It's not murder but Culpable Homicide (killing without intention). If it was murder, he would still be in prison as he would be serving a Life Sentence. Murder is the intentional killing of another human being, often premeditated. Oh, by the way, sometimes with Culpable Homicide, you can spend your prison time outside on probation for the amount of years you would have served in prison for. I hope this assisted in some way.
