      It is a path breaking speech by Shree J Sai Deepak and is an eye opener to all open minded educated people of the country who respect the Judiciary and also expect it to perform its designated role. The whole country is suffering from the combined effect of non performance of Executives, Legislature and of the Judicial activism. One of the very important and valid reasons of piling up of pending cases before the various courts of this country may be this. Every sensitive and open minded citizen of this country would sincerely expect all these very very important arms of the State to function properly and to discharge their designated duties effectively. And hence, this speech of Shree J Sai Deepak is very very timely and should reach to maximum number of people for mass awareness and to create a mass appeal in this regard.

    Very good speech. He never disappoints. Very very clear in communication. A glance at the previous appointments of CJIs shows that the existing collegium ensures dynastic supercession. Why to blame the GOP of India. That may be one of the reasons these judges don't want NJC. Sad.

    This is one of the most comprehensive and down to earth talks on the evils of judicial activism and its causes. No intellectual posturing. Only facts.
    I have noticed that the Supreme Court started encroaching upon the territory of judiciary from early 1990s, when the era of co-alition governments started. That was when the Second Judges's transfer judgment was delivered vesting the power of appointment of judges in the Judiciary. A strong government would have prevented this occurrance. It is good that the present government has recently demanded its representation in the collegium. Otherwise, it will continue to be a club of favouring the cronies.
    During the last thirty years, the weakness of the Executive and the Parliament has let the judiciary rule the roost. With 50% of the parliamentarins having criminal cases against them, and the corruption in bureaucray and State politics being legion, little wonder that the Legislautre and the executive lack the moral authority to re-assert their true role in the constitutional framework.

    India needs more and more Sai Deepaks for not allowing Western and other religions laws to be imposed on the main stream of this country. For the sake of individual political parties benefits, the main stream rights are suppressed. It is continuing for generations. New India needs more and more Sai Deepaks..

    Wow! This the first time I am coming across the answer to my old and repeated question that I had been asking as to who and how are the judges, especially SC judges, are selected and appointed!!! And of course, who else than J. Say Deepak is the only one saying the 'simple' provision in the constitution. Well done, Shrimaan. Why has there been no opposition, resistance, counter efforts in and out of Parliament by the BJP government to assert itself to correct this situation? A constitution that ignores the whole elected Parliament in choosing and appointing judges - SC judges, especially - is a flawed constitution! Is this why Mr. Modi and his cabinet and whole BJP remain silent? The CJI seems to operate and makes not only legal pronouncements about the cases in front of his bench, he freely and improperly makes many personal statements, comments, denigration including threats of "Contempt of Court" weapon at anybody that criticizes him or the court! He essentially is behaving as the Viceroy 2.0 with assumption of absolute power. This is insane. The court(s) have been usurping the power of the elected parliament and issue "Fatwas" with threats even to the PMO and its cabinet. Who is going to "bell the cat"? And with history of targeng all Hindu traditions, beliefs, rituals, temples, priests, its history, Devatas and Davies while coddling and totally ignoring the obviously wrong and illegal mass scale activities by the Muslims and Christians! I am surprised Mr. Deepak has not been the victim of a venal punishment from these "Me Lords" yet, as he practices law in their chambers and still pointing out these egregious assault on reason and the Hindu culture. Are there any provisions in the constitution to impeach these 'Me Lords'?

    Dear sai Deepak sir, please deliver your knowledge to us as much as possible to cleanse this society as me like common people who fought legal battle for 40 long years for a piece of my father's land given by government of Andhra Pradesh. Till to date the local bodies did not come forward to lay 30 ft road in my locality as per LP 11/1984. Reason the space meant for road has been under encroachment for 30 long years taking lenience of the local influencers and administration failure. Courts did not diver it's judgement so far since the petitioner was forced to withdraw case by Commissioner favouring the encroachers. The legal battle went for 20 yrs out of court and for 20 yrs in the courts. Still justice not done....

    Sorry. To meet the standard you desire, the people, the voters, should have a very high level of understanding about how to set a legal framework and what should be constraining laws.       @kannan Sankaranarayanan, In India people have repeatedly displayed sagacious clarity from time to time - throwing out Indira ji post emergency, voting for Centre and State to different parties, though election was on same date, etc. Many States parties get thrown out literally every alternate election, Rajasthan, Uttarakhand, HP, Karnataka, etc. Therefore, your plea that electorate are not good to elect a government cannot be reason to let judiciary have a free pass.
      We saw how the SC is wading into Covid relief, Oxygen allocation, BCCI administration, NEET, CUET, appointment of Railway staff, you name it, they are there. At least Executive should sit with collegium and agree on common minimum boundary and get it ratified by Parliament.

      @@ramanvk5523 You do have a great point. But, if we look carefully, it is only a defensive move. The voters have responded emotionally on a single point agenda against a particular issue. Though this is welcome, it is neither adequate nor comprehensive. This has actually led to the present political clashes where parties try to set a particular anti-government narrative through protests on each and every initiative of the government. As Sai Deepak warns, Judicial activism also has inherent risks. Especially when the judiciary picks its own people without any oversight of people or their elected representatives. But, to say that the voting electorate, normally swayed away by emotions and freebie /seemingly social welfare announcements, can effectively elect an assembly or parliament that can frame appropriate and fair laws...also seems to be far fetched.

    The problem which sai stated was the most impkrtant of all. The inefficiency of thr executive and the increasing disappointment of the people has what led to increase in judicial activism and it is justified and a legit reason that its not the courts fault but the executive and i fully agree. The only possible ways is to curb the judiciary which will propose an old threat which was subversion of the constitution during emergency and the helplessness of the courts. The solutioms though not the best but i think can curb this an itsy bit would be that we form a committee of parliamentary committees and appointing judicial memebrs as overcome their differences. This would look into what would fall in the jurisdiction of the courts and parliament and try to strike a perfect balance. This way we can have a balance of power between the two as i believe judiciary should play an important role but this has only lead to their interference within the jurisdiction of the executive. They need to understand that its a democracy and government which does not live up to peoples expectations will definitely fall. Therefore, effective solutions would only be social reforms and the above mentioned solution. Important point- courts need to understand that they are looked up as liberal bodies therefore on matters such as the sabrimala verdict- they had to make this judgement or this would only lead to the discourse of the relation between the courts and people. They need to realise at this point they are Monopolised. But fortunately, a 7 judge commiitee would look into these similar cases. But i dont know when itll be passed😂

    The Prime minister should strive to end the parivarvad in the appointment of judges also as he promised from the ramparts. Parivarvad in politics cannot be necessarily portrayed as it involves no will of people. But in the judicial appointments, it is always against the will of the people as it is neither their will nor in their interest to confine, at least in the apex court, the selection of judges in their volition who wield supreme power, to a handful of parivars. Till now, most of the Judges were the progeny of the eminent(?) of the judiciary, both bar and bench. Now a scenario of even CJIs making family rows is there. The Prime minister should try with a brave-heart to put down such interests by introducing a transparent, non- entitlement-oriented appointment of judges, especially of CJIs which do not smack of favoritism. He must ward off any danger to democracy and constitution by highly opinionated masters who can pose just tweaking the roster as four judges famously pointed out.

    Is it not a failure of our parliaments to give the ultimate power to those who are not even tested foR iq? (why not introduce an exam at par with JEE?)
    And if they are not appointed by the President in consultation of the head, are not all of these appointments illegal?

      in no international court, any of the orders passed here, would be valid if it could be contested that the appointments are not legal and so are the orders passed.

    I really admire Sai Deepak for his knowledge and passion. But what I am disappointed is, in all of his talk shows, the audience DO GET inspired, clap loudly, but but but . after the show they just dust their backsides and go home.
    That could be because of the reason, they do not know how to counter the attack on HINDUISM.
    Now SAI DEEPAK is eloquent speaker and he can convince and galvanize some POLITICIANs or POLITICAL PARTY to initiate actions, protests, PILs against demolition of hindu temples, against diversion of the monen taken from hindu temples and given to MUSLIM & CHRISTIAN places of worship.
    Why nothing is being done. If I understand correctly SAI DEEP himself is an advocate, yet I didn’t note any PILs filed by him against the DMK Govt of Tamil Nadu?

      His job is to enlighten and educate. What is preventing you from using his Knowledge and doing something?? What does he have to do with DMK, he’s already fought for Hijab and Sabrimala. You can file petitions too

    Role of judge ends with interpretation of law. Exceptional case can go the merit of the case. Union government should leverage modern technology to eliminate the dependency and lacuna over cases which could be solved without trail.
