      A group has already done it in the last few days: they lodged a legitimate complaint against the police under that legislation and the complaint stuck. I think that was a good standard to set going forward.

      For instance, under this law in Scotland, a comedian who makes a joke about Islam (ie. Billy Connolly's classic joke "I'm only gonna tell you this once") can be arrested on stage for simply making a JOKE about religion because it offends a member of the crowd, or even offends someone watching it on the television or a dvd, or on TH-cam.
      You can't even make a joke in your OWN HOME about islam and be protected from prosecution, if someone in or outside your house claims you have offended them, they can have you arrested and it would be enough for the police to get a warrant to enter your house, search everything in it and arrest you.

      @@ass640 oh no... thats not a good law. I think people should have a right to mock or criticize anything... that is very important. You cant give the government the power to police normal speach. If we do that we are not far off from tyranny. I do think there should be laws against inciting violence against people of a specific group. Whatever group it may be. But I dont think we should have laws against "blasphemous" speech. And I think the law needs to be careful about ensuring that there is proof that someone was inciting violence and not just saying offensive things. For example... we cant have people opening up class rooms teaching racist hateful idealogy. And just say call that free speech.. if they are teaching children to believe that all people of a certain group are evil and should be exterminated for example. That should not be legal. I also think peadophilic speach should be illegal. But other than that I think its ridiculous to arrest someone because they said something offensive.

      It's almost like JK is super rich so they do not dare to touch her because she could bring them world of pain.
      It's always easy to say "you should sue them" to regular person because fighting in courts take both time and plenty of money and many times there is no guarantee that you will win, even in cases that looked good for you. Especially when going against what is practically a government. Rowling has no problem with money aspect and due her work I think even the time is easier to handle and everything that happens got millions of eyes on it which means it harder to brush things under the rug.

But I ABSOLUTELY deplore and reject the proposition that I should be forced to privilege their reality over my own, and more than that, to actually subordinate my reality to theirs. To be prosecuted of misgendering someone, first there needs to be proof the person is the gender they claim to identify as. For this there needs to be a definition of the differences between genders, ie what makes a woman a woman and a man a man. If you can not say categorically what a woman is then how can you categorically claim to be one?

However, it's self-evident that individuals seeking cultural acknowledgment for gender identities that extend beyond biological definitions do exist. In fact, I'm acquainted with a few young people who are grappling with these matters. They are earnest in their identities, their quest for acceptance, and their aspiration to evade bullying, violence, or hatred.       It was clarified that a non-crime hate incident has NOT been recorded. As far as the police are concerned JK Rowling has said nothing that contravenes the new law. It is unfortunate that now the police, a force already underfunded and over-stretched, is now responsible for calling the shots and a faulty law concocted by a group of woke politicos.

    This law is a complete mess. It's a contradiction to the right of free speech, as well as being rather vague. Poor police force having to try and enforce this.
    Don't get me wrong, I very much support trans rights, but you have got to allow people to have unpopular opinions. Censorship is not a way to resolve an issue; it will only lead to more animosity.

    ……. I have read the law, the published commentary and all surrounding notes. Rowling could WELL have been arrested - as could anyone preaching from the Bible AND the Koran.
    Hamza’s Law is ACTUALLY a new Blasphemy Law which gives privileges to those set out in the “protected categories”. The OLD Blasphemy law was repealed as a consequence of Hamza’s Law.

      @@danieloliver9930 the Soviets did the same in the late 1920s. They instituted a sort of secular Blasphemy Law protecting Soviet Communism. Hence the awful propaganda campaign of “Pavlik Morosov”. Humza’s Law is just a transcription of that into Scots Law.

    Kevin Maguire's being a little cute with his details there. It's true that the SNP said misgendering wouldn't be a crime. Siobhian Brown said it.
    But later she said that it would be investigated and would be up to police whether to record it as a "non-crime hate incident", which is a hideous construct and negatively impacts someone even if they don't break the law. So despite JK Rowling's stand against it, it's still not clear where the line is here for criminality or for those pernicious "non-crime punishable offences".
    We can only hope the SNP are kicked out asap and replaced with someone who will remove these vile laws.

      Im pretty sure a non hate incident is only there so if a crime is committed against that group later they already have a record of their hate and it helps to build a case where hate is a motivating factor. Alone it means nothing

      @@ellewilliams5162 Alone it means a great deal You can stay fully within the law, but if I or anyone else 'percieve' that you're motivated by hate, you can end up with one of these which stays on your record, which could lead to the police turning up at your doorstep to check your thinking. Remember, that this is despite you remaining fully legal.
      There's no way for you to defend yourself against the accusation of feeling negative emotion, and no evidence needs to be presented, merely someone else saying they think that's what you felt, and really, what evidence could be presented?
      Then there's that little fact that it potentially could be disclosed to a prospective employer, and negatively impact your chances of employment, again despite you having done nothiong illegal whatsoever.
      However they were allegedly inteded to be used originally, the actuality is that they're frankly Orwellian.

    But have recorded it as a non crime hate incident as the offended persons word that it is hate speech is all that’s needed as no evidence or proof is required to record a hate incident. It would also be enlightening to find out if the first minister has non crime hate incidents recorded against him from all the reported hate incidents against him.
