    Hi Sir,
    A person who has been convicted for drinking at public place outside Canada and got relased by the court through submitting fine.
    Can that person apply for Canadian PR application normally if not then what is the process in that case.

    Hi Parsia Hi i was denied Canadawork permit in 2015 in dubai because a travel agent used a fortified offer letter unknown to me. When i was going through my refusal letter there was tick in a box both misrepresentation and inadmisable type of person, now it over 5years am married now and have kids my wife is the principal applicant on an express express entry aplication am i free to go with my wife how can i check this if am free from the misrepresentation n inadmisable.. I think act 40 is that category

    Been declared inadmissible to USA for 5 years due to misrepresentation (instead of saying self employed, I said I was working with my former employer as I had a freelancing assignment) and worked part time on my tourist visa during weekends. I know it’s my fault but so can I process/apply for CANADIAN PR through an attorney?

      Of course, we cannot offer immigration advice publicly. However, generally speaking, criminal inadmissibility occurs for in-Canada criminal convictions not charges. For outside Canada both conviction and charges could result in inadmissibility.

    Hi,
    Iam an Intenational PhD student in canada. I have been charged with assault and uttering threatening to my roomate. The charge is resolved by absolute discharge. My question is regarding my study permit extension in future and work permit, will I be able to go with my immigration process without a problem if I declare every thing when filling the forums?

    Hello, My name is Ajay. I want to apply for Canada student visa. But i am perplexed as my eyesight is too weak. My eyesight is -21(right) and -20(left). I am afraid i will not able to pass my medical as i am not able to read from far distance and i have heard that in medical they do you eyesight test.     Hi just wanted to ask if subsection16(1) and 40(1) are both same? If not, what is the difference between those ? One of my friend received a PFL where visa officer mentioned both sections but for 16(1) officer did not mention the reason whereas for 40(1) the officer clearly mentioned the reason. Can someone share their view on this?

      They are not the same. In layperson teems you could say 16 is the precursor for 40.

      @@aparsai Oh great info. I assume that is why the visa officer in the request letter did not specify the reason for 16(1) rather he just mentioned what 16(1) says in the act.However in the request letter ,he specifically mentioned the reason for 40(1). Reason is “lmia is expired”.

    Can someone help me I got rejected canada visitor visa under section 40(1a) back in 2017 and in my letter doesnot say anything for not entering canada for 2 or 5 years I was asked to reapply if I want to but My rejection comes under misrepresentation.Am I banned for 5 years to enter into canada or it's a general refusal in misrep?

    My husband got student visa approval but he withdrew right after that because he got job offer from Canada company. He made webform to withdraw his application and then got email from IRCC that they noted my wish on the file. A few days later, we inform canada bank to refund my money but then he got procedural fairness letter saying that he may be inadmissible for misrepresentatio because my fund in my GIC account has been withdrawn. Could you please advise us for this case. Thanks so much in advance.

      @@naazali9663 I sent reconsideration request through webform. I don’t know what happened to your case but my case, we sent explanation letter together with evidences to prove for what we mentioned in the letter. We made a table of content to help officer easily go through our documents. We defined the questions and a timeline and answered them in logical manner to persuade the officer, we really put a lot of effort to write the explanation letter to make sure everything is in order. We also admit the mistakes and express our apology to the officer.
      Here are some questions we made by ourself and answered them in the letter.
      􏰀 Why I withdrew funds from my GIC account
      􏰀 Why I had no intentions to engage in misrepresentation in submitting my application
      􏰀 Why I no longer wanted to study in Canada
      􏰀 A timeline showing what I have done since the date I submitted my student visa application and the corresponding
      supporting documents
      I hope my info can be useful for your case as I knew how painful it was to receive the ban. And my info is based on my case, my experience so please consider my info carefully before applying to your case. Good luck to you.
