ISacQB a knife would not be proportional to a poke, but if you felt your life was threatened a knife could be used to protect yourself. In the case of a poke, push or shove, you would be legally ok to defend yourself with your hands, you also have the right to protect against a reasonably perceived threat of violence which there definitely was. If he had continued to punch after the first hit then that could be considered a crime, but a single punch to someone assaulting you is a legal way to defend yourself against violence.

In the State Of Texas assault on a Medic/Fire/Security is the same as an officer. Also we have a law called "Mutual Combat" so if both parties refuse to file charges we let them go "as long as it's not family or a spouse or girlfriend" because that would be family violence.
I would of charged the guy with Assault by contact Class C since it's not a big deal no injuries and I would leave the medic unarrested and let the Investigator figure it out the next day.
In Florida poking an EMT is considered felony Battery on a LEO, and the EMT would be allow to use force one step above the poke to bring the guy into compliance. Don't know about California though. And I am speaking as a retired LEO. And yes the poke was assault. But based on my lack of knowledge of the DOJ Penal Code, I would say you made the right call, let the courts figure it out.
The AI in the LS river is scripted usually around 12am / Midnight 2 racers will spawn south from there and race up the LS river to that location where the AI was smoking. I believe the rims / customisation must be due to DOJ mods. But the script is definitely there :) Just a heads up.
How was that confusing ? That was a simple case . The guy got out of his car to go up to the official.. and the official stated (do not touch me ) and that's exactly what the guy in the car did after Being warned and the official acted in self defense .
I think irl they would've either charged both or non at all because he claims the medic was harassing him with the text message but instead of calling the police he showed up at his work place which instigated the assault as well.

But not punching him. You can't escalate it like that. You have to fallow rules of Use of Force. Punching is not allowed for just a poke. Good job handling that situation.
Disciplinary action would have to be taken by the EMS no matter what. Pretty much the only way to escalate this from a poke to a punch would be if he'd poked, the EMS pushed him back to get space, then the other guy took a swing or tried to push back far harder. With that the EMS guy would probably be able to get away without being arrested but would temporarily pulled off duty until the fire chief figured out what to do with him. The knock out you could probably argue was not intended so could be ignored. Would be an internal affair from then on. With how the situation currently would be I would have handled it exactly like this. Everyone gets arrested for assault, Mr. Coply I would charge fully since he did intimidate and touch a public employee who was on duty.

Regardless if the dude was a paramedic or not, he did not initiate the altercation and he did give a verbal warning that the other dude totally disregarded and poked him which is assault if asked not to be touched. The paramedic did act in self defense under law! Yeah sure he could’ve made a better decision and walk away or be more professional but that still does not mean he broke any laws when he was provoked first!

That being said if the Paramedic hand't of punched him the guy should have been charged at minimum. Both parties are guilty of assault at that point.

Here's the issue I have with arresting the paramedic. The whole issue started when Zac didn't like what the paramedic did on the road then hunted down the paramedic so this is actually a road rage incident. Then there is the CCTV footage showed that Zac poked the paramedic left spun his tires came back and poked him again. With him leaving the situation then coming back is where it changes it from being unreasonable to punch someone for a poke to reasonable. The added fact that this started as road rage should have kept the paramedic from being arrested. But as you said you aren't the court so great job.
The paramedic guy should not have been arrested at all... he was on the grounds of the fire house. As a officer, if I poked you I am sure you would arrest me for assault on an officer, if not getting tazed....
But on the flip side you go up and poke a cop then you could get punched or charged with assault on a peace officer. Also the paramedic is considered a public servant so the should also been charged with assault on public servant. and until the guy has filed charges the paramedic shouldn’t be arrested cause the time and place he was the victim. Cause he was provoked by being poked plus the guy came to the paramedic job and put his hands on the paramedic so it would be assault on a public servant

But you are right both should go in reguardless of who started the EMS should've just press his panic button and called out on the radio for police assistance
