Not sure if this will ever be useful to you but if you encounter someone who abuses passive mode, you can still kill them by using an arena war vehicle that has a shunt boost to launch an empty car at them. Since no one is in the car, the game doesn't make it intangible yet if you manage to kill someone with it, it still counts to the score, obviously they need to be on foot to get killed. It's really hard to pull off tho so i wouldn't recommend using this trick.
