i literally cant do feild sobriety tests because i have fucked hips meaning one sites much higher than thw other which creates balance issues plus orpn deficiency, plus sensory problems so minor things like a wind change or too bright of lights can mess up my ability to balance or give me a migrane. i pray i never have something like this happen to me
There's literally no benefit to it....I did it because I wasn't told it was voluntary....cops won't tell you that...I have lupus and my bac was under the legal limit..the cop never asked about any medical conditions before he started and I told him by the 2nd test that I had one...my affidavit doesn't even mention slurred speech or smelling alcohol or being unbalanced...it just says red eyes and I failed those tests ....1 in 3 sober healthy people fail those tests...I'm fighting this ..don't ever take them
I got pulled over (quite) a few years back, cop thought I was drunk, gave me this line, I fell for it. I did the tests, and passed, he let me drive on. I WAS JAMMED OUTTA MY HEAD ON HEROIN. They really are subjective. Edit: clean now since 2012, but just sayin. I don’t condone this behavior, someone could’ve died/gotten hurt.

@@theofficialgreenkane No, this is what happen in certain state if you refuse (verbally, not saying anything after asserting your 5th amendment right cannot be considered as refusal) to blow in the portable breathalyzer, you're absolutely not required to do (in any state) the field sobriety test, it is highly subjective and doing so can mean self incrimination.
It forces them to "fish or cut bait". If they have enough evidence to arrest you, they might arrest you. If they have enough evidence for a preliminary breath test, they're going to bring out a breathalyzer, which depending on your state, you also may be able to refuse (roadside) without consequence. After refusing the PBT, now they definitely have to either decide they have the evidence for an arrest or cut you loose. Bottom line, trying to "make it easy", as the cops like to say, is more likely to make it easy for them than for you, best case you refuse and they let you go, worst case, you spend the night in jail like you would have if you'd given them a bunch of help. With all the substances out there that don't have a legal threshold to be measured like alcohol, but can give you a DUI anyway, I wouldn't chance FSTs giving them the evidence to prove that you were impaired on some drug you doctor gave you or that you chose to take.

If the cop abuse his authority and arrests you anyway (very rare scenario), you can began a lawsuit and you'll be 90% sure to win it.
There's a good chance they will if you don't. There's a good chance they will if you do. One of those choices doesn't involve self-snitching and is going to make your lawyer happy. The other one will make the cops happy and get you a lighter punishment for being cooperative after you've provided all the evidence they need of your guilt.

Subjective or not, refusing a field sobriety test will always result in being detained until a bodily fluid test is conducted. So, sure. You can refuse any LEO legal order while briefly detained. Just expect that briefly to turn into extended.
I mean I’d rather force them to give me an absolute test than fail a field sobriety test. If you do one and fail, even if the tests come back later that you were sober it looks worse than if you refuse and only take the breath test or blood work. Yeah it’s more inconvenient in the moment but better for yourself in the long term. And no matter how sober you are they will fail you. I’ve run through the test for fun and I can do it but not without mistakes and stumbling. Especially the one leg test. They will use every lean and stumble as evidence against you. It doesn’t matter that most people would do the same, all that matters is how they can portray it. With the legal system truth is inconsequential. All that matters is perception and the portrayal of facts, not the facts themselves. My area used to have people say the alphabet backwards without saying it forwards in your head first and I can’t do that but they don’t do that anymore.

If I am innocent clean and sober they can do any field sobriety tests on me and I would volunteer to give a breath and blood test. If you have been drinking that is another story. They can’t falsify a breath or blood test.
I am 80 years old. I am still a good driver and have never had any tickets, except when I was 18. It is probably impossible for me to pass any of the field sobriety tests, even though I am always stone sober and never drink and drive. I will blow ZERO and still fail. Sanjosemike (no longer in CA)
