Shelby municipal judge Sheree Studer needs to be removed indefinitely. Incompetence, you can hear it in preliminary hearing. She has done the same thing this judge has but also allows clerk of courts to commit ultra vires acts (holding probable cause hearings, determining probable cause and issuing "warrant on complaints". A clerk of courts (who was nothing more than a dispatcher in 2017, has no judicial authority to issue warrants or determine probable cause, only an unbiased and impartial judge or magistrate can do so. therefore everything would be null and void "Ab initio " which means I was abducted and held against my will, assaulted, robbed of my livelihood and my firearms, Denied due process, Was shouted shut up at by the judge which they tampered with audio recording and remover that 8 seconds from the audio, they lied about my records request saying I requested it on December 13 2023 when in all reality i requested it oct 31st 2023, then again i called and stated sunshine state laws November 17th 2023, which I recorded both calls but the wrote I requested Dec. 13th and that they had it available Dec. 19th. Lying to try fall within the reasonable amount of time so they wouldn't be liable. However, I have the phone calls I recorded. So shows their dishonesty. I've made complaints with DOJ 2x, FBI, Ohio disciplinary Council (which i even hand delivered on the judge). For anyone with knowledge of this. If you were to go to the Richland County Common Pleas Court and search my name, you'll see an abduction Charge that was made on me after my estranged wife made a false report. I was held in jail for 28 days, bonded out and forced out of my hometown for 66 days on an ankle monitor and extensive pre-trial supervision, subjected to random visits and random Urine and BAC tests which they charge me for but done so at their discretion, charged me over 300$ a month in fees yet i was indigent. I was told if I stepped foot in my hometown (Shelby Ohio) I'd be immediately arrested. The wife had come out to my sponsors to sign divorce papers, which while there she had come up behind me while I was sitting in a chair going over paperwork, I had my hands in my pockets. She put me in a reverse choke hold and pulled me up out of the chair and Hip tossed me on the pavement (leading to asphalt burn and a chunk of skin taken off my elbow.) I never retaliated, never have even though she had hit me in the face countless times on different occasions. THEY revoked my bond, never was given an opportunity to attend a bond revocation hearing, held me in jail for 26 more days and then I was called over the intercom and they said, "McClain packed it up". I asked why I was being released, was the case dropped or what? Their response, what are you worried about at least you get to go home? By the way, this whole time my wife was cheating on me, selling my livelihood (over 7000$ of my tools) and the police officers (Sean Nolen and Adam Turner) had released multiple assault rifles handguns and shotgun and over 700 rounds of ammunition to her which she has a DV conviction from December 22 2010 where she had threatened to "shoot" me in my "f**king face" which she said was a "threat" and a "promise". She was charged by the same department, as a matter of fact the same officer who called me telling me I was being charged for F3 Abduction, that there was a warrant for my arrest, that the marshals were looking for me and that I needed to turn myself that they didn't want anything "bad" to happen to me. I said why would I turn myself in for something I didn't do? I tried to explain that she started an argument, I told her I wasn't going to argue and that I was leaving, she then retaliated by going for her handgun that was locked in a case (that she shouldn't have had seeing that she has a Domestic Violence and that would be a violation of the Lautenberg Amendment 1996 (Federal Gun Control Act of 1968). The Court Docket says, "CV dismissed by 41A or CR before arraignment.". So, you're telling me I was held for 28 days, 66 days on practically house arrest (8am 4pm curfew, she had my truck and was selling my tools so therefore I had no ability to work or do anything) then 26 more days after I was assaulted, and they revoked my bond. Yet nothing ever happened to her. as a matter a fact her, her X boyfriend, her mother, her sister and her brother came to my father's residence and ripped down my camera, forced in the home and started stealing things, then her sister pointed a 9m in my 65-year-old mother face and said "I'll sh**t you B**ch!" So, I called the police, and they fled shattering the front door window on their way out. They only charged her, her sister, and her mother with AGGRAVATED burglary F1 but did backroom deal during the preliminary hearing, reduced their charges to F4 B-E trespassing, so they only spent 3 days in jail before being bound out, was not put on an ankle monitor like they did me. Their charges got reduced to F4 B-E trespassing, 18 months, 18 months suspended, no fines, her mother was to pay 1400$ restitution which took her almost 2 years even though they own multiple rental properties etc., and 2 years community control 3 years PRC. I sent an email to Shelby PD arresting officer and had provided him with screenshots of their Facebook showing they were violating their community control, and it was ignored. as a matter of fact, I still haven't found Mugshots even to this day. the false abduction charge (2022 CR 0280) was made April 4th, 2022, and the Aggravated burglary took place on October 31, 2022. Case for Aggravated Burglary (least the one of the three charges is 2022 CR 0758). You can see the ridiculous bodycam footage and even listen to the sham Preliminary hearing for the abduction charge. the Court even edited out their misconduct where the judge shouted Shut up at me for defending against the Officers False Testimony which was easily proven seeing as her affidavit even said I offered her to remain at the residence to get enough money for her to get her own place, even offered my truck. he tried to lie and say I bribed her with Truck and residence to drop charges, that was a lie. I also have a confidential police report that says not for public use subject to RC 149. It states jurisdiction Unknown and Statute Unknown Statute... Even the chief of police told me I was not supposed to have it and asked where I got it from.

When I worked, this was the practice. In Cuyahoga Falls Municipal Court. I remember well the judges giving the option of jail time in lieu of fines and costs. There is more to this than meets the eye.
Because we are a state run by idiots. Our Attorney General doesn’t even post a legit number on his website. The number he has posted gives the message “this number cannot be completed as dialed”.

It's not like the necessary laws don't exist: 18USC242 and 18USC241. The problem is, the constitutional courts and DOJ (regardless of party affiliation) are in on the corruption.

Hoover has been doing this for at least a couple of decades now, he increases fines and costs to pay for his courthouse, he used to openly brag about it. Fines and costs at most other municipalities totaling approx $400 are about $1600-$2000 with judge Hoover He bragged he didn't use taxpayer money for his courthouse. Dig deeper and you will find Hoover has been padding his pockets too

This judge works for and is suppose to serve people , he is not there to groom his own ego, or too intimidate threaten or even lecture defendants. He is biased against addicts and the poor , dont believe check his sentencing record it does not lie. It’s not just Judge Hoover, but also Judge Lisa Coates. I will say magistrate Clark is good dude. But I will say 10 years ago when I was in trouble they’re strictness on making sure that we had fines and costs is one of the reasons I think I was afraid of getting in trouble again., they were willing to set up payment plans with me, but if I didn’t have that on my plan date, you could definitely count on being thrown in jail. I think that is a good thing. The woman in front of me also set up a payment plan, when she got up to the podium and told the judge she didn’t have her $40 or whatever it was, the judge swiftly informed her to go sit down in the bullpen you will be going to jail for the rest of the money which was like $50 a day. She suddenly had the money and pulled it out of her pocket, but it was too late. yeah there is probably a fine line there, but I think it is a good thing we were held accountable

Question, how many people come through a given court room in one week or one month or one year? How many of those people are not wealthy? How many of those are wealthy? I ask these questions bc myself have been found guilty of a crime I know nothing about and this was the sherrif dept making the crime themselves, its called a frame! I was sent to prison, yes I was then and now innocent. It was a total fabricated crime from the beginning. It took 5 years from my life and no accountability bc I am poor and without representation. I was forced by law enforcement to move from my home town or they would return me back to prison for no reason. Wealth isn't something that should determine your guilt or innocence, it should be balanced for everyone. When the law began harrassing me I had a CLEAN RECORD. I was sent to prison for 3 years, while in prison I made many friends and enemys, it is prison. I wanna say this. I was sent to 4 different prisons, prison is not any place for anyone but it is not any place a innocent person should ever be. To knowingly send a person to prison bc an officer or judge doesn't like you are totally wrong and very dangerous. The courts know the harm that is in the prisons. The damage that those years have done to me at my age can never be forgotten. I got out on parole on October 1st 2018 I was 52 and to this day the investigator that lied under oath is still working at that job. The lies he told were proven to be lies but I stiill went to prison. The video that they had was altered as it was proven also. They just don’t do nearly enough. So I don’t know what this judge did, but based on this video I’m leaning towards not agreeing with him. You give people time to pay back and if they don’t pay back they’re fine they better get a second job, and if they don’t get a second job or still don’t pay back their fines, then you hold the contempt hearing. But maybe there’s a reason in certain states that the process I laid out is not allowed. Maybe the power to put people in jail is extremely limited after the sentencing day. So I don’t know. But how many people treat court fines like they do credit card bills, they decide not to pay them because nothings gonna happen to them. Another thing to angers me, let’s say you go to a mechanic that destroys your car and you take them to small claims court and you win. But then you could never get them to pay you because they’re hiding money. And if you think it’s easy to collect money, then you don’t know anything about the court system. There’s all kinds of ways to legally hide money where you’ll never recover it. There should be sanctions for that as well. If someone really can’t afford it then maybe they can only pay a small part I want to take forever to pay it off. And that sucks, but that’s one thing. But he just completely decide not to pay what you owe, that’s when you need punished.

I also have a confidential police report that says not for public use subject to RC 149. It states jurisdiction Unknown and Statute Unknown Statute... Even the chief of police told me I was not supposed to have it and asked where I got it from.

When I worked, this was the practice. In Cuyahoga Falls Municipal Court. I remember well the judges giving the option of jail time in lieu of fines and costs. There is more to this than meets the eye.

Shelby municipal judge Sheree Studer needs to be removed indefinitely. Incompetence, you can hear it in preliminary hearing. She has done the same thing this judge has but also allows clerk of courts to commit ultra vires acts (holding probable cause hearings, determining probable cause and issuing "warrant on complaints". A clerk of courts (who was nothing more than a dispatcher in 2017, has no judicial authority to issue warrants or determine probable cause, only an unbiased and impartial judge or magistrate can do so. therefore everything would be null and void "Ab initio " which means I was abducted and held against my will, assaulted, robbed of my livelihood and my firearms, Denied due process, Was shouted shut up at by the judge which they tampered with audio recording and remover that 8 seconds from the audio, they lied about my records request saying I requested it on December 13 2023 when in all reality i requested it oct 31st 2023, then again i called and stated sunshine state laws November 17th 2023, which I recorded both calls but the wrote I requested Dec. 13th and that they had it available Dec. 19th. Lying to try fall within the reasonable amount of time so they wouldn't be liable. However, I have the phone calls I recorded. So shows their dishonesty. I've made complaints with DOJ 2x, FBI, Ohio disciplinary Council (which i even hand delivered on the judge). For anyone with knowledge of this. If you were to go to the Richland County Common Pleas Court and search my name, you'll see an abduction Charge that was made on me after my estranged wife made a false report. I was held in jail for 28 days, bonded out and forced out of my hometown for 66 days on an ankle monitor and extensive pre-trial supervision, subjected to random visits and random Urine and BAC tests which they charge me for but done so at their discretion, charged me over 300$ a month in fees yet i was indigent. I was told if I stepped foot in my hometown (Shelby Ohio) I'd be immediately arrested. The wife had come out to my sponsors to sign divorce papers, which while there she had come up behind me while I was sitting in a chair going over paperwork, I had my hands in my pockets. She put me in a reverse choke hold and pulled me up out of the chair and Hip tossed me on the pavement (leading to asphalt burn and a chunk of skin taken off my elbow.) I never retaliated, never have even though she had hit me in the face countless times on different occasions. THEY revoked my bond, never was given an opportunity to attend a bond revocation hearing, held me in jail for 26 more days and then I was called over the intercom and they said, "McClain packed it up". I asked why I was being released, was the case dropped or what? Their response, what are you worried about at least you get to go home? By the way, this whole time my wife was cheating on me, selling my livelihood (over 7000$ of my tools) and the police officers (Sean Nolen and Adam Turner) had released multiple assault rifles handguns and shotgun and over 700 rounds of ammunition to her which she has a DV conviction from December 22 2010 where she had threatened to "shoot" me in my "f**king face" which she said was a "threat" and a "promise". She was charged by the same department, as a matter of fact the same officer who called me telling me I was being charged for F3 Abduction, that there was a warrant for my arrest, that the marshals were looking for me and that I needed to turn myself that they didn't want anything "bad" to happen to me. I said why would I turn myself in for something I didn't do? I tried to explain that she started an argument, I told her I wasn't going to argue and that I was leaving, she then retaliated by going for her handgun that was locked in a case (that she shouldn't have had seeing that she has a Domestic Violence and that would be a violation of the Lautenberg Amendment 1996 (Federal Gun Control Act of 1968). The Court Docket says, "CV dismissed by 41A or CR before arraignment.". So, you're telling me I was held for 28 days, 66 days on practically house arrest (8am 4pm curfew, she had my truck and was selling my tools so therefore I had no ability to work or do anything) then 26 more days after I was assaulted, and they revoked my bond. Yet nothing ever happened to her. as a matter a fact her, her X boyfriend, her mother, her sister and her brother came to my father's residence and ripped down my camera, forced in the home and started stealing things, then her sister pointed a 9m in my 65-year-old mother face and said "I'll sh**t you B**ch!" So, I called the police, and they fled shattering the front door window on their way out. They only charged her, her sister, and her mother with AGGRAVATED burglary F1 but did backroom deal during the preliminary hearing, reduced their charges to F4 B-E trespassing, so they only spent 3 days in jail before being bound out, was not put on an ankle monitor like they did me. Their charges got reduced to F4 B-E trespassing, 18 months, 18 months suspended, no fines, her mother was to pay 1400$ restitution which took her almost 2 years even though they own multiple rental properties etc., and 2 years community control 3 years PRC. I sent an email to Shelby PD arresting officer and had provided him with screenshots of their Facebook showing they were violating their community control, and it was ignored. as a matter of fact, I still haven't found Mugshots even to this day. the false abduction charge (2022 CR 0280) was made April 4th, 2022, and the Aggravated burglary took place on October 31, 2022. It’s not just Judge Hoover, but also Judge Lisa Coates. I will say magistrate Clark is good dude. But I will say 10 years ago when I was in trouble they’re strictness on making sure that we had fines and costs is one of the reasons I think I was afraid of getting in trouble again., they were willing to set up payment plans with me, but if I didn’t have that on my plan date, you could definitely count on being thrown in jail. I think that is a good thing. The woman in front of me also set up a payment plan, when she got up to the podium and told the judge she didn’t have her $40 or whatever it was, the judge swiftly informed her to go sit down in the bullpen you will be going to jail for the rest of the money which was like $50 a day. She suddenly had the money and pulled it out of her pocket, but it was too late. yeah there is probably a fine line there, but I think it is a good thing we were held accountable

Question, how many people come through a given court room in one week or one month or one year? How many of those people are not wealthy? How many of those are wealthy? I ask these questions bc myself have been found guilty of a crime I know nothing about and this was the sherrif dept making the crime themselves, its called a frame! I was sent to prison, yes I was then and now innocent. It was a total fabricated crime from the beginning. It took 5 years from my life and no accountability bc I am poor and without representation. I was forced by law enforcement to move from my home town or they would return me back to prison for no reason. Wealth isn't something that should determine your guilt or innocence, it should be balanced for everyone. When the law began harrassing me I had a CLEAN RECORD. I was sent to prison for 3 years, while in prison I made many friends and enemys, it is prison. I wanna say this. I was sent to 4 different prisons, prison is not any place for anyone but it is not any place a innocent person should ever be. To knowingly send a person to prison bc an officer or judge doesn't like you are totally wrong and very dangerous. The courts know the harm that is in the prisons. The damage that those years have done to me at my age can never be forgotten. I got out on parole on October 1st 2018 I was 52 and to this day the investigator that lied under oath is still working at that job. The lies he told were proven to be lies but I stiill went to prison. The video that they had was altered as it was proven also. What does a poor man supose to do, how does a poor man get justice for his innocence? Sorry for rambling, what i want to say is this. I meet many many inmates and NOT ONE OF THEM WERE WEALTHY, I NEVER MEET A WEALTHY MAN BEHIND BARS! ARE WE TO THINK THE POOR ARE THE ONLY ONES COMMITTING CRIMES? You give people time to pay back and if they don’t pay back they’re fine they better get a second job, and if they don’t get a second job or still don’t pay back their fines, then you hold the contempt hearing. But maybe there’s a reason in certain states that the process I laid out is not allowed. Maybe the power to put people in jail is extremely limited after the sentencing day. So I don’t know. But how many people treat court fines like they do credit card bills, they decide not to pay them because nothings gonna happen to them.
Another thing to angers me, let’s say you go to a mechanic that destroys your car and you take them to small claims court and you win. But then you could never get them to pay you because they’re hiding money. And if you think it’s easy to collect money, then you don’t know anything about the court system. There’s all kinds of ways to legally hide money where you’ll never recover it. There should be sanctions for that as well. If someone really can’t afford it then maybe they can only pay a small part I want to take forever to pay it off. And that sucks, but that’s one thing. But he just completely decide not to pay what you owe, that’s when you need punished.
