Anytime you film/record material intended for the public and for profit, you need to have a "Release for Use of Likeness" document signed by all parties involved (I don't know NV laws in detail but some jurisdictions require notary public). While this document is often forgone under the concept of Implied Consent, once the waitress and the man at the table said "no", the cameras should've been turned off and NONE of the footage was legally usable. I've watched a lot of these and find them interesting and informative (I'm in Las Vegas quite a bit) but I've always thought she flirts with what's legal. In this case, to quote Marge Simpson, she not only crossed that line, she threw up on it!! Darcy Spears and KTNV are not above the law. And, speaking of the law, these business owners are operating within the law as long as they address the problems and abide by the SNHD. If they don't, the LAW shuts down the restaurant.
