Unless you have broken a law and they can show intent you don't need to ID. Driving into a check point only gives them the right to conduct a investigation.

All I was saying was that auditors doing these videos often plan to have at least one person give ID as a "Just in case something goes wrong" measure. Just in case they wrongfully arrest the auditors, someone can take the car home and bail them out.
      I wouldn't answer the questions and no one is obligated to ever answer any questions. But when these people do lots of these interactions for making lots of videos, sometimes they always plan to have someone drive away to take care of things and voluntarily ID.
      Sorry for being rude earlier. I'm just sure he told her to ID just in case. I could be wrong though...

    Passenger said she was a citizen, and they still wanted her ID. I guess that puts an end to the "all you had to do is state your citizenship" argument that the border patrol likes to pass along.

      @@cristianopaluzzopiccin4109 The first problem is that my ID doesn't have my citizenship info, as we americans don't walk/drive around with passports on us. It's only when we are leaving or coming into the country that we may need a passport. The second problem is that our amendments to our constitution(the fourth amendment to be precise) allow us to walk/drive anywhere within our borders without having to produce papers/ID. The Supreme Court decided that a gray area exists within a 100 miles of the border where an agent can stop us briefly to ask if we are a citizen, however because they didn't want to legislate against the constitution, they don't require people to answer the question(it is implied but not required). In this case the person actually answered the question so the 'mere suspicion' is settled and the person should have been free to go.

      @@cristianopaluzzopiccin4109 To verify who you are and if you are a US citizen. They can pull up your background and verify all of that. Also, the forth amendment protects you from searches and seizures. They weren't searching them. They were only asking if they're an US citizen. A simple "yes" can turn this stop into 3 seconds. I'm a truck driver, and I normally tell them what I have in the back. Since sometimes they ask. I don't be a dick and don't say anything.

    Personally I think a better approach is to engage just enough to explain that you don't answer questions and that if you're not being detained you would like to be on your way.
    The silent treatment works too but I don't see the need to be difficult. You are within your rights, so state them and stand on them

      1st, this isn't a traffic stop, so the difference between driver and passenger is moot.
      2nd, these Federal Agents don't enforce Arizona traffic laws.
      3rd, U.S. Border Patrol Agents explicitly refuse to accept driver's licenses and Arizona IDs as an indication of a person's Right to Remain in the Country.
      4th, the Agent is probably cross checking the vehicle's plate, serial number & passenger's id to increase his confidence in the driver's citizenship status.
      5th, the passenger is free to do as she pleases; don't be such a NAZI Wannabe. She can give up her id when she wants.

      It generally heightens interaction with an initial compliance feign and shift. We've got to mix it up to illicit varied responses.
      The ID thing was hilarious after spending 1/2 hour listening to an Agent argue why they don't accept Arizona Driver's Licenses as and indication of a person's Right to remain in the Country on our way to check into a first monthly Immigration meeting in Phoenix that this Yuma Checkpoint Stop nearly made us late for.
      That happens after ICE holds a person in a windowless cell for 2 years longer than the U.S. Supreme Court allows -- what are they, law enforcement or law breakers?
      Law Breakers riding High Horses.

      One reason they ask is it separates people into one of 3 piles. Immigrants that enter the Country legally often agree to present proof of their Right to remain in the U.S. when asked by official Federal Agents.
      By lying it simplifies the Agents decision making process on whether they believe the liar and the conditions surrounding them. It reveals their accent and also puts them in the position of committing a Felony for lying during an interrogation.

    I'm a black man and they rarely stop me they just wave me through. If they do stop they will ask to see inside my truck. When you go through the check points they have the NPR which automatically runs your plate and they have your details. They also have a thing that detects heat (not sure what it's called).
    Your brave as hell. As a black man if I reach in the car I'd be afraid of getting shot.

      I heard a U.S. Supreme Court Justice mention U.S. Border Patrol were checking people at a Toll Booth in Oklahoma.
      If people don't want to answer, they don't have to answer anywhere in the Country.

    What's the point of this video? You do not want to comply with the laws that are put in place to protect you? I have crossed into Mexico and I did not have to show a passport. Coming back into the U.S. I was asked to show my passport. They did not ask if I was a citizen. What is wrong with showing your passport?

      This is an Inland Immigration stop on the I-8 Freeway. We're not crossing from Mexico to the U.S.
      A couple laws put in place to protect people in the U.S. are the 4th & 5th Amendment.
      One point of this video is discovering what it feels like at this Inland Stop knowing the moment a Polish Refugee opens his mouth that his accent will give him away.
      The Agent didn't ask for a passport and most citizens don't have or carry one.

      By letting the CBP place a Stop sign on the road and a Spike Strip under the vehicle's tire?
      There's a Secondary Inspection Area most Agents will direct vehicles to in cases of these extended interrogations to prevent such an occurrence.

    I just don't understand why people would give border patrol such a hard time why they're protecting our country don't you have something better to do... It's cool to know our rights but to abuse him is another thing you can make their job a little easier just by talking

      That didn't look difficult for the Agent, though most would direct the car to the Secondary Area so they didn't hold up traffic.
      Others at this Stop might spend 30 minutes arguing with a Polish Refuge from 1983 on how they don't accept valid Arizona Drivers Licenses or Social Security Cards as proof of their Right to remain in the Country after holding them in detention 2 years longer than the law allows.
      Still others might simply lie, claiming the Motorist refused to go to the Secondary Inspection Area, then break in while it was there and conduct a Weapons Search which indicated the guy was a Domestic Terrorist, and sabotaged his ability to work for money for the rest of his life.
      Better to do? No.

      Hey, I have a quick question. I got a ticket for recording at the border. I have the right to film myself don’t I? I’ve been hurt before by them and since I record every time I cross. One morning the cop stopped me and took it from me and put me in handcuffs and wrote me 2 tickets. I’m allowed to record for my safety right?

    Police need information. If people exercise their right to remain silent, the information pipeline slowly grinds to a halt. If juries start doubting the word of police, convictions are thwarted by hung juries and subsequent mistrials. At some point, prosecutors, judges, lawmakers and police administrators are going to start asking “Why is this happening?” Remember, it takes only one juror out of 12 to “hang” a jury verdict. Yes, the State may retry the case, but at great expense and always the possibility of another hung jury. These cops need to learn that the same population of citizens which they like to kill, brutalize, terrorize, threaten, harass, intimidate, control, and whose pets they like to kill, is the population of citizens from which jurors are chosen. I am hearing more and more from decent, law abiding people that they don’t like the attitude of our current crop of police officers. This gets reflected in how people interact with police. I am also hearing more and more from officers I know that people seem mistrustful of and uncommunicative with them. Here in Maine, police chiefs are complaining that recruiting is becoming more difficult. It is working, slow, but sure.

The judges were very thorough concerning jury's responsibilities, rights, etc. What I found amusing is when overhearing folks, similar to you, wanting to get out of jury duty using lame excuses.
      If you want the system to work, you have to do your part. Otherwise you're obviously not interested in a working democracy.

      This is an Inland Immigration Checkpoint that U.S. Border Patrol began using back in the 1940's. In 1976 the U.S. Supreme Court approved the practice of using these warantless stops of motorized traffic without suspicion within 100 miles of it's International Borders.
