In the application it stated type ur name. But How did you e-sign?

Thanks for sharing this one and only video that I could find on online h4 filling. I have a question though. In the latest online as well as paper H4 application, there is a new question Part 3, question 4, which asks about "If you answered "Yes" to Item Number 2. or Item Number 3., select the Form type below." Not sure on what to fill here. Is it for the h4 applicant or the primary applicant. If it is primary applicant the answer would be I129, but for h4 applicant it would be i539. But it makes no sense to ask form type in a i539 form for an h4 applicant. Appreciate if you could answer.

Background: I am now in L1B visa in passport. Recently, have recd. approved I797 (H1B) sponsored from my employer ONLY for myself. I need to complete the I539 for my family members (spouse and Son), who are now in L2B visa as dependent.
1) Whether I need to fill both I -539 for myself and I-539A for my spouse and son (individually)?
2) Can I file on-line for myself and dependents?
3) When you say, complete passport to be provided as supporting documents (are you referring all pages of the passport?)
Why are you moving to H1B, when you have L1? Is your H1B going to expire soon? If not, I would suggest, stay on L1 and your wife will also be able to work/drive/apply for SSN/etc. With H4, she will not be able to do anything.

For some reason I'm unable to sign the application online.. even though I enter my name in the signature field and proceed with payment finally it states page not signed..

@@saksh2021 EAD is paper based only and can be filed along with H4 extension. Package both the applications together and mail it.

My H1-B transfer to new employer recently and I have approved I-797 . Now my H4 is due for extension ; what should I put in at (7:36 ) in " Is the application based on separate......"?
It will be 'yes'. But the case would not be pending with USCIS. You still have to provide your approved petition receipt number.

For dependent filing, it has to be yes. Provide the details of the approved H1B notice

If primary applicants h1 is expiring, then suggested to file h1, h4 and h4 ead all together
To answer your question if we can file h4 and h4 ead online, then the answer is ‘no’. U can still file both these together, but paper based.
at 8:14 you have put no and no for immigrant visa, what if the primary applicant I140 is approved? do we still select no? Thanks.
Right. Put no there. Immigrant visa is if any US person is sponsoring your permanent immigration

@@VivekKumar-m9c9g I think only i539 can be submitted online. For coapplicants, you will need to file i539A , which is not online. You may get this validated with Mr Rahul Reddy(in online session).

If we are filing H4 application online, can we send EAD application immediately after few days thru mail or we need to wait for H4 to approve.
If you are applying for ead as well, then don’t file it online. Go for paper based filing and send h4 application +ead application together at the same time.
@@mandy01011980 Thanks ! the situation is - my H4 is expiring in Feb 23 and I am not sure if the receipt will come in time if I apply thru letter. Hence, I am thinking to file H4 online to get the receipt and later file EAD after some time.
You don’t need a receipt of H4 if you are filing both H4+EAD applications in the same package. File both together and hopefully you will get the EAD within 3-4 months.

If I am an H4 Visa holder wanting to file extension for myself, can I do it myself or only my husband who is an H1B holder can file the i539 on my behalf. You should be able to file it yourself using your spouse's h1 details

As per my knowledge, your H1 needs to be approved first and after that all the H4s would approve.

Hello @Mangesh, my wife traveled to India after my petition is approved and when she back her I-94 is updated to the same date as my I-797 Approval which is valid until next year. But her visa on the passport is about to expire in 5 months. Does she need to apply for H4 extension now?
Valid i94 should be good enough.

My H1 expires on April 30th but my employer filed my extension on Mar 25th. My spouse H4 also expires on April 30th. But i yet to get my receipt number for my H1 extension since it was only 2 weeks. Now to apply for my spouse H4, we need H1 receipt number. So should i wait untill i get it or we can file H4 extension with my existing H1 receipt number. Kindly help. Thank you!

1. Is your H1B fee check debited ? Then you should be able to get the receipt# from the back of the check.
2. Chat with Emma to get the H1 receipt #
3. If you don't have it either way, then select NO to the question - "Is this application based on a separate petition or application to give your spouse, child, or parent an extension or change of status?" and proceed.

From the USCIS website, it appears that you should be able to add the minors while filing it for your spouse. You can visit the fee calculator page to add applicant and co-applicants. www.uscis.gov/feecalculator
I am not an attorney but the website clearly says that the online application should be for an individual. so No, you can't add anyone in the online application. There should be one application per applicant. The only part I am not clear is can parents file an application for minors. That's my understanding.
I applied online I-539 two weeks before but my USCIS Reciept start from MCT# When I am checking online case status it's show error, logged in to myUSCIS Account also it says "your case status is unavailable at this time. We are working to get you accurate information as soon as possible." Any idea?
The status should get updated on 72 hrs. If not, I would suggest, chat with Emma and check what's going on with your case.

@@venkatk6292 still seeing same issue, but I received Approval notice this morning in my USCIS Account(my husband extension was approved last week) and the approval document is little weird, it doesn't have any header(US Citizenship &Immigration Services, Notice of Action something like that) on notice.Called USCIS this morning to verify, they said they don't see any approval notice/status and a supervisor will be calling next week on this approval.not sure what is happening.

The attorney who filled my extension (my employer paid for my extension) is asking $750 for filling my wife's H4 extension. So I have one thought here, is there any advantage by going attorney way or I can file as per your video info ?. Thanks in advance.

@@mandy01011980 Hey Mangesh, I did file for myself based off of my husband's H1 petition. Its been over 2 months i haven't received receipt notice, got only receipt of payment, on that case number starts with MTC# which seems does not show as a valid case when i check status online.
Can you pls share how long did it take for your spouse to get a receipt#? Did it start with MTC#? Where did you check the status and if she had to go through biometric again? Thank you

Yes. My case was also the same. You should be able to use the new passport.

Put 3 years from the date of filing

I applied online i-539 two weeks before but my uscis reciept start from MCT# When I am checking online case status it's show error due to this MCT.
Do you have any idea about that ?
MCT is a valid receipt#. I would suggest, talk with Emma(live agent) and see if there is any mistake in your application.
My receipt number also starts with MCT and it still shows as " CASE WAS RECEIVED". USCIS is still processing the cases received 2 weeks before my application. Good luck.
