You could be making some sense but that is not what the court is doing. The court should have completely denied him a chance to be heard, if it felt that Uhuru was going to court with dirty hands. By allowing Uhuru to be heard, then writing some clumsy and highly unprofessional judgement makes the court also look particularly dirty. Judgement at that high level, with the president too as a litigant are permanent records that are later researched on and referred to by other courts and scholars of law. The courts are trying to have it both ways. It might leave them with a rotten egg on their face. It might end up being a case of a poorly written judgement rather than that of Uhuru going to court with dirty hands. It is unprofessional to hear a litigant all the way through when the court has already determined the outcome of the case.

That is not a matter for consideration under the appeal case. The case has only two possible outcomes. Either the appeal case succeeds, in which case the High Court judgement will collapse OR the appeal case fails, in which case the High Court judgement prevails. There is no third option. A court can't rule in matters not placed before it.
