said we need to sign this Offer before Monday, if i sign without attorney Can i terminate when my attorney review and say this contract you sign is not good, Am first time home Buyer and i didn't know a lot about this business, thanks for you're information

      It depends. Ask your agent if you can terminate after the contract is accepted, if so when. Bottom line is don't sign anything you are not comfortable with or you don't understand.

    What happens if the appraisal isn't done until after the agreed closing period? We were supposed to close on a house on Oct 26 but didn't get the appraisal until Oct 31st.

      If you are doing a government loan there is typically no date on the appraisal contingency, you just have to have it before closing.

    I need solid good advice. The seller accepted our offer on a home but with contingencies that the septic passed. It did not pass and our contract was over on 2.6.2024 without any extensions or updates to the contract. In the meantime...the seller passed away and my earnest money is being held by a title company as seller did not have a will and the seller is not available to sign the release of earnest money form. Is there anything I can do to be proactive? A form to fill and submit to the courts? Anything to present to the seller's realtor/agent giving like a 72 hour deadline? Or something of that nature? I should not be expected to wait for months to get this money back as we have moved on and are purchasing another home.

      Your agent should have access to attorneys that can answer general questions for them for no charge, since state laws vary, this is a question for a lawyer in your state. If your agent does not have access to a lawyer then contact legal aid, depending on amount of money being held you may want to do a one hour consult and let them tell you specifically what to do.       Side note, if you still want the house the heirs may want to still sell it and you can make them give you the money to fix the septic.

      If you are still in due diligence you should be able to terminate if not you may be at risk of losing your EMD. Review your contract with your agent.

    An inspection shows some damaged roof, leak in the basement and a failed random test.
    Can I use these as reasons to withdraw from a contract that has already been signed?

      **This is Not Legal Advice** If you have a due diligence period in your contract then the repairs could have been negotiated during that time period and potential cancellation based on what your contract states. Your agent should be advising you during this process of negotiating repairs. if your agent s is not helpful, go to their broker, if the broker is not helpful, go to a lawyer.       ​@ShaheedahHill This just happened to me last week. Inspection came back with a lot of repairs that needed to be fixed, or it wouldn't pass for the loan. My agent asked me for permission to share tge inspection report to the sellers. I gave it. But then I had issues with the listing agent according to my agent at the time. Telling me that I knew what I put an offer on. We were trying to negotiate with the sellers about the repairs and price. They supposedly refused and both agents were uncooperative. My agent kept telling me to terminate the contract and just look for another better home. She never told me we were able to extend the inspection option period to give the sellers time to fix the issues. I lost my option money and the money I paid for the inspector. When I found out we could've extended the time and she didn't tell me I terminated the buyers agent contract and she got mad was refusing to sign the form.

That agent and the listing agent were communicating back and forth by email and text about the offer I made for the home with the agent I terminated the contract with. She sent me screen shots and told me the listing agent sent that information to her via email. And she terminated the contract with me because she got mad that I didn't want her as my lender and Realtor. She stated that on the text message she sent me telling me she was terminating the contract.

    I have a question, we are under contract for new home construction. The rental policy in the community is changing and we were provided no information at the time of signing the contract. So we decided we are not moving forward. We have given $5k earnest deposit and are due $30k towards our payment as deposit ($35). In the contract it says, if we default, they will retain the deposit. But since we haven't paid the additional $30k, can they come after that?? What should we do to make sure they don't come after us. They will probably take our $5k.

      I am not an attorney but in this case I do suggest that you get one. It will be worth it considering the amount of money at stake. Since they don't have the 30K, yet they would likely have to sue you for it and most large builders wouldn't bother with a lawsuit. Since there was a change in the community you may be able to get all of you money back. Go to a lawyer ASAP. Have your Realtor suggest one that they have used in the past.

      @@ShaheedahHill thank you for the reply. My builder is ryan homes in ohio. Any stats if they do it or no. The contract is pretty one sided so no luck to get out. It says if you default, they will retain the deposit. Alternatively, pursue legal options to cover for damages. My last hope is misrepresentation which clearly occured in this case and have proof that they lied not just once but on multiple occasions.

I have paid $10k as a deposit. Will I only lose that $10k or i might face law suit from Seller. Please help me. Accordingly I will take a decision to cancel the contract within 7 days.       It depends on your contract and what is in your finance contingency. Verify that with your real estate agent.
