    I think it doesn't matter if anyone else believes he felt vulernable or not, what he felt is what matters. Like it or not that's not something that can ever be proven in any court.
    I agree with the former NY detective- until you've ridden the NY subway you don't know how really bad it can be and you're trapped, maybe you should shut up.
    I also agree with the commentor that said this was a political trial, not a criminal one. The real problem here is rampant drug abuse and mental illness and the utter abdication of anyone and everyone who can actually do anything about it. You can't let dope heads and mental cases roam the streets at will and then tell people they can't defend themselves. Clearly the police can't handle it.
    So so so many other problems would disappear if the people who have the power would simply DO SOMETHING THAT ACTUALLY WORKS ABOUT DRUG ADDICTION AND MENTAL ILLNESS. Homelesness and crime would drop by half, maybe more.

    The fact that in 2024 we have not figured out how to deal with mental illness is the crux of many social issues we are dealing with today. A percentage of violence, a percentage of non-violent crime, a percentage of homelessness, a percentage of family instability, etc. etc. _can be attributed to mental illness._ And our big solution is to tell society to be tolerant?? This is NOT a humane way to deal with mental illness.

Hippa has made it impossible for parents of adult children get information or be involved in the process. There are not anywhere near enough psychiatric professionals for the constant increasing mental health crisis we are facing. That being said I believe Penny is a hero!

    We live in a society where most people can't afford even necessary physical health care, let alone mental health care. Investing in preventative self-care is lovely, for those entitled to enjoy that costly privilege. Inflated insurance premiums. This dude wound up having to choose the least terrible option in someone else's crisis. A checkup prevents a wreckup? Probably not, but we'll never discuss what would make a difference in his, or others' lives. If he wasn't broke financially, would he be broke mentally? Two very different deaths show what's really broken is our profit-driven medical industry: One was a CEO among the filthy rich, the other, his polar opposite. Both were people. The money made all the difference.

    Unless you are well versed in MMA and have experience with protecting yourself on the ground with someone on top of you, yes you are in a vulnerable position and the person on top of you probably has the advantage. If Penny would have let go of him, it would have been very easy for Neely to spin around and be on top and be able to cause injury. I have no idea of Daniel Penny's hand to hand combat training or if he has any MMA experience, and I don't think anyone on the subway at that time knew if Neely had a weapon on him or not.
