    Can a neighbor’s secondhand marijuana, cigarette, and sage smoke affecting my health be a private nuisance? Secondhand smoke is harmful to everyone’s health whether they live in apartments, condos, townhomes, or public housing. Secondhand smoke and the walls they travel through don’t differentiate between whether they are traveling through the walls of renters or owners, and it can cause lung cancer and other health issues?

    Unfortunately I'm going to sound a little crazy but I wouldn't say this stuff if it wasn't true and I've already spoken to other water districts and a forensic engineer so I know this to be. Aside from that if you look at the circumstances it's kind of obvious that I'm simply a target for maltreatment due to some prior malfeasances in the court system and it's so severe that I've also been blacklisted for legal representation so that this can go on.
    I won't go into the abuses that law enforcement has been perpetrating against me because this is separate. I know there's a tour or there's a crime of malicious destruction of private property but I don't think a Municipal Water Department water district could be charged with that so my situation is that I've been my they flooded my basement with 8 inches of storage. It's just part of a program that I've been subjected to for years and it's because I continue to talk about the malfeasance that was perpetrating against me so as long as I talk about it and it doesn't matter if I talk about it or not they want me to kill myself and if you look up the concept of organized stalking harassment that is one of the goals. If and when something happens to me I'm going to die anyway because I'm not allowed to have medical care. See what I mean, I told somebody this and they're like that's not possible. I know nobody's going to believe this stuff so I have to record all of my communications but what's the point because who's going to address it?
    When you look at all the circumstances in the fact that my water has been shut off for years then you know that it's not something that originating from inside the house so they intentionally did it and they can control it. Have to make file the motion for summary judgment they let the water go out because they they knew it was going to be granted. Not only did they send the police on the final day my response was due and I believe it was more than likely to arrest me on a prior warrant but they couldn't just show up and do that so they had to make up an excuse and they fabricated a well-being and it had to use a large company that allegedly called it in because it was the only person company that I had been in touch with in that time frame. But I was able to dispel that by calling them right away as soon as they told me who it was and confirming with them that I never talked to him on the phone so the fact that I called them and claimed I was going to kill myself was impossible.
    Anyway this is some sick program and it's all because a judge decided he had a new way to steal some money by appointing an administrator to my father's estate despite my being named the executor. The results speak for themselves. 3/4 of a million dollars. These people are disgusting. You see why I'm not allowed to have legal representation?
    I'm approaching it from this aspect in case they tried playing non- responsibility

    Can a nuisance be a person

      I don't think that's the intent of nuisance law. If a person causes injuries, the person can be liable under tort law for intentional or negligence torts. Nuisance refers to circumstances that interfere with property rights.
