Well that was a pretty special trip for John and Josh. I've been berated by landowners around the Chicago suburbs for years even on larger navigatable waters. Most of the time I am several feet inside the streams, quiet, clean and respectful. No shots fired but with my luck in IL they would find me guilty of mangling a perfectly good bullet. Looks like you had a blast on a pretty creek. Blessings brother and keep your heads down
You handled that much much better than I would've. Good job my man! Cool video. I've never seen anyone thread a kayak up such a small creek to find such a wide wonderful fishing space!
Dude! I had that happen to for the first time ever just about a month ago. A guy was shooting at the creek bed/side. He didn’t care I was there. I back tracked and found a road back to my truck. It’s scary.
Creeks that small do have a lot of little smallies. There is a creek about 17 miles below my hone that I go up often. Haven't been up thru there fishing since the fracking crap started 10 years ago. We ae being heavily fracked now. I drove up there a couple years ago and they have heavy equipment everywhere but it's a heavily monitors creek and a treasure. One of the few clean streams in this area.
Great vid. You and the "fish anything guy" got me out there. I like that you're just happy to be out there. Dinks or lunkers, same enthousiasm Thanks for the inspiration.
Some people are very strange about their property. I understand being cautious and especially if you have been broken into. It is sometimes way way overkill with how people think and react to people even being near their property.
ANY body of water, creek, brook, stream, river, etc. that can be floated by any device such as canoe, kayak, boat, or even an inner tube, is considered navigable. Also, unless the property surrounding the body of water is posted, said property can be presumed to be publicly accessible also.
Did you change cameras, either your camera or my tv screen aren’t as clear as you once was. You and the content was great as usual the little lady was a bonus. Be safe and keep the videos coming and I’ll keep watching
Recently went to my creek and 2 state troopers were there. I said hey officers, whats up? They were looking for a guy "not in his right mind." I thanked them for the heads up and off to fishing I went. Caught a nice smallie that day.😊
I have had shots fired over my head before creek fishing. The law in Ohio used to be you fish 3 feet off the bank if the creek runs through private property on both sides. You can't bank fish but you can can walk through like an easement. It has been changed to once you get to the first break in a public water that runs through private property and your boat doesn't float and you have to get out and walk you are no longer legal. EDIT : one creek I was walking actually had a cattle fence across the creek and it's a real creek and public water. He also ran us off the creek. Same creek and it's extremely protected and a very beautiful creek but is so small in areas you can't float through so now that is illegal. You should be able to walk down the creek.
If there is public access to the creek. The land owner has no right regarding trespassing laws especially when you can't own a body of water unless it's surrounded by his land. You can't dock on his land but you can paddle through the body of water (creek, river, lake or pond)if there is Public access.
Should have called the cops, edit, actually after watching It wasn't a big deal. Lady fired a shot in air because they scared her, but people with land on the water should know people can fish it.
@@trollingdirty8910All true and by definition if you can canoe /kayak it then it’s navigable water . That law is in effect in 13 colonies states other adapted it as well. Here in most area of these states land owners and people respect the law for most part as long as you don’t mess around on their bank leaving trash and what not they don’t even care if you stop .
Took a trip to Michigan to see the in-laws and fish with the father in-law. In Michigan, there are parts on the lakes where the land is barely under water and it looks beachy. Some of that property is indeed marked as private property. Just an interesting side note I thought I throw in. That land out where these two were is most likely not private property. Some people think the water just beyond their back yard is theirs but I wanna say no, it's not.
Never should have shot a gun in the air. The fact she did that makes me think if she were looking at Josh and then heard you on the other side of her, she could have easily turned and fired.
In the seventies when I was whitewater kayaking people would shoot at us with pellet guns. The state of Georgia forced a guy on the chattahoochie to sell his land because he was harassing canoeist with a pistol and a big dog as they floated by.
$3.29 a gallon for unleaded, here in northern California, we haven't seen prices that low since Trump was in office. I paid $6.19 for unleaded, just last week.🥴
It gets scary when someone shoots at you or just around you when you are in the middle of no where just fishing and bothering no one. Some fifteen years ago a buddy and I were wading and fishing for smallies in a creek that we had fished many times before. When a guy shows up with a shot gun and fires in the creek. He said this is your only warning, get off of my land. The land was not posted and there were no houses within miles. Well we decided to cut our fishing trip short and go somewhere else. We found out later that the land was actually owned by someone that lived in Florida and he had just bought it for an investment. He said he did not have anyone taking care of his property and anyone could use it within reason. We talked to a Game Warden and he told us that it didn't matter if they owned the land or not if they had a gun it is best to leave. I said I'm way ahead of you brother. He just laughed and said I would have cut a new trail too.
You cant own the water but you can own the land underneath it. So if your floating by in your kayak your good. The second you get out of that kayak and put your feet on the ground you could be trespassing if someone owns the land.
Ya this is false in Ohio. You can navigate around obstacles and through shallow beds. Just can’t fish standing on the bottom. You’re fine to navigate tho
Man, call the police and make a report. If not for you, for the next guy. The next person who runs across her may not be so lucky. She just committed a felony, didn’t think you where the type to protect criminals.
From the corps of engineers website…. Navigable waters of the United States are those waters that are subject to the ebb and flow of the tide and/or are presently used, or have been used in the past, or may be susceptible for use to transport interstate or foreign commerce. As a land owner with a creek running through my property it pisses the hell out of me when someone comes up the creek and assumes they can fish the water because they can get their kayak up it, thus making the argument that it’s not private water. You are old enough to know better and old enough to get a landowner’s permission before fishing private water, armed or not.
Too many comments that are not applicable in other states. In my state, there are only three rivers allowed for floating. Every other stream is only by landowner permission. You need permission from every landowner to be lawful even if you never leave the kayak
Navigable Waters means that you can navigate it by a barge or large vessel! People ignorantly believe navigable Waters means you can navigate it by any means kayak canoe Jon boat walking etc. That is not true! Sometimes People's property line ends at the shoreline of state or city on water. Butt. It should be common sense to most people that people do on creeks and streams! Sadly common sense isn't that common.
Negative. The three terms are public navigable, public non navigable, private non navigable. Public navigable means that the waterway can be/is used for commerce (shipping). Here in Missouri think Mississippi/Missouri Rivers. Public-non navigable means that the waterway maybe able to float a canoe/kayak/small boat with no commercial use. Like the Current or the Piney. Most stream/rivers in Missouri at public-non navigable. Private-non navigable are waterways completely enclosed by land owners that have no public access, not managed by the state in anyway. Very few of them in this state. On public-non navigable waterways, in this state, property lines do extend to the center of the waterway, however the public is allowed to use any portion of the stream bed to include the water, sand and gravel bars etc. The area where permanent vegetation starts is where trespass can occur. Now, this does vary to some or a large extent in other states. For example, I believe that Georgia has some really crazy laws.
I have studied firearms law for almost ten years: Her shot was totally illegal and this video would easily be evidence to have her charged with 1) Recklessly endangering another person; 2) Making terroristic threats; 3) Disorderly conduct; 4) Harrasment; 5) Assault...Like most gun owners, she doesn't know the law. Regardless of her reasoning, or calming down, it doesn't supercede the laws she broke! Especially since you were absolutely no threat to her at all!
I wanna say that lady might be breaking the law by just shooting a round into the air with you guys around, especially since you two weren't threatening her life in any way at all. I highly doubt that land is hers. She might own property right off of the creek/river, but she doesn't own the water.
Trespassing or not she could be charged with aggravated assault by firing a gun in the air as a warning shot. Felon for life and lose her gun rights. It was a stupid dangerous thing for her to do.
A misdemeanor does not necessarily mean you are going to jail. In most states hunter/fishing harrasment means you will be issued a summons and probably get a fine. Of course it depends on how you harrased them.
She was way out of line in firing that shot. That could have ended really bad for her. She could definitely be charge with brandishing a firearm and possibly aggravated assault since you were in the water. Depending on what state you were in.
Screw that man - negligent discharge. What goes up must come down. She could have just simply asked y’all, instead of shooting one off. Glad y’all are alright. That’s stupid if that lady.

“At least she didn’t keep firing haha” yes John, at least there was that lol. Cracking me up
Stay strapped.
Glad you guys didn't get hurt, be careful out there because some people are not thinking right or doing what's right these days.
You handled that much much better than I would've. Good job my man! Cool video. I've never seen anyone thread a kayak up such a small creek to find such a wide wonderful fishing space!
Great looking creek ,good fishing, holler before shooting scary!
Dude! I had that happen to for the first time ever just about a month ago. A guy was shooting at the creek bed/side. He didn’t care I was there. I back tracked and found a road back to my truck. It’s scary.
I fish nearly everyday and ALWAYS PACKING.
Solid video, hopefully your presence settles her down some.....
That spot before the bridge is so awesome.
Glad you guys are safe.

Good stuff John glad you two are alright what a gorgeous area
Great vid. You and the "fish anything guy" got me out there. I like that you're just happy to be out there. Dinks or lunkers, same enthousiasm Thanks for the inspiration.
Pure madness ☹️ I’m glad everyone is safe 🙏🏾
Love your scripture at the end John!
Glad she just fired into the air. Glad everyone is safe. God bless
I own where you were catching some of those fish, you are welcome back anytime……I know who shot in air, ridiculous
Oh ok. Thanks so much I appreciate that
Now, that is an adventure.
Scary stuff 😬 😳 Jon!!! That's why I only creek fish at public access places!!!! Wooooooo weeeeeeeeeee
Good Bible quote to go with the vid!
I needed that scripture. I haven’t felt very peaceful lately.
Thank God you're both alright!
When you’re fishing you don’t expect someone to fire a gun near you. Thank God y’all are still here.
Glad y’all made it out alive lol. Good grief. Good fishin!

Yep...in east TN they think "He needed killin" is a legal defense.🤣
Great video nice creek

A negligent discharge is a negligent discharge in my book, praise GOD everyone is okay at the end of the day. Glad yall caught some fish tho!
You are a nice guy.
Awesome trip, even with the lady doing her crazy thing. That would've freaked me out for sure!
Title sounds very interesting john!
It’s so darn pretty. Love to fish a place like it.

Not true, and the laws are usually in regards to navigable water and are different state to state. Though shooting a passive trespasser is not legal.

@boxingstarcmbballer8797 this is not true. Sadly, in Georgia, public access is pathetic. Courts always side with landowners.
Well I always wanted to go fishing with John but Not anymore. He like to have got poor old Josh shot. HAHAHA good times keep the video's rolling.

You doing any deer hunting this year
maybe, i dont that often
Crazy lady probably thought you guys were “revenuers” about to stumble onto her distilling operation and/or grow room 😏
It's good of you to consider her point of view. Nevertheless, I agree that it was not handled well on her part.
You came upon a still site. Clearly.
You could press charges.
That creek feeds her still 😅😅😅 she don’t need no revenuers around her property dab nab it

Fishing all day = Dietary Dilemma 😂😂 I live on gas station food on every trip 🤟🏻
Whaaaaaaaat
That wouldve killed the whole mood
Great scenery great video. I think that was wrong shooting like that she could have got shot doing that to someone else
Very nice creek that lady should not shoot a gun in the air she was lucky it could have been someone that shoots back. Not a smart move 🙏🙏🐟

This. Dude does it ALL THE TIME and I’ve commented about it in past videos and he still does it. 😢
Must have mistaken you guy’s for Revenuers!
No, the creek is NOT her property it is Waters of the United States according to the US ARMY CORPS OF ENGINEERS! 🫤

Do you feel lucky punk? Well, do you?!!
