- At first glance, the news that the sentencing in Donald Trump's New York criminal trial has been scheduled for after the presidential election seems like a win for Trump, but what is also possible, and even likely, is that Judge Merchan put the date after the election because he intends for the sentence to include "confinement," either at home or in jail, and he did not want such a dramatic sentence to influence the election. Duncan Levin and Kristy Greenberg, former federal prosecutors, share their insights with Alex Wagner.

There has never been charges like this ever. Dosent that tell you something. They trying to railroad trump. Murders and rapists get less time then what they trying to give trump. Why would Trump's sentencing go to the Supreme Court. Its sentencing; which means a crime was committed. This entire process is ridiculous. Death threats upon a judge and their family just adds to the ridiculousness.
Of course an appeal would go to Scotus if he wins. Scotus is clearly on trump's side, and already ruled favorably when some states tried to remove him from their ballots for insurrection (14th amendment). As president, they'd say he can't run the government from prison, so his sentence is commuted to when he's out of office. It's the same old childish, pathetic, bait and switch rationalizations they've used since he was impeached.
Doesn't matter. The Supreme Court won't overturn the sentence.

The sentencing won't go to the supreme court; the evidence presented in the case could, however, leading to the verdicts being vacated. The record of this SCOTUS makes that fairly likey.

@@leifotto4277 I think the huge scandal was how long all of this took to get started. In the Stormy Daniels case, Michael Cohen was sentenced to prison, but Trump wasn't even indicted at the time, despite being named ASA co-conspirstor.
The AG Garland also took no action until he was shamed into doing so by the Jan 6 Committee. All of this was left too late for any action. And if Trump wins, all the federal cases will disappear and he will use everything in his power to target the state prosecutors to render them useless. And I suspect this will involve having them arrested and held on spurious charges.

The first question I’m asking is why were the Republicans so dedicated to Trump? After he was twice impeached and convicted for so many crimes, why didn’t they just choose to support another candidate for their front runner in the presidential race?
My next question is why did they assume that Trump would be able to effectively manage the country as our president if he was in jail, or if he was constantly fighting in court to defend himself for his freedom?
I’m relieved that some Republicans have broken out of Trump’s spell and that they have decided to stop supporting him. It’s comforting to know that more of them have decided to put our nation first, and are willing to convince other Republicans to do likewise.

Merchan's daughter's job is working on Democrat political campaigns. The defense has done everything they can to try to make the case look political. Given the timing, I believe Merchan is making a calculation to make sure the case is preserved and justice is served, in the end. Remember SCOTUS could interfere with justice (so ironic) so I believe Merchan is reducing that risk by waiting to sentence.

It's because the NY D.A. did not object to the defenses arguments that Trump's sentencing should be delayed. If you don't make an argument against your opponent you concede that his arguments are correct, and the judge, being a neutral arbiter, has to act accordingly. I don't blame Judge Marchant, I blame the NY D.A., for not upholding the laws of N.Y. state.
They give the people the chance to make Trump loose the election first. Going to prison can vote second. Then Trump would have lost in the election and in the court.

The judge has not YET imposed a sentence for Trumps contempt and gag order violations. For the crimes in question Trump might not serve time, BUT he should serve time for contempt and risking the lives of witnesses and court staff and their relatives.
