Currently- I purchased the audio copy of " The New Apartied." I am looking forward in digesting and critiquing the informstion you disseminate. Congratulations on the publication of your book.
Any law that is not consistent with the Constitution will be and is regarded as null. Even within private law... I differ utterly. After I read your book IL do a review based on my knowledge regarding law.
You also need to keep the interpretation of statues in mind. I personally don't think that's it's vague. Hence the context should be interpreted into right content.
you honestly have no idea what you're talking about - the constitution is there to uphold the rule of law, rather ironic since OUR RULING PARTY thinks they are ABOVE the rule of law - WE SHOULD BLAME THEM not the Constitution / it's because of bad governance that we are literally the most unequal society in the world | people in power should start to understand that there is a doctrine like separation of powers...
By the way you make declaration about South Africa"s constitution and the new apartheid is between punishment and discipline to practice justice is what you notice along the way since 1994 up and till now as long as we can practice justice then is find
I differ with you. Contracts which are contra bono mores are contracts which are against public policy and certainly parties who contract in such contracts would not desire the law to intervene because they acknowledge that the contracts are illegal. I don't know if I differ completely with you because of the knowledge I have regarding the law as well as the Constitution it'self but I guess I am purely fixed.
One quick question though are you permitted to write anything that contradicts our Constitution? As you said what you write will not be acceptable if I can put within the legal academic.
Separation in South Africa is needed by people of all races, black South Africans don't want to be ruled by corrupt people like Malema, Zuma, Mngxithama, Mpofu etc, note that areas like Zululand, Bophutatswana, Venda etc want separation.
After all the analysis I've read and seen, I think the 'framing of justice as charity' is perhaps the most poignant insight I've yet come across. Think tanks fund themselves off it, the government has prided itself, hosting conventions and conferences on it where "the language of humanity" is endlessly trudged upon (and I've been to my fair share of these as well in my student days).
SMWX it is submitted that the Constitution does transform the law. It is a rights based approach. To prescribe a legal system will result in a totalitarian state, benefitting MK & EFF people. It won't ameliorate poverty and lack of rights. It won't provide education, housing, water and sewerage for the people. Dignity, equality and freedom are important. It is not necessary to repeat the injustice of the past. Apartheid is recorded. The failure to perform better in the past 30 years, is a failure of the Executive and civil service, not the Constitution.
My mouth is watering for more information....KEEP SPREADING THE FIRE..I have learned a lot from this channel .

The constitution is supposed to be a living document. We can make it work for the marginalised. Having a constitution is better than not.
Indeed and living documents can be critiqued so that that can live better in the future?
@@_SMWX I truly revere the work you are doing to expose its inadequacies. I’ve always been taught our constitution is perfect and sacred.

Very relevant.....given the events surrounding President Zuma it's.not merely academic.....
thanks

That’s OK. Disagreement is allowed around here. 🙂

Free speech is actually a thing in South Africa you know. Loads of academics have written on this.
Separation in South Africa is needed by people of all races, black South Africans don't want to be ruled by corrupt people like Malema, Zuma, Mngxithama, Mpofu etc, note that areas like Zululand, Bophutatswana, Venda etc want separation.
Love your work, but can we please work on getting to the point 🙏 Thank you 😊

We cannot use law as corrupt politicians like Malema, Zuma, Mngxithama, Xivambu etc dont use the law, they circumvent the law
