Who's House Is It Anyway? (1986) BBC TV Documentary - Barnsley Council vs The Howard Brothers

Most people believe their home is their castle. But it isn't. If the council want it, it's theirs. Billy and Gordon Howard still believe Rose Cottage belongs to them. Barnsley Council knows better. It has placed a compulsory purchase order on the cottage and surrounding land. Legally the council is the owner. The bachelor brothers are 65 and 73. They are set in their ways and absolutely refuse to budge. They doggedly refuse to recognise the validity of an order confirmed by a Secretary of State. Their stance is a symbol of the impossibility of reconciling individual freedom with community needs. For when the bailiffs come, the brothers say they will shoot, rather than give up their birthright. Following the first showing of this film the story took a surprising turn ...

How generous of the counsel. Forcibly buys your and home for a quarter of market value... then offer to rent you a new home built on your stolen land...

Well put, and what's worse true! They're crooks, and if you did it to them personally, can you imagine the uproar. They really are some of the most evil people that I have met, and I have met plenty, but some of these Council boys excel in lies, tyranny, and malice, and finally enjoy spreading misery. I wonder who breeds them...the Council? Or the Gestapo!!!

Absolutely! A tyrannical set of evil c_unts are Barnsley Council, and it's right what he said, they take from the people and lie. I've had run-ins and intend to have another yet, as they almost took my house too, based on lies and evil, and the courts back them. The working man has little chance really, but you can try. I shall!!! Again! Shame for these bros at their time in life. Sick!!!

Can't believe I have stumbled on this wonderful documentary. I can't believe they would not leave these two elderly gentlemen to live and die in peace and let time take it's course. I remember watching it when it was broadcast. Two wonderful old characters who at least put up a resistance to authority. Not many folk left like that nowday's. Thank you so much for sharing this. Typical Barnsley council, Barnsley was one of the best market towns in England until the Barnsley council ruined it, all the town needed was some bypass roads around it and the town centre pedestrianising.
I smell some kickbacks involved in this particular case.

I watched this, and it is absolutely disgusting how Barnsley Council treated 2 old men in THEIR own home. The council should have just waited and then compulsary purchased the farm when they passed on. What right do the council have to decide they can better use some-ones land. The poor old boys probably didn't live much longer after this after being uprooted from their home. And who gave him a black eye ?

The Howard’s were/are an incredible family. I am a descendant and a rebel also. My mom who has now passed, grew up in this family and had so many stories to tell her children and grandchildren. The Howard’s were entrepreneurs, land owners, farmers, shop and dancehall owners and patented the glass tubing (instead of lead) means to pump beer in pubs. This stealing of land is truly a lesson for all of us.

The brothers ended up in a nearby farm property owned by a third Howard brother who had not long passed away. Even then they got council aggro. Their possessions did not get sent on to them by the council, the least they could have done, instead their stuff was sent to a rubbish dump as demolition began immediately after the brothers were forced out. Sadly, but unsurprisingly the older of the two brothers passed away a short time after they were kicked out.

Another travesty of life, even your home of over a century, the place of your birth, and in the twilight of your days, is not sacred, nor really your own, if some tyrant council man tells you to get off the land, after which a number of pockets are quite naturally feathered. If it matters and if anybody is listening - My Gran - 64 Harborough Hills Road to build a "better road". Oh and by the way she purchased the property in the Great Depression 'cos she didn't like the man coming round for the rent. And she had five children. So much for more the smug planners. Bet they never were compulsorily purchased from their property.

My God they're old men. How long do they've to live? Let them live out their days in that house! Their house is full of precious antiques! Too bad the old men couldn't of held an auction and hired a lawyer to fight the council. Private Property laws in America are much stronger than Britain.

So work all your life / buy a house with some land where your happy. Then have it taken from you/ go live in a council house that you then have to pay rent for for rest of your life/ can't keep your pets/ then when you die you have nothing to leave your children because the council stole it from you by force
The least they could of done was to give the the council house ( transfer ownership to the brothers) plus cash compensation

One, they are evil and utterly, utterly tyrannical and destitute within, and secondly, they are given way too much power over others. We need a people's party of some kind to enable people to fight these decisions and Benefits and other issues, which can easily change and use the law for the common good. They literally bulldozer and steamroller people the Council.

I can see both sides of the story. The council have ridden roughshod over the brothers using the law.If those council members were in the Same position they would realise the power that a house has for people. But the site was a bit of a shambles, and could have done with tidying up.This was never going to happen.I think the council had a thumping cheek to offer them that tiny house, presumably for rent. The 4 bedroom house was,I my opinion a much better prospect, and should have been offered at a very low rent, but we weren’t told.

If they had concerns re: sanitation , unsightliness or whatever, they should have approached the brothers & expected them to fix that problem - perhaps with council paying for the fix (if independently verified) and only in event they wouldn't agree, then they'd have more justification for their action

If it's his property, he owns it, unless their was a danger occurring this man should not be touched. Seperately, but especially a hard working, bill paying, honest citizen. Despite the need for more housing, should not bother a property owner unless he agrees. There are rules of course, but in the case of decency, leave him alone. Go and ask some rich country Lord, owning a manor, with acres of land and bill on his land.
